An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining
to zoning for the City of Saint Paul and
the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes �462.357 and �64.210
of the Legislative Code, Otto and Ruth Trapp duly petitioned to
rezone Lot 11, Block 15, Dawson's Addition, located on the north-
west corner of r�iorton and Charlton, from R-4 to RT-1 for the pur-
pose of converting a single-family home to a two-family dwelling,
the petition having been certified by the Department of Finance
and Management Services on July 20, 1981 as having been consented
to by at least 67� of the owners of the area of the property to be
rezoned, and further having been consented to by at least two-
thirds of the owners of the property situated within 100 feet of
the total contiguous descriptions of real estate held by the same
owner or any party purchasing any such contiguous property within
one year preceding the date of the petition� and
WHEREAS, The current Zoning Committee on September 3, 1981
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107,03 of the Admini-
strative Code, submitted its recommendation to the Planning Com-
mission that the petition be granted; and
TrdHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on September 11, 1981 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

THE COUNCIL OF THE CITY OF SAINT PAUL DOES OR.DAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 37,
as incorporated by reference in Section 60. 301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the northwest corner of
Morton and Charlton, being more particularly
described as Lot 11, Block 15, Dawson ' s Addition,
be and is hereby rezoned from R-4 ta RT-l.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage,: approval and publication.

Dear Sir:
This letter is written in response to the petition of Otto and Ruth Trapp to rezone
property at 251 W. Morton Street (northwest corner of Morton and Charlton) from
R-4 (single family residential ) to RT-1 (two family residential ) to convert a single
family home to a duplex.
The Zoninq Committee conducted a public hearing on this case on September 3, 198]r-
2 1 etters we"P�'T�t.�eTi nY sup rt of the rezon i ng. Ral ph Brown, 255 Morton,
testified on behalf of the applicants. The Zoning Committee voted 6-0 to recommend
approval of the rezoning.
The P1 ' n considered the Zoning Committee`s recommendation on
September 11 , 1981 , and voted 18-0 to approve the rezoning.

The requested rezoning is scheduled to be heard by the City Council on October 15,

A. PURPOSE: Rezone from R-4 to RT-1 to convert a single,family home to a two-family dwelling.
B. SUFFICIENCY: Declared sufficient by the Finance Department on July 20, 1981 . Parcels
eligi le: 12; parcels needed: 8; parcels signed: 8.
C. PARCEL SIZE: 47' on Morton x 150' on Charlton = 7,050 square feet.
D. SITE & AREA CONDITIONS: The site is occupied by a single-family house built in 1928.
The surroun ing area is primarily one and two family residential . Bryant School is
located kitty-corner from the site to the southeast.
E. FINDINGS:� • •
l . The site was zoned "A" Residence from 1922 until 1975, when it was designated R-4.
2. In an RT-1 zone, a lot ar�a of 6,000 sq. ft. and a. lot frontage of 50' is required
for two family use. The parcel has adequate lot area to meet the requirement;
however, the frontage is only 47' .
3. The house is a 12 story house with a foundation size of 1 ,272 sq. ft. Two�off-street
parking spaces are available.
4. The Land Use Plan states that the City will establish criteria to allow sensitive
reuse and conversion of existing housing structures. The site appears to have
sufficient lot area, structure size, and off-street parking for two family use.
5. A large RT=1 district is located just north of the site. Moreover, the 1974
Land Use Survey indicates that there are several duplexes in the immediate area.
F. STAFF RECOMMENDATION: Sased ort findings 3, 4, and 5, staff recommends approval of

The applicants were represented. There was no opposition present at the
hearing.
Ms. Daykin sho��ed slides of the site and reviewed staff findings wit� a
recorr�nendation for approval . Pdo correspondence was received on this matter.
Ralph Brown, a neighbor representing the applicants, 255 Morton, presented
2 letters in support of the rezoning. He stated that the applicants feel
the house is of adequate size for rezoning, it does have 2 off-street
parking spaces, and would not constitute spot zoning because within a 61ock
radius there is a pTayground, a recreation buildi:��, a multi-service center, .
a school and a city pool . In addition, there are a lot of dup1exes in the
area; there is not a large expanse of single family homes. Mr. Brown alsa
stated that he was speaking in behalf of the surrounding neighbors who are
iri support of the rezoning.
Hearing no further testimony, Mr. Bryan closed the public hearing partion of
the meeting.
l4r. Pangal made a motion to recommend approval of the rezoning based on
findings 3, 4, and 5 of the staff report. Ms. Summers seconded the motian.
The motion passed on a roll call vote of 6 to 0.
