On October 15, 1981 , the Zoning Committee conducted a public hearing on the case. A letter from District 6 was received in support. The Zoning Committee voted 6 to 0 to approve the rezoning. The Planning Commission considered the Zoning Committee's recommendation on October 23, 1981 , and voted 18 to 0 to approve the rezoning. The rezoning is scheduled to be heard by the City Council on December 3, 1981 . Please notify me by December 2 if any member of the City Council wishes to have slides of the site presented at the City Council public ' hearing. 'I'his conveyance is made upon the condition subsequent that if, prior to II completion of improvements by the Redeveloper in accordance with the CONTRACT, and I � � PLAN, as such completion shall be certified by the HRA: ' (a) The Redeveloper (or successor in interest) shall default in or violate � its obligations with respect to the construction of the improvements (includ- � ing the nature and the dates for the beginning and completion thereof) , or shall abandon or substantially suspend construction work, and any such default or violation, abandonment, or suspension shall not be cured, ended or remedie within three (3) months after written demand by the HRA so to do; or � I (b) The Redeveloper (or successor in interest) shall fail to pay real estate taxes or assessments on the Property or any part thereof when due, or shall , place thereon any encumbrance o.r. lien unauthorized by the CONTRACT, or shall I suffer any levy or attachment to be made, or any materialmen's or mechanic's I lien or any other unauthorized encumbrance or lien to attach, and such taxes ' or assessments shall not have been paid, or the encumbrance or lien removed or discharged, or provision satisfactory to the HRA made for such payment, removal or discharge, within ninety (90) days after written demand by the HRAII so to do; or • I (c) There is, in violation of the CONTRACT, any transfer of the Property or !' ar►y part thereof, and such violation shall not be cured within sixty (60) days after written demand by the HRA to the Redeveloper; or (d) There is, in violation of the Agreement, failure to submit a required or , requested Affirmative Action Program or Affirmative Action Progress Report, I or a failure of an Affirmative Action Participant to substantially comply witl� the Equal Employment Opportunity requirements of the Agreement or with the actions or employment standards of an Affirmative Action Program submitted un er the Agreement, and such violation shall not be cured within thirty (30) days after written demand by the HRA to the Redeveloper; - 4 - I i li� . : . _ � ., � . . � �..-����� �� then the HRA ahall have the right to re-enter and take posseseion of the Property � and to terminate and reveet in the HRA the estate conveyed hereln to the Redeveloper� provided, that such condition subsequent and any revesting of title as a result I� thereof in the HRA: i (a) Shall always be aubject to and limited by, and shall not defeat, render invalid, or limit in any way: i (1) the lien of any mortgage authorized by the OONTRACT, ,I and � (2) any rights or interests provided in the CONTRACT for the protection of the holdera of such mortgages; and (b) Shall not apply to individusl parts or parcels of the Property i (or, in the case of parts or parcels leased, the leasehold interest) on which there are no defaults under the terms of said CONTRACT; and i (c) Shall not apply after the improvements have been completed and � certified to by the HRA. Promptly after compliAnce with the reatrictions and covenants contained in I Paragraph 1 and Paragraph 3 above, the HRA will furnish the Redeveloper with an • ! appropriate instrument showing compliance therewith. I As part of our process the site plan for the expansion was shared with the Zewis Park Apartments Resident Council.
