This Agreement shall be in effect from OGtober 1, 1980 until amended or terminated. WITNESSETH: - WHEREAS, the State Agericy pursuant to Public Law 95-627 and the Regulations, instructicns and gui�elines issued by the United States Department of Agriculture, Food and Nutrition Service (USDA-FNS) in accordance with that Law, wishes to administer the WIC Program within the jurisdiation of the State, and WHEREAS, the State Agency has determined that the Local Agency meets all requirements to administer a local WIC project. IT IS, THEREFORE, AGREED BY AND BETWEEN THE TWO PARTIES THAT: 1. The Local Agency shall administer a WIC Program within its designated service area in an efficient and effective manner pursuant to the USDA-FNS Regulations issued in accordance with Public Law 95-627, and applicable state Rules, policies and grocedures. Specifically, the Local Agency agrees to: a. Have the competent professionals, facilities, and equipment necessary to perform the Minnesota WIC Program certification procedures. b. Determine and certify eligible persons for the Program according to established certification procedures, document certification actions on the state prcvided certification form, provide Program benefits to those certified on a timely basis, and reassess eligib�lity at the prescribed intervals. � . � � -2- ��'���� c. Make available appropriate health services to WIC participants. d. Provide nutrition education services to WIC participants in accordance with state policy and procedures and consistent with the local nutrition education plan. � � e. Operate the Minnesota WIC Program Automated Food Delivery and Management Information System in accordance with state policy and procedures, including; establishing and maintaining on a timely basis the 'AIC Participant Masterfile, and maintaining accountability and in��Antory controls over WIC food vouchers. f. Contract with retail food vendors within the service area, and train and monitor those contracted vendors to assure compliance to program requirements. g. Maintain complete and accurate Program and fiscal records and files in accordance with the financial management requirements and consistent with the Federal WIC Regulations, Federal Management Circular 74-4, Office of Management and Budget Circular A-102, and applicable state Rules policies, and procedures, including source documentation to support program activities and expenditures made under the terms of this Agreement. h. Submit by the seventeenth (17th) of each month the Claim for Reimbursement/ Report of Expenditures form, which shall summarize the funds actually expended during the report period by budget line item, the amount of funds currently obligated, including the amount of funds expended, obligated, anc3/or the value of in-kind services contributed related to nutrition education, and the status of the WIC cash on hand. � i. Provide access to authorized representatives of the MinnFSOta Department • of Health, USDA, the United States General Accounting Office, 5tate Legislative Auditor, or any of their duly authorized representatives, to all records, files, and documentation related to this Agreement for ' purposes of inspection, auditing, or copying. �• � � • j. Comply with various state and federal Laws and Regulations to assure that no person is discriminated against on account of age, race, color, sex, handicap, religious creed, national origin, ��r political beliefs. k. Obtain written consent from the State Agency prior to th� assignment or � transfer of any interest in this Agreement, except that claims for - money due or to become due to the Local Agency from the State Agency may be assigned to. a bank or other financial institution without such approval. , ' �Fg, �° � ����1.D�t�l,/ -3- 1. Assure that no interest exists, directly, or indirectly, which could conflict in any manner or degree with the performance of services required to be performed under this Agreement. m. Obtain written approval from the State Agency prior to the subcontracting of any work or services covered by this Agreement. 2. The State Agency agrees to: a. Provide payment for services in an amount established by the parties on an annual basis in accordance with the current market value of the services to be rendered, which amount shall be reduced to a written grant letter and upon execution by the Commissioner of Health shall be a part of this Agreement. Such payment for services shall be contingent upon receipt of funds from the United States Department of Agriculture and a properly sub- mitted Claim for Reimbursement/Report of Expenditures from the Local Agency. b. Provide technical assistance and consultation to enable the Local Agency to establish and administer a �9IC Program. c. Provide appropriate for.ms and materials necessary to establish and administer a WIC Program. d. Provide copies of the USDA-FNS WIC Regulations, the Minnesota WIC Program Operations Manual, and other instructions and guidelines on a timely basis necessary to establish and administer a WIC Program. e. Designate Greg Smith, State WZC Administrator, as its authorized agent � for the purpose -of administratien of this Agreement. Such agent shall - have full responsibility for the supervision o� the work involved under this Agreement and shall certify each claim submitted pursuant to para- graph 2a, that the services for which payment is requested have been rendered in a satisfactory manner. 3. This Agreement may be cancelled by either party upon thirty (30) days written � notice. In the event of cancellation, all finished or unfinished documents, data, studies, surveys, drawings, maps, models, photographs, reports, etc. , . prepared by the Local Agency and related to and funded in part or whole by WIC shall, at the option of the State Agency, become its property. Payment shall be made for services rendered pursuant to this Agreement to the effective date of cancellation. . 4. Any changes to this Agreement will be valid only if made in writing and accepted by all parties to this Agreement. � � • -4- �'►4���� 5. The individuals or officer signing this Agreement for the Local Agency must be authorized to sign and execute this Agreement on behalf of the responsible governing board, official, or agency; and certify that all terms of this Agreement will be appropriately adhered to; and, that records and detailed documentation for the WIC Program will be maintained for a period of not less than three (3) years from the date of the submission of the final expenditure report or until audit findings have been resolved.
