William Donova.n Valuation and Assessment Engineer Date: Jarivary 1�+, 1981 Subject: Petition of Richard E. Prokop for the va.cation of an unimproved alley in P'hilip Potts' Addition. Public Hearing - Jan�ry 20, 1981 The petitioner requests the va.cation of this unimproved alley ori.gi.nally platted in 1886. The area to be vacated is 20 feet wide and 280 feet long, consisting of.5,600 square feet and zoned RT-l. The petitioner now owns all the abutting property to said alley and proposes to include the a11ey with the abutting property to provide additional space for his _ personal use. The petitioner also requests the vacation to eliminate possible serious title problems in as much as his existin� 100 year old hause may encroach on the pla.tted alley. The Depa.rtment of Public Works has reviewed this praposed va.ca.tion and has no objection to the vacation as proposed. Staff of the Department of planning and Economic Development has reviewed the subject petition and finds no objection to the vacation as proposed. ' There were no objections from an�y other public or priva.te agencies involved. In vie�w of the foregoing, I recommend the vacation be approved, subject to the following terms and conditions: l. That the description of the alley to be vaoated be as follc�ws, to wit: Al1 of the alley as dedicated in Philip Potts' Addition. � /�. That the vacation be sub�ect to all the terms and cOnditions , of Chapter 228 of the St. Faul I,egislative Code, as amended. � .�.
