An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes �462 .357 and �64.210
of the Legislative Code, Arthur Werthauser duly petitioned to re-
zone part of Section 20, Township 29, Range 22, located on the
northeast corner of DeSoto and Cottage at 1386 DeSoto, from R-3
to RT-1 for the purpose of constructing two side-by-side duplexes,
the petition having been certified by the Department of Finance
and Management Services on June 30, 1981 as having been consented
to by at least 67� of the owners of the area of the property to be
rezoned, and further having been consented to by at least two-
thirds of the owners af the property situated within 100 feet of
the total contiguous descriptions of real estate held by the same
owner or any party purchasing any such contiguous property within
one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on August 6, 1981
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107 . 03 of the Admini-
strative Code, submitted its recommendation to the Planning
Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on August 14, 1981 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

WHEREAS, A public hearing before the City Council, having
been conducted on September 10, 1981 where all interested persons
were heard, and the Council having considered all the facts and
recommendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 5,
as incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the northeast corner of
DeSoto and Cottage at 1386 DeSoto, the property
being more particularly described on Exhibit A,
be and is hereby rezoned from R-3 to RT-l.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days fram and after its passage, approval and publication.

Dear Sir:
This letter is written in response to the petition of Arthur Werthauser to
rezone property on the northeast corner of DeSoto and Cottage from R-3
(single family residential ) to RT-1 (two family residential ) to allow con-
struction of two side-by-side duplexes.
On August 6, 1981 , the Zoning Committee conducted a public hearing on this
case. One neighbor testified in mild opposition to multiple family dwellings
in a single family neighbarhood. One letter was received stating no objections
to the rezoning and the District 5 Planning Council submitted a letter in
support of the rezoning. The Zoning Committee voted 5-0 to recommend approval
of the rezoning.
The Planning Commission considered the Zoning Committee's recommendation on
August 14, 1981 , and voted 12-0 to approve the rezoning.
The matter of the requested rezoning is scheduled to be heard by the City
Council on September 10, 1981 . Please notify me by September 9 if any member
of the City Council wishes to have s1ides of the site presented at the City
Council public hearing.

A. PURPOSE: Rezone from R-3 to RT-1 to allow the construction of two side-by-side duplexes.
B. SUFFICIENCY: Declared sufficient by the Finance Department on June 30, 1981 . Thirteen
parce�s were eligible to sign the petition; 9 were needed; and 9 were obtained.
C. PARCEL SIZE; 150 x 121 � 18,150 square feet.
D, SITE & AREA CONDITIONS: The site is vacant at present. The lots on DeSoto north to
Arlington are also vacant; to the west is Arlington-Arkwright Park and Playground; to
the south are two single family homes and vacant land; and to the east are single family
homes. .
E. FINDINGS:
1 . The proposed development of the site is the construction of two side-by-side
duplexes with a projected selling price of $70,000 per unit. The proposal has
received tentative approval for inclusion in the McKnight Family Housing Fund. .
2. The site plan indicates two off-street parking spaces will be provided for each
unit, which more than meets the Zoning Ordinance parking requirement.
3. The rezoning is in conformance with the Housing Plan. The Housing Plan encourages
a more efficient use of land resources for housing development by encouragin�
development of duplexes and triplexes on scattered vacant infill sites in lower
density residential areas. (Policy S5, p.6) .
4. The rezoning is in conformance with the Land Use Plan. The Land Use Plan states:
. "On scattered vacant sites in existing neighborhoods, the City will establish
criteria which will allow new housing development at densities somewhat higher
than the existing zoning but compatible with the general existing pattern of
development." (P.23, Policy 4.1-4)
5. The proposed rezoning is compatible with the surrounding land uses. It will
create an opportunity for affordable, energy efficient housing for families.
F. STAFF RECOMMENDATION: Based on findings 2 through 5 above, staff reco►rnnends approval

ARTHUR 4JERTHAUSER (#8949) : Petition to rezone from R-3 to RT-1 to allow

The applicant was present. There was opposition present at the hearing.
Ms. Daykin showed slides of the site and reviewed the staff findings with a
recomnendation for approval . District 5 Planning Council submitted a letter
stating their support of the rezoning and one letter was received �stating no
objections.
Arthur Werthauser stated he had nothing further to add at this time.
Jim Nagel , 1390 Burr, asked if the property in question was a single lot and
whether off-street parking would be provided?
Ms. Daykin explained that the property is an unplatted area which is the
equivalent af three lots. She also stated that surface parking would be
provided.
Mr. Nagel expressed mild opposition to bringing multiple dwellings into a
single family neighborhood, He felt the lots would be more ideal for single
. family homes.
Mr. Llerthauser testified that under the McKnight program, there cannot be one
owner of any 2 or more units. The program is designed for young families
who are required to live in the residence for two or three years before they
can sell . �
Hearing no further testimony, Mr. Bryan closed the,public hearing portion of
the meeting.
Mr. Lanegran made a motion to recommend approval of the rezoning based on
findings 2 through 5 of the staff report. Mr. Pangal seconded the motion.
The motion passed-'on a roll call vote of 5 to 0.

We are Robert P. and Janet Y. Hoelzel, adjoining property owners
to Mr. Werthauser.
Please include in the minutes of this hearing our support for the
rezoning only if the following conditions are met.
1. Section 60.421 shall nat allow any other use other than new
construction.
2. Section 60.422 shall not allow a,ny alteration, enlargement
and moving of existing buildings or structures from other
locations.
3. Section 60.�22C to include the accessory building or garage
either attached or in rear yard shall be fully enclosed
with doors.

Dear Honorable Mayor and City Council:
We are Robert P. and Janet Y. Hoelzel, adjoinin$ property oWners
to Mr. Werthauser.
Please include in the minutes of this heaxi.ng our support for the
rezoning only if the followin� conditions are met.
1. Section 60.421 sha.11 not allow any other use other than new
construction.
2. Section 60.422 shall not allow any alteration, enlargement
and moving of existing buildings or structures from other
locations,
3. Section 60.422C to include the accessory building or ga.ra,ge
either attached or in rear yaxd shall be fully enclosed
with doors.
4. Builder shall install on the north side of house and rea,r yard
either a ma.sonary wall or wood fence located on the lot line.
We personally feel that if the above conditions axe met the
a.djoining neighborhood shall be greatly improved. Your concurrence in
this recomaxendation is respectfully appreciated.
