WHEREAS, Chapter 293 of the
enacted to regulate the subject

WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, Schwietz Saloon, represented by Maureen Mariano,
owners who has been designated as the responsible person on the
application, has applied for a variance to allow live music at
956 Payne Avenue, on September 14, 15 and 16, 2000; and
WHEREAS, applicant is seeking a variance for the hours of
8:30 p.m. to 12:30 a.m. on September 14, 15 and 16, 2000; and
WHEREAS, if applicant is not granted a variance it will not
be able to present the live music; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to Schwietz Saloon, subject to the following
conditions:
1) The variance shall be for the hours of 8:30
p.m. to 12:30 a.m. on September 14, 15 and
16, 2000.
2) Al1 electronically powered equipment used in
conjunction with the event shall not exceed
90 dBA from 8:30 p.m. until midnight on each
of the dates and shall not exceed 85 dBA from
midnight until 12:30 a.m. on each of the
three dates. Measurement of the sound level
shall be performed at a dist n�e between one
to five feet south of the "� ��� on the
south side of Case Avenue by the entrance to
the tent.

3 equipment who shall provide continuous sound QO
4 level monitoring between 8:30 p.m, and 12:30
5 a.m. on all dates to ensure compliance with
6 Condition #2.

9 4) All electronically powered equipment, PA
10 systems, loudspeakers or similar devices
11 shall be turned off no later than 12:30 a.m.
12 on September 15, 16 and 17, 2000.

14 FURTHER RESOLVED, that any violation of the conditions set
15 forth above on the September 14, 2000 date may result in
16 revocation of the grant oP a variance for the September 15 and
17 16, 2000, dates, and any violation of the conditions set forth
18 above during the September 15, 2000 date may also result in
19 revocation of the grant of a variance for the September 16, 2000
20 date, in addition to any criminal citation which might issue.
