WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul; and
WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, River City Asphalt, Inc, represented by Rich
Carron, owner and Dalen Wieberdink, Plant Manager, who have been
designated as the responsible person on the application, has
applied for a variance to allow River City Asphalt, Inc. to set
up and operate a temporary asphalt plant at South Robert Street
and Plato to provide asphalt for a paving project on I-94 between
Riverside and John Ireland Boulevard; and
WHEREAS, applicant is seeking a variance to permit them to
operate the asphalt plant through the night, at various times
between July 7, 2000 and August 31, 2000; and
WHEREAS, applicant anticipates that the plant will only need
to operate from 8:00 p.m. Friday until 5:00 a.m. the following
Monday for five weekends, but cannot be certain because of
possible weather delays; and
WHEREAS, if applicant is granted a variance it will be able
to complete the resurfacing project with the least amount of
disruption to traffic and increased safety for the public; and
WHEREAS, the Office of License, Inspe'ctions, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to River City Asphalt, Inc., for the period
from June 7, 2000 to August 31, 2000, subject to the following
conditions:
1) The variance shall permit asphalt
plant operation and associated
machinery during that period

amend or revoke the variance.

operation of a temporary asphalt plant to be located near the northwest corner
of Plato Blvd. and Robert Street S..
The plant will be used to produce asphalt for a paving project on I94 between
Riverside and John Ireland Blvd. Work on the project is scheduled for nights
and weekends, The plant is scheduled to be in operation on weekends from
approximately 8:00 p.m. on Fridays until 5:00 a.m. the following Monday

Attached is a sound level variance application from River City Asphalt to allow operation
of a temporary asphalt plant near the northwest corner of Plato Blvd. and Robert St. S..
The plant will be used to produce asphalt for a paving project on I94 between Riverside
Drive and John Ireland Blvd. The variance is requested for work scheduled from
approximately 8:00 p.m. on Fridays unti15:00 a.m. the following Monday morning on 5
weekends during the period beginning on July 7, 2000 and ending on August 31, 2000.
Also attached is a copy of the Public Hearing Notice sent to properiy owners within 200
feet of the temporary plant area.
