Shetka Street Ma.intenance Engineer City of St. Paul Department of Public Works St. Paul, Minnesota 55102 Dear Mr. Shetka: This is in reply to your letter of 19 August 1981 concerning a request for emergency streambank repair assistance under the authority of Section 14 of the 1946 Flood Control Act, as amended. From your subsequent meetings with personnel from our office, we under�tand that bank instability problems exist in two reaches, both involving the left bank of the Mississippi River, and that you are seeking assistance for both reaches. One reach includes the area upstream f rom the Warner-Childs Road intersection (approximate river miles 837.5 to 838.5) as indicated in your letter and the o ther involves the reach between the Robert and Wabasha Street bridges. Based on the information you have provided us, we have determined that we could imdertake a study of both erosion problems under the Section 14 authority. An information sheet describing the provisions of the Section 14 authority is inclosed. To begin a study under the Section 14 authority, we need to receive a formal request from a legal entity, such as the St. Paul City Council, that is capable of f urnishing the necessary assurances of local cooperation. The request should be in the form of a resolution similar to the inclosed sample copy. Upon receipt of the resolution, we would include a study of the bank instability problems in St. Paul in our overall study program. Since the two problem reaches are not related, we propose to conduct separate studies on each reach. Construction of a bank stability pro�ect would depend on the outcome of these studies and the availability of funding and manpower at the time. CORPS OF ENGINEERS' PROGRAM FOR CONSTRUCTION OF EMERGENCY BANK PROTECTIUN PROJECTS UNDER THE AUTHORITY OF SECTION 14 OF THE 1946 FLOOD CONTROL ACT ENACTED 24 JULY 1946 Authority and Project Scope: Section 14 of the 1946 Flood Control Act, as amended by the 1974 Water Resource Development Act (P.L. 93-2.51) , provides special authority to the Chief of Engineers to construct bank protection works to protect endangered highways, highway bridge approaches, and ather essential, important public works such as municipal water supply systems and sewerage disposal plants, churches, hospitals, schools, and other non-profit public services, which are endangered by flood-caused bank or shoreline erosion. Section 14 covers only protection of important and essential public facilities which serve the general public. Privately owned riverfront and privately owned facilities are not eligible for pro- tection under the Section 14 authority. In addition to major highway systetas of nationai importance, eli�;ible highways may also include principal highways, streets, and roads of special and significant importance to the local community. Examples are arterial streets, important access routes to other communities and adjacent settlements as well as roads designated as pri:nary farm to market roads. A Section 14 project is designed to be a complete-within-itself project that does not require additional work for effective and successful operation. Each project constructed must be economically justified and the maximum Federal expenditure per project is limited to $250,000. If the project cost exceeds the $250,000 Federal cost � limit, the difference must be provided by local cash contribution. Local Sponsorship and Cost Participation: Local sponsorship for a Section 14 project must be provided by a State or local agency Pmpowered under State law with sufficient legal and financial authority to comply • fully with all required local cooperation and participation. T"��e local sponsoring agency must agree to: 1. Provide without cost to the United Sta�es all lands, easements, and rights-of-way necessary for construction of the project. 2. Accomplish without cost to the United States all required alter- ations and relocations in sewer, water-supply, drainage, and other utility facilities. 3. Hold and save the United States free from damages due to the construction works, not including damages during construction, operation and maintenance which are due to the fault or negligence of the United States or its contractors. 4. Maintain the project after• completion. 5. Assume full responsibility for all ,project costs in excess of the Federal cost limit of $250,000. 6. Provide a cash contribution for project costs in proportion to any special benefits to non-public property.
