WHEREAS, the Saint Paul Port Authority was granted a broad
array of powers, including the power of eminent domain, to under-
take a governmental program of economic development, and
WHEREAS, H.F. 246 would prevent the Saint Paul Port Authority
from acquiring property by eminent domain and require that such
action be taken by the City of Saint Paul, and
WHEREAS, the power of eminent doma.in is essential to the Port
Authority' s qualification as a political subdivision and its ability
to issue revenue bonds, and
�IEIEREAS, the elimination of the powers of eminent domain would
require a ma.jor restructuring of the Port Authority and jeopardize
its ability to ma.rket revenue bonds, thus adversely affecting the
Saint Paul Port Authority, the City of Saint Paul and its citizens;
now, therefore, be it
RESOLVED, that the City Council hereby opposes H.F. 246 and,
be it
FURTHER RESOLVED, that the City Clerk shall transmit �a copy
of this resolution to the Ramsey County Legislative Delegation for
its consideration and action.
