An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to P�Iinnesota Statutes § 462. 357 and � 64.21p
of the Legislative Code, the Housing and Redevelopment Authority o�
the City of Saint Paul duly petitioned to rezone vacant streets '
accruing and the following: All of Blocks 90 and 91, West St. Pau'�,
located on the northwest corner of State and Concord from RM-2 to ;
B-2 f or the purpose of constructing a new West Side Clinic and ,
expanding an existing bar/restaurant, the petition having been I
certified by the Department of Finance and Management Services on
September 15, 1981 as having been consented to by at least 670 of ,
the owners of the area of the property to be rezoned, and furtheri
having been consented to by at least two-thirds of the owners of t{he
property situated within 100 feet of the total contiguous descript�ions
of real estate held by the same owner or any party purchasing any � such
contiguous property within one year preceding the date of the pet$tion;
and
WHEREAS, The current Zoning Committee on November 5, 1981 ;
conducted a public hearing for the purpose of considering the re-�
zoning petition, and pursuant to Section 107. 03 of the Administra�
tive Code, submitted its recommendation to the Planning Commissiot�
that the petition be granted; and ; .

WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on November 6, 1981 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing bef ore the City Council
on the said rezoning petition was duly published in the official

Section 1.
That the zoning map of the City of Saint Paul, Sheet Nos. 37 !
and 38, as incorporated by reference in Section 60.301 of the Sair�t
Paul Legislative Code, as amended, is hereby further amended as '
follows: ;
That property located on the northwest corner of State '
and Concord, being more particularly described as
vacant streets accruing and the following: All of
Blocks 90 and 91, West St. Paul, be and is hereby
rezoned fram RM-2 to B-2.

Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

City Council Hearing: December 3, 1981
Dear Sir:
This is written in response to the petition of the Housing & Redevelopment
Authority to rezone property at the northwest corner of State and Concord
from RM-2 (.multi-family residential ) to B-2 (community business) to construc't
a new West Side Clinic and expand an existing bar/restaurant.
The Zoninc� Committee conducted a public hearing on November 5, 1981 , on this
case. No testimony was heard. The Zoning Committee voted 7 to 0 to recomme�nd
approval of the rezoning.
The Planning Commission considered the Zoning Committee's recommendation on
November 6, 1981 , and voted 19 to 0 to approve the rezoning.
The requested rezoning is scheduled to be heard by the City Council on
December 3, 1981 . Please notify me by December 2 if any member of the
City Council wishes to have slides of the site presented at the City Council
public hearing.

The applicant was represented. There was no opposition present.
Ms . Daykin showed slides of the site and reviewed the staff re�ort with a
recommendation for approval . P�o correspondence was received on the matter.
Joe Gomez, representing the Housinq E� Redevelopment Authority, was present
to answer any questions.
Hearing no further testimony, Mr. Bryan closed the public hearing portion of
the meeting.
Mr. Levy made a motion to recommend approval of the rezoninq based on findings
2 through 5 of the staff report. Mr. Hanggi seconded the motion. The mo�ion
passed on a roll call vote of 7 to 0.

2. The Land Use Plan designates Concord Street as a mixed use strip. The P�an
states that, "Intensifying existing retail uses, encouraging new busines uses,
and providing for housing can iielp provide a healthy image for all of St� Paul 's
commercial strips." (.p.26�
3. The Economic Development Strategy of the Comprehensive Plan states that '! .the
City shall consider the feasi6ility of rezoning residential land that wo ld be
more suitable for commercial or industrial purposes." (p.13j. The loca�ion
at the intersection of two major streets make the site an appropriate lo�ation
for commerical development.
4. The uses permitted in 6-2 are compatible with surroundinc� land uses.
5. The rezoning is an extension of an existing B-2 zoning district to the s�uth. _
