1 WAEREAS, The City of Saint Paui, Division of Pazks & Recreation, provides a variety
2 of special events for youth including track & field meets; and
4 WHEREAS, Saint Paul Parks & Recreation is in need of space for its growing track &
5 field program; and

7 WHEREAS, Macalester College of Saint Paul owns land at 1600 Grand Avenue which
8 includes an athletic track; and
9
10 WHEREAS, Macalester College is willing to give permission for Parks & Recreation to
11 use their field space for the period from April 1, 2000 to August 1, 2000, Monday through Friday
12 from 7:00 p.m. to 9:00 p.m., but wishes to haue the City indexnnify and hold the College
13 harmless from claims related to the City's use of the facilities; and

WHEREAS, provision of track & field opportunities serve a legirimate public purpose by
serving the youth of the City; and
WHEREAS, the expenditure of public funds, which includes the promise of
indemnification and defense, for such a purpose will facilitate xnd allow the City to provide such
opportunities, now therefore, be it
RESOLVED, that the City Council of the City of Saint Paul on behalf of the City of Saint
Paul hereby agrees to defend, indemnify and hold Macalester Coilege harmless from any and all
damages it may be required to pay as a result of suits, claims, actions, or judgments arising out of
the use of Macalester's athletic track at 1600 Grand Avenue which are attributable to the
negligent act or omission by the City of Saint Paul, its employees, agents or contractors.

2 Fi.JRTHER RESOLVED, that this indemuification does not include: 1) injuries or
3 damages arising from hidden traps or dangerous conditions of the facilities and track itseif as to
4 which the College had actual or constructive norice; and 2) damages or injuries arising out of
5 occurrences or events which are not part of the authorized use of the premises or which do not
6 take place on the premises during the period of time use is authorized. Furthermore, nothing in
7 the foregoing provisions shall be constnxed as a waiver o£the municipal tort liability limits and
8 defenses set forth in Mimi. Stat. §466.01 et. seq.
