vacation of Northwesterly portion of the public
a11ey in Block 21, Desnoyer Park Addition
Public Hearing - October 13, 1g81
The two getitioners are the sole owners of the abutting property to
the Northerly 60 feet of a public alley located in Block 21, Desnoyer
Paxk. They request that this portion of said alley be vacated as a
public right-of-way. The vacated area will be used by the petitioners
for their priva,te use (garden area on the South 1�2 and new garage on
the North 1�2) . The area to be vacated is an unimproved alley 20 feet
by 60 feet, (1,200 square feet) with a permanent sewer easement over
and across the sauth 30 feet thereof. The area is zoned R-3, Single
Family Residential.
The Department oP Public Works has no objections to the vacation,
subject to the retention of an u.nderground permanent sewer easement
for the existing Sandrock Tunnel that crosses this alley.
Northern States Pawer Company reports that they have overhead conductors
in the proposed vacation area. They request that their interest be
protected.
The Northwestern Bell Telephone Company reports that they also have aerial
conductors in the proposed va.cation area. Theq request that their interest
be protected.
There were no objections from any other public or private agencies involved.
In view of the foregoing, I recommend the vacat3;on be app�oved, subject to
the following terms and conditions:
1. That the description of the alley to be vacated read
as folla�ws:
All of the Northwesterly 60 feet
of the public alley in Block 21,
Desnoyer Paxk Addition lyin�
between Lots 1 and 14 and North
20 �eet of Lots 2 and 13 all in
said addition.

� --�": That the vacation be subject to all the terms and
conditions of Chapter i3o, coclif`ied March l, 1981
of the St. Paul Legislative Code, as amended.
Z 3• That a specific easement be retained to protect
the interest of Northern States Power Company
within the vacated portion of said a11ey.
�-�. That a specific easement be retained to protect
the intereat of 1Vorthwestern Bell Telephone
Compa.r�y within the vacated portion of said a11ey.
c�S�'. That a full width permanent sewer easement must be
retained across the southeasterly 30 feet of the
vacated Northwesterly 60 feet of said alley in
Block 21, Desnoyer Park Addition.
Restrictions within the easement area axe as
follows:
a. That no buildings, structures, or
trees are permi.tted within the
easement area, or any temporaxy
structures, material storage,
f`ixture or other ab�e�ts that
will prohibit normal access to
sewer facilities for maintenance
purposes.
b. That no change from the existing
grade is permitted withaut written
permission from the Sewer Engineer.
c. That no change in surfacing within
the easement area is permitted
without wri.tten permission from
the Sewer Engineer.
d. That the petitioners, their succes-
sors and assigns, shall flilly indem-
nify, defend and save harmless the
City of Saint Paul, �r officers,
agents, employees, and servants
from a11 suits, actions or clai.ms
which shall arise from ar�y in�uries
or dama�es received or sustained by
any break in any service pipe or
connection in said reserved easement,
arising out of or resulting from any
action or negligence of the petitioners,
their employees, agents or business
invitees.
��S. That the petitioners pay to the City as market value the
suzn of $900.00 as compensation for the vacation.
