An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes � 462. 357 and � 64.210
of the Legislative Code, Herman and Marie Eliasen duly petitioned
to rezone Lot 3 and west 1/2 of Lot 4, J. Auer ' s Rearrangement,
located at 230 E. Wyoming Street, from R-4 to RT-1 for the purpose
of converting a single family home into a duplex, the petition
having been certified by the Department of Finance and Management
Services on June 30, 1981 as having been consented to by at least
67% of the owners of the area of the property to be rezoned, and
further having been consented to by at least two-thirds of the
owners of the property situated within 100 feet of the total
contiguaus descriptions of real estate held by the same owner or
any party purchasing any such contiguous property within one year
preceding the date of the petition; and
WHEREAS, The current Zoning Committee on August 6, 1981
cona.ucted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107 .03 of the Admini-
strative Code, submitted its recommendation to the Planning Com-
mission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on August 14, 1981 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

rezoned; and
WHEREAS, A public hearing before the City Council, having been
conducted on September 17, 1981 where all interested persons were
heard, and the Council having considered all the facts and recom-
mendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 38,
as incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located at 230 E. Wyoming Street,
being more particularly described as Lot 3 and
west 1/2 of Lot 4, J. Auer's Rearrangement, be
and is hereby rezoned from R-4 to RT-1.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
This letter is written in response to the petition of Herman & Marie
Eliasen to rezone property at 230 E. Wyoming Street (southside between
Oakdale & Harvard) from R-4 (single family residential ) to RT-1 (one and
two family residential ) to a11ow conversion of a single family home to
a duplex.
On August 6, 1981 , the Zoning Committee conducted a public hearing
on the case. No correspondence was received and�only the applicant
testified. The Zoning Committee voted 3-2 to recommend approval of
the rezoning.
The Planning Commission considered the Zoning Committee's recommendation
on August 14, 1981 , and voted 12-0 to approve the rezoning.
The requested rezoning is scheduled to be heard by the City Council on
September 17, 1981 . Please notify me by September 16 if any member of
the City Council wishes to have sl�des of the site presented at the
City Counci1 public hearing.

A. PURPOSE: Rezone from R-4 to RT-1 to convert a single-family home to a duplex.
B. SUFFICIENCY: Declared sufficient by the Finance Department on June 30, 1981 . Seventeen
parcels were eligible to sign the petition; 12 parcels were needed; and 13 were obtained.
C. PARCEL SIZE: 72'x 119' = 8,568 square feet.
D. SITE & AREA CONDITIONS: The site is occupied by a 12 story single-family house con-
structed in 1939. The lot is set about 4' above street grade. The surrounding land use
is primarily single family residential . Most of the houses on the block are 1� story
houses similar to the subject property: West St. Paul is located 1 block south of the
site. �
E. FINDINGS:
1 . The site was zoned "A" Residence from 1922 until it was designated R-4 under the
1975 citywide zoning amendments.
2. In an RT-1 zone, a lot size of 6,000 sq. ft. and a lot frontage of 50 feet is
required for two family use. The parcel has adequate lot area and frontage to meet
these requirements.
3. The Nousing Plan and the Land Use Plan recognize that there are many houses in the
city which are appropriate for conversion to two units based on lot size,
structure size, and other criteria, and that the primary purpose of allowing large
house conversions is to make more efficient use of space within the large number
of large single family houses in St. Paul .
4. The house in question is not a large house. It is a 1'� story house with a
foundation size of 961 sq. ft. If the site is rezoned, two small-to-average sized
units will be created.
� 5. Rezoning the parcel would create one RT-1 parcel in a large R-4 zone, which presently
has few duplexes in it.
6. The rezoning appears to be an effort to relieve one lot of restrictions applying~
generally to the area as a whole.
F. STAFF RECOMMENDATION: Based on findings 3 through 6, staff recommends denial of the
rezoning request to RT-1 .

PRESENT: Mme. Karns; Messrs. Bryan, Lanegran, Levy, and Pangal of the Zoning
Comnittee; Mr. Segal , Assistant City Attorney; Ms. Lane of the
Division of Housing & Building Code Enforcement; Ms. Beseman,
� Ms. Daykin, Mr. Soderholm, and Mr. Torstenson of the Planning
Division Staff.
ABSENT: t�ne. Summers; Messrs. Armstead and Hanggi .
The meeting was chaired by James Bryan, Chairman.
HERMAN & MARIE ELIASEN #8948 : Petition to rezone from R-4 to RT-1 to
convert a sing e-family ome to a duplex at 230 E. blyoming.
. The applicant was present. There was no opposition present at the hearing.
Ms. Daykin showed slides of the site and reviewed the staff findings with a
recomnendation for denial . No correspondence was received on this matter;
no district comment was submitted.
�Herman Eliasen, 230 Wyoming, testified that the area does lend itself to
duplexes; directly behind his property and one lot over is a duplex, there is
a duplex over on Oakland, and two blocks over on Winona are two more duplexes.
Of these duplexes,only one is a true duplex, the others are conversions. He
stated that there is plenty of off-street parking. There is a double garage _
with a ,large driveway and adequate parking facilities for two vehicles. His
intent is to raise the roof creating 2 small to average sized units. The
upstairs unit would consist of a large living room, large kitchen, small
dining area, one bedroom, private bath and outside entrance.
Hearing no further testimony, Mr. Bryan closed the public hearing portion of
the meeting.
Mr. Pangal made a motion to recommend approval of the rezoning based on the
fact that the Housing Plan and Land Use Plan recognize conversions, �there is .
a large sement of single people who only want 1-bedroom units , and relieving
one lot of restrictions would not jeopardize the area as a whole. Mr. Lanegran
seconded the motion. The motion passed on a roll call vote of 3 to 2 with
Mr. Levy and Mr. Bryan voting against the motion.
