SUBJECT :
Request variance of Section 13. 03, Uniform Building Code , pertaining to
smoke door rec{uirements in stair tower, to obtain Certificate of Occupancy ,
because appellant considers rec{uirements "unfair and unreasonable . "
Prior Hearing 12/9/80 : Continued hearing to January meeting to allow time
to consult with housing code office on possible alternative solution.

PROCEEDINGS :
Chairman Glassman said he would abstain from partipating in the discussion
of this case because of a past business association with the property.
Alice Bijjani explained that a three-story complex must have two enclosed
exitways from each floor. Enclosure is required to keep £ire and smoke
from spreading from one floor to the next and to provide smake-free towers
in case of fire . In this building , a total of six part�tions and smoke
dcaors to enclose the stairwells have been ordered installed by the city,
ar.d, in addition, ten fire-rated apartment doors are required.
Lana Cheatham, president of Merriam Park Community Council , said that
her organization had discussed this case and asked that the request for
a variance be denied.
Mr. Hughes stated that it would be difficult for him, financially, to do
the required work immediately , and asked that he be granted an extension
of time if the board sh.ould decide to deny his reauest for variances .
BOARD ACTION:
Mr. Sawyer moved that an extension of time to M�rch 30 , 1981 , be granted
to enclose the front stair tower, and to September 30 , 1981 , to enclose
the rear stair tower and provide fire-rated doors on ten apartments .
Mr. Tilton seconded. MOTION CARRIED AND SO ORDERED.

tiValter, please give special attention to my wording o� the action
on the F. Scott Fitzgeral Condominium case . I have not xeceived
the copies of the signed waivers yet, but have been assured they
are on their way. As long as I had this much done , I thought I ' d
send it down to you for review even though the waiver is missing.
Please also look at the way I have set up the Public Housing Agency
case where their appeal covered six different high-rises . I did it
�his way rather than set up six separate sections and repeating the
same Board Action after each.
