Subject: Petition of Minnesota Mining and Manufacturing
C�npany for the vacation of all of the alley in
Block 2, E. M. Mackubin's Addition.
Public Hearing - November 3, 1981 (Revised Report)
Minnesota Mining and Manufacturing Company, owner of all the abutting
property, has petitioned the City of St. Paul for vacation of the City's
interest in the referenced alley to allow expansion of their existing parking
lot. The City currently holds a perpetual easement by Warranty Deed,
recorded and filed June 15, 1942. The area to be vacated consists of 4,912
square feet and is zoned I-2 (Industrial).
Northern States Power Company has overhead electric facilities in the pro-
posed vacation area. They request that their interest be protected until
such time as their facilities are removed.
There were no other objections or recommendations from any other public or
private agencies involved.
In view of the foregaing, I recommend that the vacation be approved, subject •
to the following terms and conditions: ��

conditions of Chapter 130, codified March 1, i981
of the St. Paul Legislative Code, as amended, in-
cZuding the retention of all public utilities ease-
ments.
��Y. That a specific easement be retained to protect tt�e
interests of Northern States Pawer Company within the
vacated alley.

sum of $7,200.00 as compensation for the vacat�

amount of $2,000.00, and in addition thereto, by acceptance
of the terms and conditions of this vacation, agrees to
indemnify, defend and save harml�ss the City of Saint
Paul, its officers and employees from all suits , actions,
or claims of any character, including, but not limited to,
a claim brought because of any injuries, or damages received
or sustained by any person, persons or property, on account
of this vacation; or because of any act or aaission, neglect
or misconduct of said petitioner; or because of any claim
or liability arising from or based on any violation of any
law or regulation made in accordance with the law, whether

RE: Legal description change in the vacation of part of alley in

Dear Mr. Bowser:
The 3M Company, as petitioners of the subject vacation would prefer
that the Council Resolution use the following legal description in said
vacation. I concur with this change.
All of the City's interest in the public alley not
heretofore vacated within Block 2, E. M. MacRubin's
Addition to Saint Paul, abutting Lots 1 through 5,
22, and 24 through 28, including the City's interest
in the public alley heretofore opened across Lots 1,
4, and 24, also Lots 2 and 3.
