' Resolution Presented By Referred To Committee: Date Out of Committee By Date WHEREAS, the Capital Tmprovement Budget Committee and the City Counci1 of �he C�ty of Saint Pau1 did provjde funds from the 1980 CTB program for the Youth Athletic Recreation Equipment Program (YAREP); a€�d WHEREAS, both bodies approved the Jackson Elementary School site as an eligible project for the YAREP funds; and WHEREAS, it has been determined that installation of play equipment at this school site will benefit the children of the District 7/Thomas- Da1e community; now, therefore, BE TT RESOLVED, that the St. Paul City Council does, hereby, authorjze appropriate city officials to execute the necessary agreements between �he C�ty, the St. Paul School District and the Jackson School PlaygroundFund to provide grant-in-aid assistance of up to $5,000 for play equipment. In consideration of the mutual promises and benefits to be derived by the inhabitants of the City of Saint Paul, the City and . School District hereby agree as follows: ' 1. The School District shall design and approve the proposed installation of playground equipment for the Jackson School .Playground � and shall provide the necessary grading, fill and installation of this equipment. School District shall maintain the playground equipment after it is installed. 2. The District 7/Jackson School Playground Fund and City shall each contribute 50X of the cost for the purchase of the playground � equipment for the Jackson School Playground. District 7/Jackson School . , Playground Fund shall submit an invoice to the City for costs of the equipment. Upon receipt of the invoice and approval thereof by School District, the City shall pay one-half of the cost of such equipment not to exceed the sum of $5,000.00; payment by the City shall be made to the District 7/Jackson School Playground Fund. School District shall hold harmless, protect, indemnify and defend the City of Saint Paul, its agents and employees from any and all claims arising out of the existence, use, operation or maintenance of the said playground equipment to be located and installed at the Jackson School Playground.
