WHEREAS, Perry Giles applied to the Board of Zoning Appeals for a
variance from the strict application of the provisions of Section 62. 106 (4)
of the 5aint Paul Legislative Code pertaining to the size of accessory
structures permitted in an R-4 zoning district so as to permit him to
construct a garage on his property located at 1635 York Avenue, Saint Paul,
Minnesota; and
WHEREAS, following a public hearing with notice to affected property
owners the Board of Zoning Appeals by its Resolution No. 9012 adopted
October 27, 1981 varied the provisions of Section 62. 106 (4) to allow the
construction of a 24 foat by 40 foot garage on property located at 1635
York Avenue in accordance with the application for variance and the site
plan which was approved by the Board of Zoning Appeals based upon the
Board' s findings that the strict application of the regulations would re-
sult in exceptional undue hardship upon the owner of the property by
reason of the exceptional size of the lot, the variances could be granted
without substantial detriment to the public good and without substantially
impairing the intent and purpose of the Ordinance, that the variances
can be granted without substantial detriment to the neighbors' supply of
light, air, health, safety or property values, and that the variance re-
quest was not based primarily upon a desire to increase the value or in-
come potential of the parcel of land; and
WHEREAS, pursuant to the provisions of 64.205, Frank Huberty, 1655
York Avenue, Saint Paul, Minnesota 55106 duly filed with the City Clerk
his appeal of the determination made by the Board of Zoning Appeals and
requested that a hearing be held before the City Council for the purpose
of considering the actions taken by the said Boa?^d; and
WHEREAS, acting pursuant to Sections 64 . 205 through 64. 208 and upon
notice to Appellant and other affected property owners, a public hearing
was duly conducted by the City Council on December 10, 1981 where all
interested parties were given an opportunity to be heard; and

WHEREAS, the Council having heard the statements made and having
considered the variance application, the report of staff, the minutes
and findings of the Board of Zoning Appeals, does hereby
RESOLVE that the Council of the City of Saint Paul does hereby
affirm the decision of the Board of Zoning Appeals in this matter and doe
hereby concur in the findings made and determined by said Board; and
BE IT FURTHER RESOLVED that the appeal of Frank Huberty be and
hereby is denied; and
BE IT FURTHER RESOLVED that the City Clerk shall mail a copy of this
resolution to Perry Giles, Frank Huberty, the Zoning Administrator, the
Planning Commission and the Board of Zoning Appeals .

Dear Sir:
This letter is written in response to the appeal of Frank Huberty to a �
decision of the Board of Zoning Appeals granting a variance of the i
provision of the Zoning Ordinance which prohibits an accessory buildinn
from exceeding the ground floor area of the main building.
On October 13, 1981 , the Board of Zoning Appeals conducted a public
hearing. Three letters were received in support from residents of
1611 , 1623 and 1641 York. Three persons spoke in opposition; opposition
centered on a race car owned by P�1r. Giles. The Board voted 6 to 0 to approve
the variance based on findings that (1 � strict application would result in
hardship to the owner given the exceptional size of the property (21 ,OCOsq, ft. ) �
(2� the variance would not impair the intent of the Ordinance; (3) the variance '
would not impair the neighbors ' supply of light and air, health, safety, or ;
property values; (4) the request for the variance was not based on a desire
for economic gain.
This appeal is scheduled for December 10, 19�1 . Please notify me by
December 9 if any member of the Council wishes to have slides of the site
presented at the hearing.

Perry Giles, 1635 York, explained that the purpose of the request is to build II
a 24'x 40' garage to store his vehicles. ,

Maureen Giles commented that their vehicles have been vandalized and they ;
feel they should be covered up. It would also look better if the vehicles I,
were parked in a garage. I
Fra�k Huberty, 1655 Y�rk, spoke in opposition. He complained about the noise I'!
caused from the applicant unloadinq his race car late at niQht. He stated �I
that the applicant should have applied for a permit before starting construction. ,
�
Ms. McNeally clarified that the applicant indicated that they contracted with !
a contractor and it was his responsibility to get a building permit which he �,
did not do and they were tagged during construction. It was the applicant's � ',
understanding that the contractor was going to take care of all permits. !,
Mr. Kane, 1635 York, stated that his bigqest objection was the nois e from the
applicant's race car. �',
Korlyn Gooder, 1653 York, expressed concern with the aesthetic appearance of '
the buildinq. The garage is 2 to 3 stories high and is very huge. �I,
Mr. Giles responded that the garaqe will have green siding on it and will be �
a nice looking building.
Hearing no further testimony, Ms. Morton closed the public hearing portion of �'�
the meeting.
Ms. Sur►�ners made a motion to approve the variance request based on findinqs ��,
1 through 5 of the staff report. Mr. Osborn seconded the motion. The motion I�
passed on a roll call vote of 6 to 0. -

1 . The variance is based on the exceptional size of the lot (.21 ,000 sq. ft. ) and the ��
relatively small main structure (720 sq. ft.l. I
Using the Zoning Code formula for accessory structures (.25� of required rear yard li,
plus 40� of non-required rear yard� a garage in excess of 7,000 sq. ft. would result.l
In this case the hardship results from the comparatively small size of the principal '
structure. If the main structure were enlarged, then the garage could also be
enlarged. .
2. Without variances the owner would incur hardship. Given the size of the house, the
owner would be limited to either expanding the existing garage by 8' or demolishin� �,
the old garage and constructing a 24'x 30'garage. '
The applicants state that they need off-street parking for two trucks, an antique I,
car, and an automobile. There is no alley and on-street parkinq is limited. ,
� 3. The variance can be granted without substantial detriment to the community or to I
the intent of the Ordinance. �

Councilman McMahon asked that I write to explain the process for appealing �
the decision of the Board of Zoning Appeals relative to the Perry Giles
variance.
On October 27, 1981 , the Board will adopt a resolution approving the garage '
variance for Perry Giles. You, or any affected party, will then have 30
days to appeal the decision to City Council . This is done by writing a
letter outlining the basis for your appeal and filing it together with a
$50.00 fee with the City Clerk, Room 386 of the City Hall/Courthouse. The
Council will schedule a public hearing and notify all property owners �
within 350' of the Giles property.
I will send you a copy of the Board of Zoning Appeals resolution after it ��
is adopted on October 27th. If I may be of any further help, please call
