Villaume, III $�}� Assistant City Attorney� L" DATE: February 6, 1981 RE: Claim against City of St. Paul by Bart T. and Irene M. Fitzgerald Claimant Bart T. Fitzgerald was injured on February 17 , 1979, near 466 North Lexington Parkway when he slipped and fell while attempting to negotiate a snowbank between the parking lot and the sidewalk. He sustained a fracture to both the tibia and fibula of his right leg resulting in a 5% permanent disability. His med`ical expenses exceeded $800 and he was off work several months . He brought suit against the owner and tenant of the property adjoining the sidewalk as well as the City and a private service which provided the snow removal. The total settlement equalled $6,400.00 and the City's contribution reflects its limited liability. We approve the settlement of this claim in the amount of $500.00. FEV:paw enc. cc.
