Minutes of the meeting of July 14 , I981 , were approved as distributed to
the members.

SUBJECT: Request variances of Section 34. 11, to permit occupancy of fiv
dwe 11 ni g units where bathroom facilities are located outside the walls
(one bathroom shared by all five units) , occupancy of Apt. #1 where
kitchen sink is located away from cooking area, and Apt. #3 where bath-
room lacks handsink. Also, request variance of Section 34. 14, pertainin
to light and ventilation , for Apts . #1 and #3 where kitchens have no
windows . Request two-year extension of time to complete electrical work
as designated in city' s letter of 5/14/81. Appeal is for reasons of
financial hardship.

PROCEEDINGS: Senator Moe � stated that Mr. Daniluk emigrated to this `
country�ter World War II from Ukrainia, bought this property in 1958
and is now retired. His income consists of social security and the pro-
ceeds of the less than $900 monthly income from rents . He lives in Apt. #1 ;
and charges very modest rent for the remaining eight units because his
tenants have limited incomes . He asked the board to give consideration
to these circumstances .
Mr. Knutson noted that the 30-amp electrical service was severely inade-
quate. He recommended that the overfusing be corrected immediately as
a temporary safe�Cy measure , and that the service be upgraded to code
within six mont�s . Heestimated the cost , roughly, to be around $5 ,000.
BOARD ACTION: Mr. Knutson moved that a six-month extension of time be
granted to complete the electrical work required, on condition that the
present overfusing of the system be corrected immediately as a temporary ,
safety measure. Mrs . Burg seconded. MOTION CARRIED AND SO ORDERED. .
THE VOTE : Ayes - 4 Nays - 0 Abstentions - 0
Mr. Daniluk said there were five b athrooms in the building. Four units
had private baths , and four remaining units and a sleeping room shared
one bathroom. He took the responsibility for maintaining the shared '
b athroom in clean condition. He lived in Apt. #1 , where violations were �
cited by the city because there was no window in the kitchen and the
sink was located in the dining room instead of the kitchen. Apt. #3
also had no kitchen window and the bathroom lacked a handsink, there bei g
no space .
. Jerry Kern expla�ned that the housing code had recently been revised and
had taken effect since the original inspection, at which time the old
code applied. He questioned whether the sink in the dining room was a
violation of code , and a handsink no longer needed to be within the room
where the toilet facility was located, but could be outside in an adjace t
area.
Chairman Glassman said the sharing of one bathroom by five persons gave
him some concern. He suggested that a variance , if granted, should be
limited to the period of Mr. Dani2uk's ownership or so long as he lived
in the building , whichever period was shorter. If at some future time
Mr. Daniluk found it within his means to add one more bathroom, he might
again appeal to the board for a variance effective for the lifetime of
the structure. � ;
Mr. Knutson suggested that Mr. Daniluk install mechanical ventilation inl
the two kitchens where there were no windows to provide natural ventilat on.

BOARD ACTION: Chairman Glassman moved that a variance of Section 34. 1I
e grante to permit the sharing of one bathroom by tenants of four
dwelling units and one sleeping room on condition that no more than one
person occupy each unit, limited to the period of Anton Daniluk's owner-
ship or his residency on the premises , whichever period was shorter.
Mrs . Burg seconded. MOTION CARRIED AND SO ORDERED.

approved mechanical ventilation be installed. Mrs . Burg seconded.

its walls , and continued occupancy of a unit where the bathroom lacks a
handsink. Also , reauest waiver of requirement for� a storm-screen door
at first floor entrance to upstairs , because "compliance would serve no
useful purpose. "

V�- PROCEEDINGS: Mr. Rantapaa said that , after listening to Mr. Kern' s -
comments about recent code revisions , Apt. #3, where there was no hand-
sink in the bathroom, no longer appeared to be in violation, since ther
was a handsink just outside the bathroom on an adjacent w all .
Mr. Kern agreed that Apt. #3 complied with the revised code.
As for Apt. #2 , Mr. Rantapaa explained that the bathroom was across a
common hall from the unit , but it was private and used only by occupant
of Apt. #2. Regarding the requirement of a screen-storm door at the
first floor entrance to the upstairs , the door was always kept closed
and was not needed for ventilation of any of the apartments .
BOARD ACTION: Mr. Knutson moved that a variance of Section 34. 11 be .
grante to permit continued occupancy of Apt. #2, where the bathroom
facilities are located outside the walls of the dwelling unit, and that
the reauirement of a storm-screen door on the first floor entrance lead
ing to two upstairs dwelling unit be waived. Mr. Gausman seconded.
MOTION CARRIED AND SO ORDERED.

PROCEEDINGS : Mrs . McEvoy said the situation was the same in both build"ngs.
Tt 14 1 Wynne, Apt . #2 on the first floor has its awn bath, but it is
located in the basement. The tenant keeps it locked, so it cannot be used
by others . At 1335 Minnehaha, one of the first floor apartments also h s
its private bathroom in the basement. In addition, at this address , on
upstairs tenant has to go into a common hallway to reach the apartment' s
private bathroom, which is nearby on the same floor.
BOARD ACTION: Mr. Gausman moved to grant variances of Section 34. 11
for occupancy o�f one apartment at 1461 Wynne and two at 1335 W. Minneha a,
each unit having a private bathroom that is not within its wa11s .

room lacks handsink. Also, request variance of Section 34. 14 , pertainin
to light and ventilation, for Apts . #1 and #3 where kitchens have no
windows . Request two-year extension of time to complete electrical work
as designated in city' s letter of 5/14/81. Appeal is for reasons of
financial hardship.
