The Housing and Redevelopment Authority of the City of Saint Paul, Minn sota (the "HRA"), will undertake a below market interest rate mortgage loan program (the "Energy Improvement Program, Phase II" or the "Program") to finance energy improv ments made to one-to-four family residences in the City pursuant to Chapter 222 of the La s of Minnesota for 1981 and Minnesota Statuties, Chapters 462A and 475, and Chapter 7 , Saint Paul, Minnesota, Administrative Code, relating to Housing and Rehabilitation F nance Progra ms; B. By resolution (the "HRA Resolution"), the HRA will authorize the issuance of approximately $3,080,000 Energy Improvement Revenue Bonds, Series II (the "Bonds");! D. This City Council has on this day held a public hearing on the Program; E. The City has applied for and received preliminary approval of an Urban Deve�lopment •Action Grant, the proceeds of which will be applied to assist the Program and earlier ar�d later programs of providing financing for energy improvements to single-family and mu�ti- family residences; F. The Indenture of Trust pursuant to which the Bonds shall be issued, togetheq with various other Agreements, have been made available in draft form and will be sub�mitted to the HRA for approval, and the HRA will approve such Indenture of Trust and Agree�nents and authorize such Indenture of Trust and Agreements to be executed; and G. The City Council has approved the related Energy Improvement Program, �'hase I (also called Series I), of the HRA, by Resolution No. 277305, adopted August 25, 1981� NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Saint Paul, Minnesota, as follows: 1. It is hereby found, determined and declared that: (a) The City faces potential serious shortages in energy resources, andl implementing energy conservation measures requires expanded authority and technical capal�ility in order to minimize the use of traditional energy sources in the housing sectdr. (b) Accomplishing energy conservation is a public purpose. (c) It is in the public interest for the City, through the HRA, to provlde existing one-to-four family housing loans for energy improvements. (d) There is a continued need to reduce consumption of energy from�nonrenewable petroleum based resources. i . +` y��i F� ��� � (e) There are housing units within the jurisdiction of the City which are in need of energy improvements and energy rehabilitation. (f) Private sources of financing are not reasonably available to provide the i needed loans for energy improvements and energy rehabilitation. ; (g) The types of energy improvements and energy rehabilitation which are ; eligible for financing under the Program will reduce the consumption of energy frc�m nonrenewable petroleum based resources or from nuclear sources, both directly ar�d indirectly. (h) At least 759i6 of the proceeds of each energy improvement loan under fthe Program shall be used for housing repairs and improvements (1) which will be useki or useful to conserve energy and (2) which, when installed or completed, will wit� respect to each housing unit directly result in a cost effective reduction of ener�y use from nuclear or nonrenewable petroleum based resources. i 2. The Council hereby authorizes and directs the HRA to carry out the Ener�y Improvement Program, Phase II, and to issue the Bonds to finance the Program upon �he terms to be set forth in the HRA Resolution. 3. The Mayor, City Clerk, Director, Department of Finance and Managemer�t Services, and other officers of the City are authorized and directed to take such ac�ions as may be necessary to secure the Urban Development Action Grant for which appli}�ation has been made and preliminary approval received with respect to the Program, incl�pding the furnishing of evidentiary materials and the execution of agreements with parti ipants in the Program and other programs to which the Urban Development Action Grant elates. The Mayor, City Clerk, and other officers of the City are authorized and dire ted to prepare and fumish when the Bonds are issued, certified copies of all proceedings and records of the City relating to the Bonds and such other affidavits and certificates as m y be requir ed to show the facts relating to the legality, tax exemption and marketability of the Bonds as such facts appear from the books and records in said officers' custody d control or as otherwise known to them; and all such certified copies, certificates and af idavits, including any heretofore fumished, shall constitute representations of the City as to th truth of all statements made by the City and contained therein.
