An Ordinance to amend Chapter 315 of the
Saint Paul Legislative Code to provide for �>_,
all-night restaurant licenses for on-sale
liquor establishments. '
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
Chapter 315 of the Saint Paul Legislative Code is hereby
amended to read as follows:

No pre�c�ises licensed for the sale of both food and
intoxicating liquor and or non-intoxicating malt liquor
shall remain open for any business between the hours of
one o'clock A.M. and five o'clock A.M. and no person
other than employees shall be permitted to enter or remain
upon the remises unless the operator has obtained a
Special Food License pursuant to this chapter.

315.83.- 02 . Application of Chapter.
a. It is the intent of this chapter to
apply to those places only in which e�e-se�e1
both food and a�eel�e��e-d��nks; intoxicating
liquor and/or non-intoxicating malt liquor ar�
served, and it sha�l not apply to places in which
food alone is served. In the event the sale of
food and a�eei�e��e-�1��n3�s intoxicating liquor and/
or non-intoxicating malt liquor by the drink is
now or hereafter authorized in any place of busi-
ness the Proprietor may prnvide a room or rooms
in which no a�eel�e��e-e1���3�s-a�e intoxicating
liquor or non-intoxicating malt liquor is served
at any time, and such room or rooms may remain
open for the service of food at all hours. Such
room shall, however, be distinctly separated from
that part of the building in which tke-a�eel�e��e
d���3�s-a�e intoxicating liquor or non-intoxicating
malt liquor is served, which part shall be entirely
closed during the hours provided for in Section
315 . 01.

b. If any place of business is a�x�l�e���ee� licensed
to sell food and a�eel�e��e-el��n3�s intoxicating
liquor and/or non-intoxicating malt liquor by the
drink and also to provide sleeping accommodations
for the public, such place of business may remain
open at all hours for the purpose of providing such
sleeping accommodations only but in all other re-
spects such places sha11 be subject to the provisions
of this chapter.
� 315. 03 Apn�icatior� for Speeial Food License .
Any person operating under an "on-sale" license for
the sale of non-intoxicating malt liquor or non-
intoxicating malt liquor and wine, or any person
operating under an "on-sale" intoxicating liquor
license within the boundaries of the Downtown
Business District who desires to remain open all
night for the service of food, may apply for a
special food license in the manner provided for
the making of application for a regular food license.
The annual license fee for such s ecial food license
shall be one hundred dollars ( 100.00) , which shall
be in addition to the fee for a regular food license.

315. 04 . Conditions.
a. The number of such all night special
food licenses which shall at any time be issued
and outstanding shall not exceed twenty-five

b. All persons holding such special food
licenses shall kee their places of business
open continuously for at least fifteen 15
hours each day for twelve months in the year
for service of food to the public.
c. During the hours in which the sale by
the drink of intoxicating liquor and non-intox-
icatinq malt liquor is prohibited by statute,
all liquor and all liquor dispensers shall be
covered and secured from public view and access-
ibility by a locking device .
d. No such special food license shall be
issued to an applicant unless he is the actual
owner or proprietor of the business at the lo-
cation specified in the license.
e. Consent of Neighbors. At least thirty
(30) days before a public hearing on an
application for an all night restaurant license,
the Department of Finance and Management
shall notify by mail all owners and occupants
who own' property or reside within three hundred
(300 feet of the establishment to be licensed and
all community organizations that have previously
registered with said department, of the time,
place and purpose of such hearing. 8aid three
hundred (300 feet being calculated and computed
as the distance measured in a straight line from
the nearest point of the building where intox-
icating liquor is sold, consumed or kept for
sale to the nearest point of the property line
owned, leased, or under the control of t e
resident. Prior to the hearing date, the Depart-
ment of Finance and Management shall submit to

the License Committee of the City Council
a list of the names and addresses of each
person or organization to whom notice was
sent, and certification of such list by the
Clerk shall be conclusive evidence of such
notice. The applicant shall present with
hi ps a plication a statement in writing by
the owners and tenants of seventy-five
percent (75�) of all private residences,
dwellings and apartment houses located
within two hundred (200) feet of such
premises to the effect that they have no
objection to the granting of such all night
restaurant license or the operation of the
business of conducting an all night rest-
aurant at the location proposecl, providing
nevertheless that such consent shall not
be necessary when the premises whereon the
all night restaurant is proposed is zoned
as a light or heavy industry district, or
wit in the boundaries of the Downtown
Business District.
315. 05. Revocation of Licenses. Upon conviction
for a violation of this chapter, in addition to any
other penalties which may be imposed, all licenses
of every kind or nature issued by the City of St.
Paul to the person so convicted and under which the
person so convicted conducts the business of selling
food or a�ee�.e��e-d���3�s liquor shall be revoked by
the City Council. The spec—i 1 all night food license
may be revoked by the City Council after notice to
the licensee and hearing for any of the causes re-
quiring revocation of on-sale liquor licenses , as
well as for violations of this chapter.
315.06. Downtown Business District. For purpose
of this section, Downtown Business District shall in-
clude all that portion of the City of Saint Paul lying
wit ih n and bounded by the following streets : Beginning
at the intersection of Shepard Road with Chestnut Street
to Pleasant Avenue, Pleasant Avenue to Kellogg Street,
Kellogg Street to Summit Avenue, Summit Avenue to
Tenth Street, Tenth Street to Interstate Freeway 94 ,

Section 2.
This ordinance shall take effect and be in force thirty

RE: Al1-Night Food License Ordinance
I am again introducing the all-night food license ordinance.
As you may recall , this ordinance was introduced earlier and was
voted down. The new ordinance, however, addresses some of the
concerns that were raised by persons who previously did not support
it. One specific new feature in the new ordinance is that, in
neighborhoods , only wine and beer licensed establishments can
receive the all-night food license and the neighborhood consent
provision requires an affirmative 75% of all private residents
within 300 feet of the premises. Establishments in the downtown
district licensed to sell wine, beer and liquor can receive the
special food license and no consent provision is required.

potential support for the ordinance.
