An ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining
to zoning for the City of Saint Paul and
the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes �462. 357 and �64.210
of the Legislative Code, David Wall duly petitioned to rezone Lots
4, 5 and 6, Block 5, Hersey Woolsey Addition, located on the south
side of Taylor between Syndicate and Griggs from R-4 to RM-2, to
allow construction of a seven unit apartment building, the petition
having been certified by the Department of Finance and Management
Services on July 31, 1981 as having been consented to by at least
67� of the owners of the area of the property to be rezoned, and
further having been consented to by at least two-thirds of the
owners of the property situated within 100 feet of the total
contiguous descriptions of real estate held by the same owner or
any party purchasing any such contiguous property within one year
preceding the date of the petition; and
P�HEREAS, The current Zaning Committee on September 3, 1981
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107 . 03 of the Admini-
strative Code, submitted its recommendation to the Planning Cozn-
mission that the petition be granted; and
Tr7HEREAS, The Planning Commission considered the rezoning
petition at its meeting held on September 11, 1981 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

WHEREAS, A public hearing before the City Council, having
been conducted on October 15, 1981 where all interested persons
were heard, and the Council having considered all the facts and
recommendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 11,
as incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on south side of Taylor
between Syndicate and Griggs, being more
particularly described as Lots 4, 5 and 6,
Block 5, �-Iersey Woolsey Addition, be and is
hereby rezoned from R-4 to RM-2.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
This letter is written in response to the petition of David t�lall to rezone
three vacant lots on the south side of Pierce Butler between Syndicate and
Gric�gs from R-4 (one-family residential ) to RM-2 (medium densit,y multi-
family residential ) to allow construction of a seven unit (seven 1-bedroom)
apartment buildings.
On August 11 , 1981 , the Board of Zoning Appeals voted 5 to 0 to approve a
request for variance of front and rear yard setbacks contingent upon
successful rezoning to Rf9-2.
On September_ 3� 1981 . the 7�ninq_Commi_t�cQn�ed a public hearing on
� e case. representative from the District 11 Council testified in
opposition to the rezoning. The District 11 Council also submitted a
letter in opposition to the rezoning expressing concern about the density
of the project. The Zoning Committee voted 5 to 0 to approve the rezoninq.
The Plannin Commission c n ' Zoning Committee's recor�mendation
on Septem er , 1981 , and voted 18 to 0 to approve the rezoning.
The matter of the requested rezoning is scheduled to be heard by the
City Council on October 15, 1981 . Please notify me by October 14 if any
member of the City Council wishes to have slides of the site presented at
the City Council public hearing.

A. PURPOSE: Rezone from R-4 to RP1-2 to allow construction of a 7-unit (seven, 1-b�droom}
apartment building.
B. SUFFICIENCY: The rezoning petiti�on was declared sufficient by the Finance Department on
July 31 , 1g81 . Fifteen parcels were eligible to sign the petition; 10 were needed, and
12 were obtained.
C. FRONTAGE & AREA: The parcel has a frontage of l28' on Pierce Butler and is approximately
12,240 square feet.
D. SITE/RREA CONDITION: The parcel is vacant and it has alley access. Sur,rounding land
uses include I-1 to the north; single ramily homes to the south anu west; and vacant
lots zoned RM-2 to the east.
E. ZOP�ING HISTORY: The site was zoned a "Light Industry District" in 1922 and in the 1931
amendments; by 1971 , it was designated "B" Residence. In 1975, the site was zoned R-4,
single-family.
- F. FYNDINGS:
1 . The applicant was granted front and rear yard setback variances,subject t� successful
rezoning, from the Board of Zoning Appeals on Au�ust 11 , 1S81 , to allow for
construction of the apartment building. _
2. The site plan, submitted with application for yariances, indicates 10 off-street
parking spaces will 6e provided, wnich more than meets the Zoning Ordinance parking
� requirements. -
3, The rezoning is consistent with District 11 's vacant land proposals which specifically
recommends rezoning this parcel to RM,1 to accommodate townhouse or apartment
development.
4. The zoning is in conformance with the Housing Plan. The Housing Plan encourages a
more efficient use of land resources for housing development by encouraging
development of apartments on larger vacant 1ots or underutilized sites within built-up
neighborhoods (Policy 1,�, p.6�.
5. The rezoning is �n conformance with the Land Use Plan. The Land Use Plan states:
"On scattered vacant sites in existing neighborhoods, the City will establish
criteria which will allow new housing development at densities sor�ew�at higher
than the existing zoning but compatible vlith the general existing pattern of
development" (Policy 4.1-4, p.23)_.
6, The .rezoning is compatible with surroundin� land uses and will not create disharmony
between land uses. The vacant lots to the east of the proposed development are
zoned RM-2.

DAVID WALL (#8977) : Petition to rezone from R-4 to RM-2 to allow canstruction

Syndicate and Griggs.
Ms. Von Mosch showed slides of the site and reviewed staff findings with a
recommendation for approval . A letter was received from the Distrlct 1�
Coalition in opposition to tt�e rezoning.
Ernest Steneroden, attorney repres�nting the applicant, 770 University, reoorted
that the building will fit into the neighborhood well and be an asset to the
community. The neighboring property owners have all signed the petition
approving the rezoning, and in view of the position of the Mayor stating the
need for housing in the area, they feel that this is an acceptable project
which should be approved.
KiKi Sonnen, representing District li Coalition, testified in opposition and
requested the matter be laid over to allow time for the Physical Gommittee ta
meet with the applicant to try and reach a compromise.
Hearing no further testimony, Mr. Bryan closed the public hearing portion of
the meeting.
Ms. Sumners made a motion to lay the matter over to the meeting of Seotember 17
to give District 11 an opportunity to meet with the developer and discuss
alternatives. The motion failed for lack of a second.
Mr. Hanggi then made a motion to recommend approval based on findings 2. through
6 of the staff report. Mr. Armstead seconded the motion. The mation passed on
a roll cali vote of 6 to 0.

The District 11 Coalition's Board of Directors
voted at our Council meeting Aug. lo -�o oppose the
rezoning of the parcel at S�,^J Pierce Butler and Griggs
�from R—�- to Rl��2.
Although our district plan calls for the rezoning
to allow a six unit apartment building or toti�rnhouses at
this location, t�re noti•a believe this is not the best use
of the land. The two members of our Board, who tirere
active in the Coalition at the time of the ti�miting of
our plan and who are still active t�rith us now, report
that they were under the impression that discussions on
the rezoning recommendation in our district plan per—
tained to the SE, not S��1, parcel at Pierce Butler and
Griggs.
Our draft District 11 Housing �lan calls for a
duplex or triplex at the S���T parcel. Our Housing Committee
felt this is the best use of this irregiilarly shaped
parcel, which should also be landscaped and buffered
from the loud, heavy and fast traffic on Pierce Butler.
4�ihen our Housing Committee discussed this development
proposal at its July '$1 meetin�,it listed several concerns:
i) The rezonir�g process shauld have- preceeded the variance
p�ocess (on $-11—$1 the Board of Zoning Appeals granted
setback variances, conditioned upon rezoning to RT�2 2} ,
2) Access to the propert irom Pierce Butler appears to
create safety hazards, 3� The project does not fulfill
the need for affordable family hou�ing, and 1�) The nroject
conflicts with the Housing Plan's recommendations for
a triplex, at the maximum, at this site.

Our Physical Co::zmittee aZso discussed the project at its
aug. 11 meeting. This committee recommended no apartment build�..ng
at the site and that instead houses should be moved or constr�ucted
on the lots. This idea �,�ras first proposed by David ti�Tall, the
land ov�mer, in the summer of 19��, who said if he could not get
it rezoned, he vsould put up houses on the lots and it would not
r;iake tha-t much financial difference to him.

and the Physical Committee's recommendations and voted �o oppose
the rezoning of the parcel to R•'I-2•
