An Ordinance amending Chapter 60 of the �
Saint Paul Legislative Code pertaining to !
zoning for the City of �aint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes § 462. 357 and � 64.210
of the Legislative Code, Leo and Thomas Huppert, Rita Domke and
Joseph Fischler duly petitioned to rezone Lots 16, 17 and 18;
except the Easterly 17 feet thereof and Lots 19, 20, 21 and 22; all
in Block 1, McKenty's Out Lots, located on tha southeast corner of
Wayzata and Albe�narle, from RT-1 to s-3 for the purpose of expanding
North End Machine by adding a warehouse west of the existing build-
ing, the petition having been certif ied by the Department of Finance
and Management Services on September 16, 1981 as having been con-
sented to by at least 670 of the owners of the area of the property
to be rezoned, and further having been consented to by at least two-
thirds of the owners. of the property situated within 100 feet of I
the total contiguous descriptions of real estate held by the same
owner or any �arty purchasing any such contiguous property within i
one year preceding the date of the petition; and
WHEREAS, The current Zoning Co�n.mittee on October 15, 1981
conducted a public hearing for the purpose of considering the re-
zoning petition, and pursuant to Section 107 . 03 of the Administra-
tive Code, submitted its recommendation to the Planning Commission I
that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on October 23, 1981 anc? re�o?:mmendec? �
that the City Council approve the petition; and

Dear Sir:
This letter is written in response to the petition of Leo & Thomas Huppert
to rezone property at the southeast corner of Wayzata and Albemarle from
RT-1 (_2 family residential ) to B-3 (general business) to allow expansion
of PJorth End P1achine by adding a storage building for merchandise west of
the existing building.
On October 15, 1981 , the Zoning Committee conducted a public hearing on
the case. A letter from District 6 was received in support. The Zoning
Committee voted 6 to 0 to approve the rezoning.
The Planning Commission considered the Zoning Committee's recommendation
on October 23, 1981 , and voted 18 to 0 to approve the rezoning.
The rezoning is scheduled to be heard by the City Council on December 3,
1981 . Please notify me by December 2 if any member of the City Council
wishes to have slides of the site presented at the City Council public '
hearing.

provided by law; and make no changes ia the improvements on ,

(b) Not discriminate upon the basis of race, color, religion, ,
sea, or national origin in the sale, lease, or rental or in
the use of occupancy of the Property or any improvements '
erected or to be erected thereon, or any part thereof. I
It is intended and agreed that the above and foregoing agre�menta and covenant�l
ahall be running with the land, and that they shell, in any event, and without rega�d
to technical classification or designation, legel ar othezwise, and eaccept only as I�'�,
otherwise specifically provided ia this Deed, be binding, to the fullest extent of I
law and equitq, for the benefit and in favor of, aad enforceable by, the HRA, its ,
successora and a8aigns, the City of Saint Paul, Minnesota, and any successor in �I
interest to the Property, or any part thereof, and the owner of any other lsad or ojE
any interest in such land in the District Area which is subject to the land use, �

requirements and restrictions of the PLAN, and the United States (in the case of �
covgnant in clauae (b) hereof) against the Redeveloper, (or succe8sors ia interest),
and everq auccessor in interest to the Property, or any part thereof, or any intere t
therein, and anq partq in possession or accupancy of the Property or any part therebf.
It ia further intended and agreed that the agreement and covenant provided for in cl�lause
(a) shall remain in effect until July 2, 2009 (st which time such agreement anld
covenant ehall terminate) and the agreements and covenants provided in clause (b) I�
eha11 remain in effect withont limitation se to time: Provided, that such agreemec�ts
and covenaat shall be binding on the Redeveloper itself, each successor in interest�
to the Praperty, and' every part �hereof, and each party in possesesion or occupancy,�l
respectively, only for period as such succesaor or party shall have title to, or I
� an interest in, or poseessioa or occupancy of, the Property or part thereof. The
term "Uses" specified in the PI.AN and the "Land Uee" referring to provisione of th

housing and other requirements or restrictions of the PLAN pertaining to such land. �� �
In amplification, and not in restriction of, the provisions of the preceding '
section, it is intended and agreed that the HRA and its successors and assigns shall I
be deemed beneficiaries of the agreements and covenants provided herein, and the �
United States shall be deemed a beneficiary of the covenants in clause (b) hereof, I

both for and in their own right, and also for the purposes of protecting the interest
of the community and other parties, public or private, in whose favor or for whose ,
benefit these agreements and covenants have been provided. Such agreements and �I
covenants shall run in favor of the HRA and the United States, for the entire I

period during which such agreements and covenants shall be in force and effect, I�
I
�vithout reyard to whether the HRA or the United States has at any time been, 'I
,.emains, or is an owner of any land or interest therein to, or in favor of, which I,
such agreements and covenants relate. The HRA shall authorize in the event of
any breach of any agreement or covenant, and the United States shall have the '
riyht in the event of any breach of the covenant in clause (b) hereof, to exercise .
all the rights and remedies, and to maintain any actions or suits at law or in !

��uity or other proper proceedings to enforce the curing of such breach of agreement �I�

or covenant, to which it or any other beneficiaries of such agreement or covenant ,

3. 'I'his conveyance is made upon the condition subsequent that if, prior to II
completion of improvements by the Redeveloper in accordance with the CONTRACT, and I

PLAN, as such completion shall be certified by the HRA: '
(a) The Redeveloper (or successor in interest) shall default in or violate �
its obligations with respect to the construction of the improvements (includ- �
ing the nature and the dates for the beginning and completion thereof) , or
shall abandon or substantially suspend construction work, and any such default
or violation, abandonment, or suspension shall not be cured, ended or remedie
within three (3) months after written demand by the HRA so to do; or �

(b) The Redeveloper (or successor in interest) shall fail to pay real estate
taxes or assessments on the Property or any part thereof when due, or shall ,
place thereon any encumbrance o.r. lien unauthorized by the CONTRACT, or shall I
suffer any levy or attachment to be made, or any materialmen's or mechanic's I
lien or any other unauthorized encumbrance or lien to attach, and such taxes '
or assessments shall not have been paid, or the encumbrance or lien removed
or discharged, or provision satisfactory to the HRA made for such payment,
removal or discharge, within ninety (90) days after written demand by the HRAII
so to do; or • I
(c) There is, in violation of the CONTRACT, any transfer of the Property or !'
ar►y part thereof, and such violation shall not be cured within sixty (60)
days after written demand by the HRA to the Redeveloper; or
(d) There is, in violation of the Agreement, failure to submit a required or ,
requested Affirmative Action Program or Affirmative Action Progress Report, I
or a failure of an Affirmative Action Participant to substantially comply witl�
the Equal Employment Opportunity requirements of the Agreement or with the
actions or employment standards of an Affirmative Action Program submitted un er
the Agreement, and such violation shall not be cured within thirty (30) days
after written demand by the HRA to the Redeveloper;

then the HRA ahall have the right to re-enter and take posseseion of the Property �
and to terminate and reveet in the HRA the estate conveyed hereln to the Redeveloper�
provided, that such condition subsequent and any revesting of title as a result I�
thereof in the HRA: i
(a) Shall always be aubject to and limited by, and shall not
defeat, render invalid, or limit in any way: i
(1) the lien of any mortgage authorized by the OONTRACT, ,I
and �
(2) any rights or interests provided in the CONTRACT for
the protection of the holdera of such mortgages; and
(b) Shall not apply to individusl parts or parcels of the Property i
(or, in the case of parts or parcels leased, the leasehold interest)
on which there are no defaults under the terms of said CONTRACT; and i
(c) Shall not apply after the improvements have been completed and �
certified to by the HRA. I
4. Promptly after compliAnce with the reatrictions and covenants contained in I
Paragraph 1 and Paragraph 3 above, the HRA will furnish the Redeveloper with an • !
appropriate instrument showing compliance therewith. Such instrument ehall be in ,,
such form and so executed as to make it recordable in the office of Register of Deec�s
or of the Registrar of Titlea, as the case may be, of Ramsey County, Minnesota. Suc�h
instrument by the HRA shall be a conclusive determination of the eatisfactory !

termination of the agreements and covenants of the CONTRACT above referred to, excer�t
for �pecific covenants set forth in this Deed, and shall be a conclusive determinat�.nn

of the satisfactory texznination of the covenants in this Deed with respect to the �
obligation of the Redeveloper, its succesaors and assigns, to construct the improve
ments on the dates for the beginning and completion thereof and with respect to all
of the obligations of the Redeveloper (or successor in interest) under Paragraph 1 ;
and Paragraph 3 above. I
5. If the HRA shall refuse or fail to provide any instrument in accordanc� I
with the proviaions of this Deed, in addition ta any other remedy in law or equity ',
of the Redeveloper (or succeasors in interest), the HRA ehall, within ninety (901 �
days after witten request by the Redeveloper, its successors or aesigns, provide th�e
Redeveloper (or successors in tnterest) with a written statement, indicating in-
adequate detail in what respect the Redeveloper (or auccessor in interest) has
failed to comply with the provisions of the OONTRACT and of this Deed or is othe se
in default, and what measures and acta will be necessary, in the opinion of the I
HRA, for the Redeveloper (or successors in interest) to take or perform in order ;
to obtain auch instrument.

The meeting was chaired by James Bryan, Chairman.
LEO & THOMAS HUPPERT, DOPIKE, FISCHER (�9023) : Rezone from RT-1 to B-3 to �
expand Morth End Machine by adding a storage building for merchandise west
of the building at the southeast carner of bJayzata and Albemarle down to
910 Albemarle.
The applicant was present. There was no opposition present at the hearing.
Ms. Daykin showed slides of the site and reviewed the staff report with a
recommendation for approval . A letter was received from District 6 in
support of the rezoning. '
Tom Huppert, 1551 E. 6th Street, was present to answer any questions.
Hearing no further testimony, Mr. Bryan closed the public hearing portion
of the meeting.
Mr. Armstead made a motion to recor►anend approval of the rezoning based on
findings 1 through 4 of the staff report. Mr. Pangal seconded the motion. j
The motion passed on a roll call vote of 6 to 0.

On September 29, 1981 the District Six Planning Council review�d
the rezoning request of John Pecchia to allow expansion of North
End Machine. (Zots 16-22, Block 1 MeKenty"s Outlots. ) The District
Planning Coun.cil upheld the recommendation of the District Six
I,and Use Task Force to support the zoning change. I
As part of our process the site plan for the expansion was
shared with the Zewis Park Apartments Resident Council. Their
expressed epncerns were with visual buffering of the building, but
were generally supportive of the zoning change.
The District Six Zand Use Plan encourages the expansion of
business to that particular block. With the support of the Zand
Use Plan and the support of the immediate neighbors, the District .
Six Planning Council supports the rezoning from RT-1 to B-3. We '
encourage you also to support this zoning change. Thank you
