The petitioner, E. T. Hughes Construction Ca�pe.rLy, Inc. requests that this �
petition be granted in order that several four-pleaces may be constructed �
on this site in con�unction with other similar units being constructed by
the petitioner on Sloan Street to the South. The proposed vacation area ;
is an unimproved street right-of way and is located in three different �
zonin� areas, B-3, R-3 and RM-2. (Note that the petitioner is also requesting �
a zoning change of part of the R-3 zone to RM-2. This zonin� cY.►�.nge has been ;
recommended for approva.l by the Plannin� Comomission and is also part of the
public hearings before the City Co�cil on November lOth.) I
In addition to the areas originally petitioned, staff and the petitioner ;
have agreed to vacate the ren�.ining �+0 feet of the North-South alley in Block i
3, Kavanagh and Dawson's Addition to the City of St. Paul a�cl. aqy rem�.ini.ng ;
portions of East Id,�ho that are currently under ownership by the State of ;
Minnesota. The City is not able to vaoate these portions of public street '
and alley until the State of Minnesota relea.ses its interests. 7'he petitioner j
has assured sta.ff that he will have f1a.7.1 ownership interests ia this praperty i
(Lot 1, Block 3, K�vanagh and. Dawson's Additi�n to the City of St. Paul) by
or before the November lt7th public hearin.� date. �

I have referred this va.cation matter to all of the City departments, all
utilities doin� business in St. P�ul and Planning District #5. Unless other- i
wise noted bela�ur, there were no adverse comments or concerns submitted to this
office.

The Department of Public Works reports the folla�ring: ;
a) Easements must be retained for the t,wo (2) private sewer �
lines and connections serving the properties on Wheelock ;
Parkway for acce�s and maintenance purposes to the sewer
manhole located in Sloan Street at East Idaho Avenue.

c) The petitioner should iaiprove the Idorth-South alley f�om �

Dawson's Addition to the City of St. Pa.ul extended
southerly to meet the existing improved alley attd the
petitioner should improve the Ea.st-West alley to be re-
tained in Ici,a.ho. This alley improvement to be constructed
to the satisfa.ction of the Department of Public Works and '

d) The petitioner must be responsible for the dedication of
�he necessary right-of-way for cul-de-sac purposes on Sloan ;

to the follawing terms and conditions:
