Section 1 .
T hat pe rmission and authority are hereby granted to Joyce B. Cassidy, 495 Kenny
Road, St. Paul, Minnesota and/or her successors in interest to construct, operate
and maintain a step and handrails which extend approximately u�ine (g) inches into
Brunson Street right-of-way adjacent Lot 7, Block 5, Brunson 's Addition, and
located approximately 25 feet norfih of the north line of Kenny Road.
Sect i on 2.
That the Di rector of Pub 1 i c Works i s hereby authori zed to i ssue a permi t to Joyce
B. Cassidy for the construction, operation and maintenance of said step and hand-
rai ls upon compl i ance wi th the fol lowing terms and conditions:
a. TMat said permittee and/or its successors in interest shall fully
indemnify, hold harmless and defend the City of Saint Paul, its agents
officers and employees f rom any and all damages, claims, losses,
judgments, suits or expenses and on account of all claims of whatever
nature for injury to person(s) and/or property arising out of or
connected with the construction, maintenance, operation and/or removal
of said step and handrails and by the permission and authority granted
herein; and that supplemental to all other obligations on their part,
jointly and/or severally, hereunder, said permittee and/or its successors
in interest shall furnish and maintain and pay all premiums and other -

expenses therefor, Casualty Insurance Coverage with a duly licensed
Casualty Insurance Company, naming the permittee and the City as
jointly insured to the extent of $300,000.00 for injury to any person
and/or persons in any single incident and to the extent of $200,000.00
for damage to property in any single accident and insuring the City of
Saint Paul against liability on account of all claims �f third persons
for injury to person(s) and/or property arisinq from or connected with
the construction, maintenance, operation and/or removal of said step
and handrai ls hereunder at all times. The permittee shal l furnish a
certificate of this insurance policy, from time to time, to the Office
Engineer of the Department of Public Works. The Office Engineer shall
submit said certificate to the City Attorney for review and if said
insurance is acceptable the certificate shall be filed with the Depart-
ment of Finance and Management Services of the City of Saint Paul ;
b. Said permittee expressly agrees and undertakes to mai�tain the step
and handrai Is in proper condition and to keep the same free and clear
of any obstacles, snow or ice;
c. That said step and handrails shall be removed by and at the sole cost
and expense of said permittee and/or its successors in interest whenever
the Council of the City of Saint Paul shall by resolution determine
such removal necessary in the public interest and accordingly order
the removal of said step and handrai ls from Brunson Street right-of-way;
d. That said permittee shall pay the costs for the publication of this
ordinance and all related resolutions and ordinances;
e. That said permittee shall pay the costs of administration, enqineering,
and inspection incurred by the Department of Pubtic Works because of
this undertaking;
f. That said permittee shall within thirty (30) days after the pub) ication
of this ordinance, file written acceptance thereof with the City Clerk,
spe cifically agreeing to al ) the terms and conditions herein.

RE: Use of Street Right-Of-Way
ACTION REQUESTED:
This ordinance wou)d allow Cassidy, Inc. to construct one step with handraiis
which encroaches onto the public sidewa�k on the east side of Brunson Stre�t,
25 feet north of Kenny Road. . . .
PURPOSE AND RATIONALE FOR THIS ACTION: : ,
Cassidy, Inc. has been remodeling it's buil.ding on the northeast corner of Brunson
Street and Kenny Road. This bui!ding has a doorway along Brunson Street and the
threshol�d of the doorway is about 16 inches above the sidewalk. Therefore a step
is needed. The proposed step should not affect pedestrian movements on the side-
walk. The step will extend approximately 9 inches , from the face of the building,
onto public street right-of-way. Just to the north of the doorway, a�ong the buil.d-
iny, NSP has a high pressure to low pressure gas reducer valve which a!so extends
approximately 9 inches from the face of the building.
