An Ordinance amending Chapter 60 of the
Saint Paul Legislative Cade pertaining
to zoning for the City of Saint Paul and
the Zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes � 462.357 and § 64.210
of the Legislative Code, the Housing and Redevelopment Authority of
the City of Saint Paul duly petitioned to rezane the Narth 1/2 of
vacated Banfil Street and Lot 16, Block 6, Winslow's Addition,
located on the north side of Banfil between West Seventh Street and
Western, from RM-3 to P-1 for the purpose of expanding a parking
lot, the petition having been certified by the Department of Finance
and Management Services on July 27, 1981 as having been consented to
by at least 67� of the owners of the area of the property to be re-
zoned, and further having been consented to by at least two-thirds
of the owners of the property situated within 100 feet of the total
contiguous descriptions of real estate held by the same owner or
any party purchasing any such contiguous property within one year
preceding the date of the petition; and
WHEREAS, The current Zoning Committee on September 3, '1981
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107 .03 of the Admini-
strative Code, submitted its recommendatian to the Planning Com-
mission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on September 11, 1981 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

WHEREAS, A public hearing before the City Council, having
been conducted on October 15, 1981 where all interested persons
were heard, and the Council having considered all the facts and
recommendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 28,
as incorporated by reference in 5ection 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the north side of Banfil
between West Seventh Street and Western, being
more particularly described as the North 1/2 of
vacated Banfil Street and Lot 16, Block 6, Winslow' s
Addition, be and is hereby rezoned from RM-3 to P-1.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
This letter is written in response to the petition of the Housing and
Redevelopment Authority to rezone property on the north side of Banfil
Street between W. Seventh Street and Western from RP�-3 (high-rise, multi-
family residential ) to P-1 (parking) to expand the parking lot for Mancini 's
Char House.
On September 3, 1981 , the Zoning Committee conducted a public hearing on the
case. A letter was received from the West Seventh Street Federation in
support of the rezoning. No one testified at the public hearing. On a vote
of 7-0, the Zoning Committee recommended approval of the rezoning.
The Planning Commission considered the Zoning Committee's recommendation on
September 11 , 1981 , and voted 18-0 to recommend approval of the rezoning.
The requested rezoning is scheduled to be heard by the City Council on
October 15, 1981 . Please notify me by October 14 if any member of the
City Council wishes to have slides of the site presented at the City Council
public hearing.

A. PURPOSE: Rezone from RM-3 to P-1 to expand the parking lot for Mancini 's Char House.
B. SUFFICIENCY: Declared sufficient by the Finance Department on July 27, 1981 .
Twenty-four parcels eligib.le to .sign the petition; .16 parcels needed; 21 parcels received_.
C. PARCEL SIZE: 82' x 134' = 10,988 sq, ft.
D. SITE & AREA CONDITIONS: The sit� is vacant at present. Adjacent ta the east is a
parking lot for Mancini 's Char House and other businesses. To the west the land is
vacant to Western Avenue. To the southwest is a 7-story apartment building.
E. ZONING HISTORY: The site was zon�d "B'' Residence from 1922 until 1975, when it was
designated RM-3. �
F. FINDINGS:
1 . The site plan indicates 23 additional off-street �parking spaces will be provided
for Mancini 's Restaurant.
2. The District 9 Plan states: "Parking should be provided by businesses either to
the xear or to the side of the business. Commercial buildings should continue
to front the street at a 0' setback. Buil�dings. should not be cr.eated with
parking directly in front of them" (.p.181. The rezoning would provide parking
to the rear of the building.
3. The Land Use Plan designates W. 7th Street as a mixed use strip �p.25� . Rezoning
the parcel to P-1 for use as parking is an appropriate land use under the Plan.
4. The rezoning is an extension of the P-1 district to the east.
G. STAFF RECOMME�IDATION: Based on findings 2, 3, and 4, staff recommends �approval of
the rezoning to P-1 . •

HOUSING & REDEVELOPN1ENT AUTHORITY (,#8975): Rezane from RM-3 to P-1 ta
expand parking lot for Mancini 's C ar House located at 347-53 Ban�Fil.
The applicant was present. There was no opposition present at the hearing.
Ms. Daykin showed slides of the site and reviewed the� staf� findings �ith a
rec4mmendation for approval . No correspondence was r�ceived on the matter.
Joe Gomez, Project Manager for the City of St. Paul , stated that a letter
was submitted by the W. 7th Street District endorsing the proposal .
Hearing no further testimony, Mr. Bryan closed the public hearinc� portion of
the r�eeting.
h1r. Levy made a motion to recommend approval of the rezoning based on findings
2, 3, and 4 of the staff report. Mr. Pangal seeanded the motion. The motion
passed on a roll call vote of 7 to 0.
