approved April 30, 1981, which amended State Legislation relating

5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
6 Section 1 . Minnesota S�atutes 1980, Section 43 . 60,
7 Subdivision 3, is amended to read:
8 Subd. 3 . Employees in shared positions shall be eligible
9 for the following benefits and subject to the following
10 obligations:
11 ( 1) Membership in the Minnesota state retirement system,
12 the teachers retirement association, or the highway patrol
13 retirement fund, whichever is appropriate, except that,
14 notwithstanc3ing any provision of sections 352 .01, subdivisions

28 salary applicable for a full-time week or a ful�-time year;
29 (2 ) Vacation and szck leave accrual at the rate of the
30 appropriate shared-time percent of the entitlement of comparable
3I full-time employees;
32 (3 ) Employee dental, medical and hospital benefits coverage
33 shall be available of the same type and coverage afforded to
34 comoarable full-time employees. Employees in shared positions
35 who elect such coverage shall pay, by payrol.l deduction, the
36 difference between the actual cost to the employer and the
37 appropriate shared-time percent of the actual cost. The

1 remaining percent shall be paid by the employer. Employee lif�
2 insurance coverage shall be available to employees in shared ;
3 positions on the same terms as for comparable full-time ''
4 employees;
5 (4) Dependent life insurance coverage shall be available 'to
6 employees in shared positions on the same terms as for
7 comparable full-time employees. Dependent medical, hospital and
8 dental benefits coverage shall be available to employees in
9 shared positions of the same type and coverage afforded to
10 comparable full-time employees, except that the employer shalZ
11 contribute the appropriate shared-time percent of the dollar
12 amount contributed for comparable full-time employees electing
13 the same program, the remainder to be paid by payroll deductian
14 by the employee electing such coverage;
15 (5) Employees in shared positions shall be entitled to the
16 appropriate shared-time percent of the holiday pay to which
17 comparable fu21-time employees are entitled for holidays �
18 observed by the full-time employees whenever the employee in � �
19 shared position would otherwise be scheduled to work on that
20 day. The employee may be allowed to reschedule working hours to
21 avoid any loss in pay due to the prorating of hoTiday pay. When
22 an employee in a shared position is not scheduled to work on an
23 observed holiday the next scheduled working day shall be treated
r
24 as the holiday;
25 ( 6) Employees in shared positions shall accrue seniority
26 time in every relevant category at the same rate accorded to
27 comparable fulJ.-time employees. No fu11-time employee accept:ing
28 a shared position shall suffer any loss of or gap in seniorit:y
29 time in the relevant categories applicable to the £ull-time
30 employment; and
31 (7) Any other benefits of employment for employees in
32 shared positions shall be prorated at a rate of the appropriate
33 shared-time percent of those available to comparable £ull-time
34 employees, whenever the benefits are divisible. Contributiori.s
35 by the employer toward the benefits, if any, shall be equal �o
36 the appropriate share time percent of the £ull.-time benefits.

1 When not divisible, the cost of the full-time benefits normally
2 allocable to the employer shall be allocated, the appropriate
3 shared-time percent to the employee in a shared position, by
4 payroll deduction, and the remaining percent to the employer.

12 Sec. 3 . Minnesota Statutes 1980, Section 69. 011,
13 Subdivision 1, is amended to read:
14 Subdivision l . (DEFINITIONS. J Unless the language or
15 context clearly indicates that a different meaning is intended,
16 the following words and terms shall for the gurposes of this
17 chapter and chapter 424 have the meanings ascribed to them:
18 ( a) "Commissioner" means the commissioner or director of �
19 insurance.
20 (b) "Municipality" means any city of any class, and
21 organized town.
22 (c} "Minnesota Firetown Premium Report" means a blank form
23 containing space for reporting by insurers of fire, lightning,
24 sprinkler leakage and extended coverage premiums less return
25 premiums and dividends received upon risks located or to be
26 performed in this state.
27 (d) "Firetown" means any municipality �having a" qualified
28 fire department or a qualified incorporated fire department
29 having a retirement plan.

3 abstracts filed with the commissioner of revenue or equali.zed by
4 the state board of equalization.
5 fc�i ( f) "Minnesota Aid to Police Premium Report" means a
6 blank form containing space £or reporting by each fire and
7 casualty insurer of all premiums less return premiums and
8 dividends received upon direct business received by it in this
9 state, or by its agents for it, in cash or otherwise, during �he
10 preceding calendar year, with reference to insurance written £or
11 insuring against the perils contained in auto liability-bodil�r
12 injury, auto liability-property damage, and auto physical dam�ge
13 as reported on lines 19, 20, and 21 of page 14 of the fire and
14 casualty insurence companies annual financial statement which
15 each insurer is required to file with the commissioner in
16 accordance with the governing laws or regulations .
17 fk3 (g) "Police of£icer" means any person:
18 ( 1) Whose primary source of income derived from wages is �
19 from direct employment by a municipal.ity or county as a law
20 enforcement officer on a full time basis of not less than 30
21 hours per week;
22 (2 ) Who has been employed for a minimum of six eenseets���e
23 months prior to December 31 preceding the date of the current
24 year' s certification pursuant to suhdivision 2, clause (b) ;
25 (3 ) Who is sworn to enforce the general criminal laws ofl
26 the state and local ordinances; '
27 (4) Who is authorized to arrest with a warrant;
28 (5) Who is a member of a local police relief association or
29 the public employees police and fire fund;
30 (6) Who, i£ employed in a municipal�.ty with a population 'of
31 more than 1, 000 inhabitants according to the most recent federal
32 census, is certified or meets the requirements for certification
33 by the Minnesota police officers trai.ning board; and
34 (7) Who meets the selection standards of the Minnesota
35 police officers training board.
36 E�� (h) "Full time aquivalent number of police officers

1 providing contract service" means the integral or fractional
2 nur,�er of police officers which would be necessary to provide
3 the contract service if all were employed on a full time basis
4 as defined by the employing unit in the mun�cipalzty receiving
5 the contract service.
6 Sec . 4. Minnesota Statutes 1980, Section 69 . 011,
7 Subdivision 2, is amended to read:
8 Subd. 2 . (CLERK TO FILE CERTIFICATE. ] (a) On or before
9 March 1 annually the clerk of each municipality having a duZy
10 organized fire department as provided in subdivision 4, c2ause
11 ( 1) or the secretary of nonprofit fire fighting corporations
12 having a relief and retirement plan or incorporated
13 firefighter' s relief association shall certify that fact and the
14 fire personnel and equipment of the fire department as of the
15 preceding December 31 to the commissioner on a form prescribed
16 by him together with the ather facts the commissioner may
17 require . The certification shall be made to the commissioner in
18 duplicate. Each eopy of the certificate shall be duly. executed
19 and deemed an original . The commissioner shall forward one copy
20 to the auditor of the county wherein the fire department is
21 lacated and retain one copy.
22 (b) On or before March I annually the clerk of each
23 municipality having a duly organized police department and
24 having a duly incorporated relief association shall certify that
25 fact to the county auditor of the county where the police
26 department is located and to the cammissioner on a form
27 prescribed by him together with the other facts the cammissioner
28 or auditor may require.
29 On or before March 1 annually, the clerk of each
30 municipality and the auditor of each county employing one or
31 more police officers as defined in subdivision 1, clause (h) ,
32 shall certify the number of such police afficers to the
33 commissioner on forms preseribed by him. Credit for officer�

34 employed less than a full year shall be apportioned. Each full

35 month of employment of a qualifying officer during the calendar

36 year shall entitle the employing municipality or county to

1 credit for one-twelfth of the payment for employment of a poli' e

2 officer for the entire year. For purposes af sections 69 .011 0
3 69 . 051, employment of a police officer shall commence when the
4 police officer is entered on the payroll of the respective
S municipal police department or county sheriff' s department. Nio
6 police o£ficer shall be included in the certification of the
7 number of police officers by more than one municipality or
8 county for the same month.

9 Sec. 5. Minnesota Statutes 1980, Section 69 .021,
10 Subdivision 1, is amended to read:
11 Subdivision 1. [MINNESOTA EIRETOWN PREMIUM REPORT AND
12 MINNESOTA AID TO POLICE PREMIUM REPORT. ] The commissioner of
13 insurance shall, at the time he mails annual statement and tax
14 forms, send blank copies of the Minnesota Eiretown Premium
15 Report and when applicable the Minnesota Aid to Police Premium
16 Report to each insurer, including township and farmers mutual
17 insurance companies licensed to write insurance as described �;n
18 section 69.011, subdivision 1, e�at�se clauses (c) and e�at�se �g� �
19 ( f) in this state. These reports shall contain space for the
20 insurers name, address, gross premiums less return premiums,
21 dividends, net premiums, certification and other facts the
22 commissioner may require.
23 Sec . 6. Minnesota Statutes 1980, Section 69.021,
24 Subdivision 2, is amended to read:
25 Subd. 2 . (REPORT OF PREMIUMS. ] Each insurer, including
26 township and farmers mutual insurers where appli.cable, shall
27 return to the commissioner with its annual � financial statement
28 � the reports described in subdivision 1 certified by its
29 secretary and president or chief financial officer. The
30 Minnesota Firetown Premium Report shall contain a true and
31 accurate statement of the total. premium for alI gross direct
32 fire, lightning, and sprinkler leakage insurance of all domestic
33 mutual insurers and the total premiums for all gross direct
34 fire, lightning, sprinkler leakage and extended coverage
35 insurance of all other insurers, less return premiums and
36 dividends received by them on that business written or done

2 during the preceding calendar year upon property located within
2 ��e state or brought into the state for temporary use. The tire
3 a�d extended coverage portion of multi-peril and multiple peril
4 package premiums and all other combination premiums shall be
S cetermined by applying percentages determined by the
6 commissioner or by rating bureaus recognized by the
7 commissioner. The Minnesota Aid to Police Premium Report shall
8 contain a true and accurate statement of the total premiums,
9 less return premiums and dividends received, on all direct
10 business received by such insurer in this state, or by its
11 agents far it, in cash or otherwise, during the preceding
12 calendar year, with reference to insurance written for perils
13 described in section 69.011, subdivision 1, clause Fgj (f) .
� I4 Sec. 7 . Minnesota Statutes 1980, Section 69� 021, "+
15 Subdivision 6, is amended to read:
16 Subd. 6, jCALCULATION OF APPORTIONMENT OF RID TO
17 COUNTIES. ] With respect to firefighters, one-half of the state
1$ aid available shall be distributed to the counties in proportion�
19 to their population as shown by the last o£ficia� statewide
20 federal census . The remaining one-hal£ of the state aid
21 available shall be distributed to the counties in proportion ta
22 their assessed property valuation, excluding mineral values.
23 In the case of incorporated or municipal fire departments
2� furnishing fire protection to cities, towns or townships in
25 other counties as evidenced by valid fire service contracts
26 filed with the commissioner of insurance and county auditor the
27 distribution to the respective counties shall be adjusted
28 proportionately to take into consideration the crossover fire

8 police officers, as defined in section 69.011, subdivision 1,

3 In the case of municipalities or independent fire
4 departments qualifying for the aid the county auditor shall
S calculate the state aid for the municipality or relief
6 association on the basis of the population and the property
7 valuation of the area furnished fire protection service by the
8 fire department as evidenced by duly executed and valid fire
9 service agreements filed with him. If one or more fire
10 departments are furnishing contracted fire service to a city,
11 town or township only the population and valuation of the area
12 served by each fire department shall be considered in
13 calculating the state aid and the fire departments furnishing
14 service shall enter inta an agreement apportioning amang
15 themselves the percent of the population and the assessed
16 property valuation of each service areae Agreement shall be in
17 writing and filed with the commissioner in duplicate. The
18 commissioner shall forward one copy of the agreement to the
19 county auditor of the county wherein the fire department is
20 located and retain one copy.
21 In the case of cities of the first and second class the
22 state aid calculated sha11 be paid directly to the treasurer of
23 the relief association. In the case of all other municipalities
24 and independent fire department relief associations ar
25 retirement plans the aid shall be paid to the treasurer of the
26 municipality where the fire department is located a�nd the
27 treasurer of the municipality shall within 30 days transmit the
28 aid to the relief association if the relief association has
29 filed a financial repart with the treasurer of the municipality
30 and has met all other statuto�y provisions pertaining to the aid
31 apportionment. .
32 The county auditor and commissioner are hereby empawered to
33 make rules and regulations to permit the administration of the
34 provisions of this section.
35 (2 ) The county auditor shall apportion the state police aid
36 received by him to each municipality and to the county in the

2 ( a) For all municipalities maintaining police departments'
3 and the county, the state aid sha11 be distributed by the coun�y
4 auditor in proportion to the total number of police officers, as

16 municipality for police service, a proportionate amount of th�
17 state aid distributed to the municipality providing contract
18 service based on the full time equivalent number o£ police �
19 officers providing contract service on a full time equivalent
20 basis shall be credited against t:ze contract obligation of th�e
21 municipality receiving contract service;
22 (d) No municipality entitled to receive police state aid
23 shall be apportioned less police state aid for any year under
24 Laws �976, Chapter 315, than the amount which was apportioned to
25 it for calendar year 1975 based on premiums reported to the
26 commissioner for calendar year 1974; provided, the amount of '
27 police state aid to othez municipalities within the county arid
28 to the county shall be adjusted in proportion to the total
29 number of police officers in the municipalities and the coun�y,
30 so that the amount of palice state aid apportioned shall not
31 exceed the amount of police state aid available for
32 apportionment.

6 Premium Report to the treasurer of the duly incorporated
7 firefighter' s relief association if. there is one organized and
8 the association has filed a financial report with the
9 municipality; but if there is no relief association organized, .
10 or if any association dissolve, be removed, or has hereto£ore
11 dissolved, or has been removed as trustees of state aid, then
12 the treasurer of the municipality shall keep the money in the
13 municipal treasury as provided for in see��ena 4�4-3A and 4�4-3�
14 section 424A.08 and sha21 be disbursed only for the purposes and
15 in the manner set forth in those sections.
16 (2 ) The municipal treasurer, upon receipt of the state aid
17 and tax attributed to insurance premiums reported on the
18 Minnesota Aid to Police Premium Report, shall disburse, the state �
19 aid in the following manner.
20 (a) For a municipality in which a local police relie£
21 association exists and all police officers are members of the
22 association, the total state aid shall be transmitted to the
23 treasurer of the relief association within 30 days of the date
24 of receipt, ar.d the treasurer of the relief associatian shall
25 immediately deposit the total state aid in the special fund of
26 the relief association;
27 (b) For a municipality in which police retirement coverage
28 is provided by the publzc employees police and fire fund and all
29 police officers are members of the fund, the total state aid
30 shall be applied toward the municipality' s employer contribution
31 to the public employees police and fire fund pursuant to section
32 353 . 65, subdivision 3 , and any state aid in excess of the amount
33 required to meet the employer' s contribution pursuant to section
34 353 . 65, subdivision 3, sha11 also be contributed to the public
35 employees poZice and fire fund and credited in the manner to be
36 specified by the board of trustees of the public employees

2 (c) For a municipality in which both a police relief
3 association exists and police retirement caverage is provided in
4 part by the public employees police and fire fund, the

3 disabled and physically unfit to perform his duties as a direct
4 result of an injury, sickness, or other disability incurred in
5 or arisinq out of any act of duty, which shall render the member
6 physically or mentally unable to perform his or her duties,
7 shall receive di�ability benefits during the period of such
8 disability. The benefits shall be paid in monthly installments
9 equal to that portion of the average monthly salary of the
10 member multiplied ( a) by 50 percent and, (b) by an additional
11 two percent for each year and pro rata for completed months of
12 service in excess of 20 years .
13 (2 ) If a member is injured under circumstances which
14 entitle him to receive benefits under the workers' compensation
15 law, he shall receive the same benefits as provided in clause
16 (1 ) , Iess the amount paid to him in weekly benefits under the
17 workers' compensation law.
18 (3 ) Any member who after not less than five years_ of �
19 service, before reaching the age of 55, terminates employmen�
20 because of sickness or injury occurring while not on duty and
21 not engaged in state work entitling the member to membership and
22 the termination is necessary because the member is unable to
23 perform his or her duties shall be entitled to receive a
24 disability benefit. The benefit shall be in the same amount and
25 computed in the same manner as if the member were S5 years of
26 age at the date of disability and the annuity we�e paid pursuant
27 to section 352B. 08. Should disability under this clause occur
28 after five but in less than ten years service, the disability
29 benefit shall be computed as though the member had ten years
30 service.
31 (4) No member shall receive any disability benefit payment
32 when the member has unused annual leave or sick leave or under
33 any other circumstances, when during the period of disability
34 there has been no impairment of salary. Should such member or
35 former member resume a gainful occupation and his or her
36 earnings are less than the salary received at the date of

1 disability or the salary currently paid for similar positions,
2 the disability benefit shall be continued in an amount which
3 when added to earnings does not exceed the salary �received at
4 the date of disability or the salary currently paid for simil2�r

6 in such case does not exceed the disability benefit originally
7 allowed.
8 (5) No disability benefit payment shall be made except upon
9 adeguate proof furnished to the director of the existence of
10 such disability, and during the time when, any such benefits a�e
11 being paid, the director shall have the right� at reasonable '
12 times, to require the disabled former member to submit proof �of
13 the continuance of the disability claimed.
14 (6) A disabled member not eligible for survivorship
15 coverage pursuant to section 352B. 11, subdivision 2, may eledt

2 (g) Part-time employees other than firefighters who receive

7 membership until termination of public service.
8 (h) Persons who first occupy an elected office after March

11 (i ) Emergency employees who are employed by reason of work

13 (j ) Employees who by virtue of their employment are
14 required to contribute to any other pension, relief or

17 legislature has specifically enabled participation by employees
18 of a designated governmental subdivision in a plan supplemental �
19 to tne public employees retirement association; provided that
20 this clause sha11 not prevent a person from contributing to the
21 public employees retirement association and also belonging to or
22 contrzbuting to another public pension fund for other service
23 occurring during the same period of time.
24 (k) Police matrons employed in a police department of any
25 city who are transferred to the jurisdiction of a joint city and
26 county detention and corrections authority.
27 ( 1) Chaplains and nuns who have taken a vow of poverty as
28 members of a religious order.
29 (m) Full-time students who are enrolled and are regularly
30 attending classes at an accredited school, college or
31 university; provided, no person employed full-time by a .
32 governmental subdivision shall be exempt under this paragraph.
33 (n) Resident physicians, medical interns and pharmacist
34 interns who are serving in public hospitals .
35 (o} Appointed or elected officers, paid entirely on a fee
36 basis, and who were not members on Jur�e 30, 197,1 .

9 The members of the municipal police department of Chisholm
10 are hereby authorized to become incorporated pursuant ta the
Z1 provisions of General Statutes 1923 , Chapter 58, and the laws
12 amendatory thereto, and adopt a constitution and bylaws as a
13 relief association, and provide for and permit and allow such
14 police relief association, so incorporated, and organized, to
15 pay out of and from any funds it may have received from any
16 source a service, disability or dependency pension in such
17 amounts and in such manner as its articles of incorporation and
18 bylaws shall designate, subject to the provisions of Laws 1945,
19 Chapzer 74, as amended.
20 When a member has reached the age of 55 50 years or more
21 and served as a member of such municipal police department for a
22 period of 20 years or more, or has been disabled physically or
23 mentally because of any injury received or suffered after at
24 least one year of service as a member of the police department,
25 so as to render necessary his retirement from active police
26 service and cause a total and permanent disability, such
27 retirement member shall be paid each mont2i a pension equal to
28 one-half of his average monthly base total pay during the last
29 six months of his service with said police department. No
30 pension authorized by this act shall be paid to any person after
31 he removes his residence from the United States, or to any
32 person who shall have been convicted of a felony for which he
33 shall have been adjudged to be imprisoned, or who is an habitual
34 drunkard, or to any person receiving a pension or sick relief
35 from any other public relief association.
36 When any member reti�es from said service who either is not

1 entitled to, or does not care to accept a pension, he may
2 withdraw all moneys deducted from his salary, minus any moneys
3 that have been paid out of such fund for his benefit for
4 hospitalization or doctors' services, or in insurance premiums
5 therefor. In that event, neither he nor his dependents shall be
6 entitled to further benefits under Laws 1945, Chapter 74, as
7 amended. Alternatively, a member of the association who
8 completes 20 years of servzce but has not attained 55 50 years�
9 of age may retire without forfeiting his right to a retirement;
10 pension. Upon application he shall be placed upon the preferx�ed
11 pension roll of the association. After he has attained the aqe
12 of �5 SO years the association shall, upon application, commer�lce
13 payment of his pension from the date upon which it approves hi�s
14 application.
15 These monthly payments may be increased by adding theretd
16 an amount not exceeding $S per month for each year of active

17 duty over 20 years of service before retirement not to exceed
18 five years for purposes of pension computation. No such pens�on
19 sha11 be paid to any person while he remains a member of the ',

15 Sec. 5 . ( FIN.b.NCIAL REQUIREMENTS OF THE TRUST FUND. )
16 Commencing January 1, 1979, the city of Thief River Falls
17 shall provide by annual levy an amount sufficient to pay the
18 greater of either:
19 ( a} the aggregate ammount of service pensions, disability
20 benefits, and survivorship benefits projected by the board of
21 trustees of the trust fund established pursuant to section 4 jfor

22 the following calendar year less the amount of assets in the '
23 trust fund as reported in �he last audited financial report olf
24 the association prepared pursuant to Minnesota Statutes, Sectlio�
25 69 . 051 , or
26 (b) an amount equal to the level annual dollar amount

27 sufficient to amortize the unfunded accrued liability of the

28 trust fund by December 31, 1996, as determined in accordance

29 with Minnesota Statutes, Sections 69 . 77, 356.215 and 356. 216,' in

30 the latest actuarial valuation. All revenues generated by aniy
31 levy required under this section shall be transferred to the
32 trust fund.

5 ( 1 ) To the surviving spouse a pension in an amount not to

6 exceed $250 per month payable for life; provided, however, that
----------------------------------------------------------------
7 if the surviving spouse shall remarry, the pension shall
--------------------------------------------------------
8 terminate as of the date of remarriage.

9 (2 ) To the child or children, until the child reaches the
---------------------------------------------------------
10 age of 18 years, a monthly benefit in an amount not to exceed

11 $125 per month. Payments for the benefit of any qualified
12 dependent child under the age of 18 years shalZ+be made to the

13 surviving parent or if none, to the legal guardian of the

14 child. The maximum mQnthly benefit for any one family shall not
ZS exceed $750. If the member shall die under circumstances�which
16 entitle his surv�.ving spouse and dependent children^to receivew

17 benefits under the workers' compensation law, the amounts so

18 received by them shall not be deducted from the benefits payable

20 Subd. 2 . (DEFINITIONS. ) (a} "Surviving spouse" means a

2i person who became the member' s legally married spouse while or

22 prior to the time he was on the payroll of the police department
23 as a police officer, and remained such continuouslyrafter their
24 marriage until. his death, and who, in case therdeceased member

25 was a service or deferred pensioner, was legally married to the
26 member before his retirement from the police department; and
27 who, in any case, was residing with him at the+time of his�
----------------------------------------------------------
28 death. No temporary absence for purposes of business, health or

29 pleasure, shall constitute a change of residenee for the
--------------------------------------------------------
30 purposes of this section.
31 (b) "Surviving child" means any child born the issue of the

32 lawful wedlock of a service, disability or deferred pensioner,

33 or of a deceased active member.

8 Allowable service credit shall only be granted based on
9 amounts deposited in the retirement contribution escrow account

11 of allowable service credit shall be limited to service

12 attributable to the moneys representing contributions

19 representing contributions bear to the contributions that should

21 For any person, the serviGe credit granted pursuant to this

22 section shall be allowable service for the purposes of Mi.nnesota

24 Any person covered by this act who is currently receiving

25 an annuity from the public employees retirement association for

26 service other than service credit granted pursuant to this
27 subdivision shall have their annuity recomputed to include the

28 service credit granted pursuant to this section. The recomputed

29 annuity shall be paid commencing the first day of �he month

30 following the effective date of the act.
31 Subd. 2 . (REPAYMENT OF REE'UND. j Notwithstanding any
32 minimum service period of Minnesota Statutes 1980, Section

33 353 . 35 , upon resuming active membership in the public employees

34 retirement association, any person employed by the Suburban
