Said resolution was adopted after public hearings on said district- ing which were held over the past many months. These public hearings were held after published notice of said heari•ngs and members of the public had the opportunity to speak, and did speak, upon the districting proposals. This districting resolution is being filed today in the Office of the City Clerk, this date beinq sixty days prior to the day on whiich filings open for the first City primary election occurring after the 1980 City election. The procedures described above for dividing the City into seven contiguous districts, the conduct of public hearings after notice, and the adoption of the enclosed districting resolution were done in accordance with and pursuant to Section 4 .01 .02 of the Saint Paul; City Charter, said Section being part of the amendment of the Sa�nt Paul City Charter made by the voters at the general election held on November 4 , 1980 . You ask whether under the Minnesota Statute prohibiting changing precinct boundaries prior to January 1, 1982, it is permissible for the Council to adopt a resolution establishing new precinct boundaries with an effe�tive date after January 1, 1982. The answer is in the affirmative. � � Thw facts relevant to your opinion request are as follows : The voters last November approved a Charter amendment providing that Council members be elected from separate districts sub- stantially equal in population to all other districts. Section 4.01.1 of the Saint Paul City Charter. Sec. 4.01.2 of the City Charter, as amended, provided that the Charter Commission after public hearing establish the initial Council district boundaries. The Charter Commission filed a copy of its resolu- tion establishing Council districts with the City Clerk on October 20, 1981. A number of precincts will encompass two Council districts. It is the desire of the Elections Bureau under the Office of the City Clerk that the City Council prior to the March 16, 1982 primary election re-establish precinct boundaries so that no precinct encompasses more than one Council district. The statutes governing the changing of precinct boundaries are Minnesota Statutes, Sec. 204B.14, Subd. 1, Subd. 3 and Subd. 4. Minnesota Statutes, Sec. 204B.14, Subd. 1, reads as follows : �-�4��SS�. r� � Al Olson Page Two November 4, 1981 9ubdivision 1. Boundaries. The governing body of each municipality shall establish the boundaries of the election precincts in the municipality. The gov- erning body of a county shall establish the boundaries of precincts in unorganized territory in the county. Except as provided in subdivision 3, a governing body may change the boundaries of any election precinct which it has established. Minnesota Statutes, Section 204B.14, Subdivision 3, as amended by the Legislature during the Second Special Session of 1981, reads as follows : Subd. 3. Boundary changes; prohibitions, exceptions. During the period from January 1 in any year ending in seven to January 1 in any year ending in two, no changes may be made in the boundari�s of any election precinct ex- cept as provided in this subdivision. If a city annexes an unincorporated area located in the same county as the city and adjacent to the corporate boundary, the annexed area may be included in an election precinct immediately adjacent to it. A municipality or county may establish new election pre- cincts lying entirely within the boundaries of any existing precinct and shall assign names to the new precincts which include the name of the former precinct. Minnesota Statutes, Section 204B. 14, Subdivision 4, reads as follotils : . . � � � � � � A1 Olson Page Three November 4, 1981 Subd. 4. Boundary change procedure. Any change in the boundary of an election precinct shall be adopted at least 90 days before the date of the next election, and shall not take effect until notice of the change has been posted in the office of the municipal clerk or county auditor for at least 60 days. The municipal clerk or county auditor shall notify each affected registered voter of the change in election precinct boundaries at � least 30 days prior to the first election held after the change takes effect. That paragraph of Minnesota Statutes, Section 204B. 14, Subdivision 3, above underlined was added during the Second Special Session, 1981. The permission to change precinct boundaries during a year ending in one, 1981, does not apply to the City of Saint Paul for Saint Paul does not elect councilmen by wards in a year ending in one, nor does it have a general City election before March 15, 1982. A "general election" is defined in Minnesota Statutes, Section 200.02, Subdivision 2, as: "An election held at regular intervals on a day deter- mined by law or charter at which the voters of the state or its subdivisions choose by ballot public offi- cials or presidential electors. " The general City election for Saint Paul is set by Section 7.01 of the City Charter as the last Tuesday in April of even-numbered years. The 1981 amendment would apply, for example, to the City of Minneapolis which elects aldermen from wards during 1981. The Legislature under Minnesota Statutes, Section 204B.14, Subd. 4, has established a mandatory two-step procedure for changing ward boundaries. First, at least 90 days before the next municipal election, the governing body must adopt a resolution changing precinct boundaries. Second, the City Clerk must post in his office notice of the change for at least 60 days. If the City Clerk failed to post notice for 60 days of the precinct boun- daries changes adopted by the governing body, then the action - '� � � 7 7,� � A1 Olson Page Four November 4, 1981 of the governing body would be a nullity for the Legislature has determined that a change "shall not take effect until notice of the change has been posted in the office of the municipal clerk or county auditor for at least 60 days. " Provisions respecting publication and sufficient notice of ordinances and resolutions are mandatory, and failure to publish or give notice, or to do so substantially in the manner prescribed, renders the ordinance or resolution void. McQuillin Mun. Cor�. (3rd Ed. ) , Section 16.78. The posting requirement under Minnesota Statutes, Section 204. 14, Subdivision 4, is comparable to a Charter provision requiring publication of an ordinance before it is effective. The Minnesota Supreme Court in Town of Burnsville v. City of Bloominqton, 268 Minn. 84, 128 N.W.2d 97, (1964) noted that failure to comply with a Charter mandate that an ordinance be published after adoption by the Council rendered the ordinance ineffective. The selection of words by the Legislature also indicates a legis- lative distinction between making a change, the completed act, and adopting the resolution. Under Minnesota Statutes, Section 204B. 14, Subdivision 3, the Legislature said "no change may be made in the boundaries of any election precinct" before January 1, 1982. If the Legislature intended under Minnesota Statutes, Section 204B. 14, Subd. 4, that the change in precinct boundaries be a completed act 90 days before the next election, it would have said any change in precinct boundaries shall be made 90 days before the next election. Instead, under Minnesota Statutes, Section 204B.14, Subd. 4, the Legislature said that any change in precinct boundaries shall be "adopted" 90 days before the next election and that the change shall not take effect until it is posted in the office of the City Clerk for at least sixty days. � Furthermore, under the Saint Paul City Charter, adoption by the governing body of a resolution, is just the first step in the legislative process. Section 6.08 of the Saint Paul City Charter provides that every ordinance or resolution adopted by the Council be presented to the Mayor for approval or rejection. Although . . ; ' A1 Olson Page Five November 4, 1981 Minnesota Statutes, Section 204B.14, Subdivision l, states that "the governing body of each municipality shall establish the boundaries of election precinets in the municipality, " the Minnesota Supreme Court has ruled that a Charter provision requiring ap- proval of an ordinance or resolution by the Mayor prevails over a general legislative grant of power to the governing body. In State v. Citv of Crookston, 252 Minn. 526, 91 N.W.2d 81, (1958) pursuant to a legislative grant of power to the governing body, the Crookston City Council called an election to consider an annex*- ation petition. After the election the Supreme Court ruled the annexation void for the resolution calling the election had not been approved by the mayor in accordance with the Crookston City Charter. Therefore, under Minnesota Statutes, Section 2048. 14 and the Saint Paul City Charter, a change in precinct boundaries is not effective until all three of the following acts have been completed: first, adoption of a resolution by the City Council; second, ap- proval of the resolution by the Mayor; and third, posting of notic�e of the change in the office of the City Clerk for at least 60 days. It is our opinion that Minnesota Statutes, Section 204B.14 does not prohibit the City Council from adopting prior to January l, 1982, a resolution establishing new precinct boundaries provided that the change in precinct boundaries is not a fait accompli until after January 1, 1982, and, further, provided that the reso- lution establishing the new precinct boundaries is adopted by the City Council at least 90 days prior to the March 16, 1982, primary�.
