WHEREA5, the City Council opened Hubert Street (later
renamed Livingston Avenue) on March 5, 1887 over parts of
Blocks 1, 9 and 10, Eaton and Morrison's Addition to West
Saint Paul, where no street was platted; and
WHEREAS, the City then acquired deeds to the rever-
sionary interests of most of the fee owners at the time of
the opening of Hubert Street; and
WHEREAS, the City Council vacated this portion of the
street on November 20, 1973; and
WHEREAS, the title of the street did not pass to the
adjoining landowners because the street was an opened
street and not a dedicated street. The title remains with
the 'City wh�e the City received deeds, or with the owner of
the underlying lot where the City did not receive a deed; and
WHEREAS, the Housing and Redevelopment Authority of the
City of Saint Paul, Minnesota (HRA) is the adjoining property
owner on the Northwest side of said vacated street; and
WHEREAS, the HRA desires to obtain title to the street,
or as much thereof as the City has title to, to provide
additional land for development in the area.
RESOLVED, that the proper officials of the City of Saint
Paul be and hereby are authorized to execute a quit claim
deed to the Housing and Redevelopment Authority of the City
of Saint Paul, Minnesota to the vacated Livingston Avenue as
described in the attached deed.

� THIS INDENTURE, Made this day of , 1981,
between the CITY OF SAINT PAUL, MINNESOTA, a municipal corporation
under the laws of the State of Minnesota, party of the first part,
and the HOUSING AND REDEVELOPMENT AUTHORITY OF THE CITY OF SAINT
PAUL, MINNESOTA, a body corporate and politic, party of the second
part.
WITNFSSETH, That the said party of the first part, in consid-
eration of the sum of ONE DOLLAR ($1.00) AND OTHER GOOD AND
VALUABLE CONSIDERATION, to it in hand paid by the said party of
the second part, the receipt whereof is hereby acknowledged, does
hereby Grant, Quitclaim, and Convey unto the said party of the
second part, and its assigns, Forever, all the tract or parcel
of land lying and being in the County of Ramsey and State of
Minnesota, described as follows, to-wit:

TO HAVE AND TO HOLD THE SAME, Together with all the heredit-
aments' and appurtenances thereunto belonging or in anywise
appertaining, to the said party of the second part, its successors

Paul (originally called Hubert Street) pursuant to Order of
Common Council March 5, 1887 confirmed by the Board of Public
��Torks May 2 , 1887, and filed June 2 , 1888 , in Book 5 of Street
Openings, paae 3 , lying over parts of Lots 1, 2 , 3 , 5 , 6 , 7 and
8 , Block 1, Lots 1, 2 , and 3 , Block 9 and vacated Chadwell
Avenue and vacated Morrison Street accruing thereto of said
Eaton and Morrison' s Addition more particularly located as
follows:
Commencing at a point where the �Tortherly border of said Eaton
and P�iorrison' s Addition (also the Northerly line of the South
half of the Southwest Quarter of Section 5 , Township 28 North, '
