WHEREAS, Peter Stumpt applied to the Board of Zoning Appeals �
from a variance from the strict application of the provisions of
Sections 61. 101 and 62 .106 of the Saint Paul Legislative Code
pertaining to building setback and requirements in an R-3 resi-
dential zoning district for his property located at 1283 Danforth I
Street for the purpose of constructing an attached double garage; �
and
WHEREAS, Following a public hearing with notice to affected I
property owners, the Board of Zoning Appeals by its Resolution �
No. 8989 adopted September 22, 1981, varied the provisions of '
Section 61. 101 to allow the construction of a garage with a side i
yard setback of 0 feet and a front setback of 32 feet in accord- ',
ance with the site plan which was attached thereto; and �
WHEREAS, The decision of the Board of Zoning Appeals was ;
based upon its findings that (1) the variance is based on the I
topography of the site and the locatian of the existing princip le I
structure in that the lack of an alley limits access to the site i
from the street; (2) without the variances the owner would incur '�
exceptional practical difficulty in that the windows of the �
existing house necessitate placing the garage three feet from �
the house; (3) the variances can be granted withaut substantial
detri.ment to the community or to the intent of the ordinance in ;
that the garage will be stucco, will require minimal maintenance, I
and drainage will be on to the site; (4) the variances can be
granted without substantial detriment to the neighbors' supply of ;
light, air, health, safety or property values and (5) the variances ;
are not based primarily on a desire for economic gain; and '
WHEREAS, pursuant to the provisions of Section 64.205, Lowell �
C. Raitor, 595 West Orange Avenue, Saint Paul, Minnesota, duly i
filed with the City Clerk his appeal from the said determination ;

Dear Sir:
This letter is written in response to the appeal of Lowell Raitor
to a decision of the Board of Zoning Appeals granting set ac< variances
to Peter Stumpt to construct a garage at 1283 Danforth Street.
On September 8, 1981 , the Board of Zoning Appeals conducted a public
hearing. Three letters were received in opposition; one from Mr. Raitor.
The Board voted 5-0 to grant the variances based on findings that
(1 ) strict application of the Ordinance would result in hardship given
the exceptional topography of the site; (2) the variances would not
impair the intent of the Ordinance; (3) the variance would not sub-
stantially impair the neighbor's supply of light and air, health,
safety or property values; (4) the request f�r variance was not based
primarily on a desire for economic gain.
This appeal is scheduled for November 24, 1981 . Please notify me by
November 23, if any member of the Council wishes to have slides of the
site presented at the hearing.

� WHEREAS, PETER STUMP7 has applied for a variance from the strict application

WHEREAS, the Saint Paul Board of Zoning Appeals conducted a public hearing

WHEREAS, the Saint Paul Board of Zoning Appeals based upon evidence presented
at the public hearing, as substantially reflected in the minutes attached
hereto, made the following findings of fact: .
l . That the strict application of the regulations would result in exceptional
undue hardship upon the owner o` property at 1283 Danforth, as distinguishe�
from mere inconvenience , by reason of the exceptional topography of the site;
2. That the variance can be granted without substantial detriment to the public
good and without substantially impairing the intent and purpose of the
urdi nai��e;
3. That the variance can be granted without substantial detriment to the
neighbors ' supply of light and air, health , safety, or property values ;
4, That �he variance requests are not based primarily upon a desire to
� increase the value or income potential of the parcel of land.
NOW, THEREFORE, BE IT RESOLVED, by the Saint P�ul Board of Zoning Appeals that
tne provisions of Section 61 .101 be hereby waived to allow the construction of
a garage. with a side yard setback of 0' and a front yard setback of 32 ' for
property at 1'283 Danforth , in accordance with the application for variance
and the site plan attached hereto.

Peter Stumpt, representing the appellant, his father, stated that to build
the smallest double garage which would be 18 feet, they would have to
physically attach the garage to the house. He also commented that the drainaqe'
off the property would be handled as well as snow removal .

� Section 62.106 requires attached garaoes to comply with se�backs for the principal
structure -- 42 feet in this case; the applicant proposes a setback of 32 feet or a 10'
variance.
Section 62�106 also requires accessory siructures to be 3 feet from interior lot lines ;
the applicant propases 0' or a variance of 3' .
F. FINDINGS:
l . The variance is based on the topography of the site and the location of the
existing principal structure.
The lack of an alley limits access to this site to the street. The topography !of
the rear yard� (slopes to the west) and the location of the existing house dicta�te
placement of the garage on the level area of the lot currently used for parking.
2, 4lithout variances , the ov�ner would incur exceptional practical difficul ±y.
Windows on the south side of the house necessitate placing the garage 3' from �he
house. The other alternative is to place the garage in the rear yard; this al�ernativ�
is impractical given the topography of the site and the length of the drive��ay (80' ).
Location closer to the street arill provide ample pad space but decrease the amqunt
� of impervious surface.
3. The variances can be granted without substantial detriment to the community or
to the intent of the Ordinance.
The garage will be stucco, requiring minimal maintenance; drainage ti�ill be ontp
the site. The topography of the sites on Danforth and the location of the gar8ge
to the south substantially obscu�-e the varied setback of the garage.
