A.n administrative Resolution approving the terms
and conditions of a 1982-1983-1984 Memorandum
of Understanding applying to "Supervisory Confidential
Employees" of the City of Saint Paul holding Classified
title s.
WHEREAS, the Council, pursuant to the provisions of Section 12. 09
of the St. Paul City Charter and the Public Employees Labor Relations Act,
recognizes the employees in the confidential group ahall be those employees
defined as "Confidential Employee s"in 5ection 179. 63, Subdivision 8, of �he
Minne s ota Statute s; and
WHEREAS, the City, through its designated representatives, has met
and conferred in order to establish the terms and conditions of employme�t
for the calendar years of 1982, 1983 and 1984 for such personnel as are 8et
forth in the "Memorandum of Understanding", and
WHEREAS, a 1982-1983-1984 "Memorandum of Understanding" has been
reached which includes the same adjustments received by the non-confidelntial
classified supervisory employees; riow therefore, be it
RESOLVED, that the "Memorandusn of Understanding" cited above, dated
as of the effective date of this Resolution, on file in the office of the City �Clerk,
is hereby approved, and the authorized administrative officials of the Cit�r are
hereby authorized and directed to execute said "Memorandum of Understalnding"
on behalf of the City.

This riemoranduM of Understanding shall apply to the Classified Confidential
Supervising Employees holding the following classified titles:
Administrative Assistant--Public �dorks
Assistant Director of Personnel
Chief Examiner and Director of Personnel `
City Training Coordinator
Director of School Caf eterias
General Manager--�Jater Department
Personnel Assistant IV
Program Administrator
1. Employees employed in the aforementioned classif ied supervisory titles and
positions which are considered conf idential shall be Flaced in a salary
range equal to the 1952-1983-1984 salary ranges applicable to euployees
employed in classified supervisory titles in non-conf idential positions
which are in the same pay grade and occupational group as the conf idential
titles.
Employees employed in the aforementioned classif ied supervisory titles and
positions which are considered confidential and which are in pay grades in
which there are no classified supervisory non-confidential titles, sha11
be placed in the 1982, 1983 and 1984 salary ranges which would be applicable
to employees employed in classif ied supervisory non-confidential positions,
if they existed., in the same pay grade anc3 occupatior.al group as the
confidential titles.
The 1982 wage adjustments shall be effective December 26, 1981. The 1983
wage ad�ustments shall be effective December 25, 1982. The 1984 wage
adjustments shall be effective January 1, 1984.
2. E�ployees emgloyed in the aforementioned titles shall cQntinue to be covered
by the vacation schedule shown below:
Years of Service Vacation Days
Less than 8 years 15 days
Af ter 8 years thru 15 years 20 days
After 15 yrs and thereaf ter 25 days
3. For employees employed in the aforementioned t'itles:
3.1 The Employer wi11 continue for the period of this Agrement to
provide such health and lif e insurance benef its as are provided
by Employer at the time of execution of this Agreement.
3.2 The Employer will for the period of this Agreement provide for
employees who retire af ter the time of execution of this Agreement
and until such employe�es reach sixty-f ive (65) years of age such
health insurance benefits as aze provided by the Employer for such
employees and such lif e insurance benefits as provide� in this
article.

3.3 In order to be eligible for the benefits under the early retiree '
provision, the employee must:
3.31 Be receiving benefits from a public employee
retirement act at the time of retirement.
3.32 Have severed his relationship with the City of �
Saint Paul under one of the early retiree plans.
3.33 Inform the Personnel Off ice of the City of Saint
Paul ir_ writing within b0 days of employee's
early retirement date that he or she wishes to be
eligible for early retiree insurance ben.ef its.
3.4 Eff ective October 1, 1981, for each eligible employee covered by
this Agreement who selects� Blue Cross-Blue Shield insurar.ce coverage,
the Employer agrees to cantribute the cost of such coverage or $70.00
per month, whichever is less. In addition, for each em.ployee who
selects Blue Cross-Blue Shield dependent's coverage, the Employer
will contribute the cost of such dependent's coverage or $120.00
per month, whichever is less.
3.5 Effective October 1, 1981, for each eligible employee covered by
this Agreement who selects Groug Health insurance coverage, the
Employer agrees to contribute the cost of such coverage or $70.OQ
per month, whichever is less. In addition, for each employee who
selects Group Health dependent's coverage, the Employer �aill con-
tribute the cost of such dependent's coverage or $120.00 per month,
whichever is less.
3.6 Effective October 1, 1981, for each eligible employee covered by
this Agreement who selects Coordinated Care health insurance cover�.ge,
the E�ployer agrees to contribute the cost of such coverage or $70.00
per month, whichever is less. in addition, for each employee who
selects Coordinated Gare dependent's coverage, the Employer will
contribute the cost of such dependent's coverage or $120.00 per
month, whichever is less.
3.7 Effective October 1, 1981, for each eligible emgloyee covered by
this Agreement who selects HMO-Minnesota insurance cbverage, the
Fmployer agrees to contribute th? cost of such coverage or $70,00
per month, whichever is less. In addition, for each employee who
selects the HMO-Minnesota dependent's coverage, the F�nployer will
contribute the cost of such dependerit's coverage or $120.00 per
mor�th, whichever is Iess.
3.$ Effective October 1, 1981, for each eligible e�nployee covered by
this Agreement who selects the SHARE insurance coverage, the Employer
agrees to contribute the cost of such coverage or $70.00 per month,
whichsver is less. In addition, for each employee who selects the
SHARE dependent's coverage, the Employer will contribute the cost
of such dependent's coverage or $120.00 per month, whichever is less.

3.9 The Employer agrees to contribute the cost for $5,C00 of Life
Insurance Coverage for each escployee who is eligible for such
coverage or $ 2.07 per month, �ahichever amount is less. Any
increa.se in this Lif e Insurance premium shall be paid by the
employee.
3.10 In addition to the $5,000 Life Insurance Coverage in 3.9, the
Employer agrees to contzibute the cost of additional life
insurance coverage or $ .97 per thousand dollars of coverage
per month, whichever amount is Iess. The total amount of life
insurance coverage provided under this section and section 3.9
for each employee shall be equal to the employee's annual salary
to the n�arest full thousand dollars. For the purgose of this
section, the employee's an.nual salary shall be based on the
salary as of the beginning of a contract period. This contri-
bution shall be paid to the City�s Group Health and �r'elfare Plan.
Any premium cost for this life insurance beyond the $ .9? per
thousand dollars of coverage per month shall be paid by the employee.
3.11 Effective October 1, 1982, the Employer's contribution to�oard
employee coverage in Articles 3.4 thru 3.8 will be adjusted in
dollars to reflect the total cost of the October 1, 1982 premium
rates for the respective employee coverages.
3.12 Effective October 1, 1982, the Fanployer's contribution toward
dependent coverage in Articles 3.4 thru 3.8 will be adjusted in
dollars to reflect an increase of seventy-f ive percent (75%)
of the difference between the October 1, 1982 premiums for the
respective dependent's coverages and $12Q.00. In the evzr_t that
the October 1, 1982 premium for dependent coverage does not
exceed $120 .per month, no adjustmenC shall be made in the Employer's
contribution toward dependent coverage.
3.13 Effective October 1, 1983, the October 1, 1982, Erployer's contri-
bution toward employee coverages in Articles 3.4 thru 3.8 will be
ad3usted in dollars to reflect the total cost of the October 1,
1983 premium rates for the respective employee coverages. Any
increase in premiums for employee coverages after September 30,
1984 shall be paid by the employee.
3.�4 Eff ective October 1, 1983, the October 1, 19$2 Enployer's contri-
butions toward dependent's coverages in Articles 3.4 thru 3.8 will
be adjusted in dollars to reflect an increase of seventy-five
percent (75%) of the difference between the October l, 1983
prezniums far the respective dependent's coverages and $120.00.
In the event that the October 1, 1983 premium for �ependent coverage
does not exceed $120 per month no adjustment shall be made in the
Employer's contribution toward dependent coverage. Any increase in
the premiums for dependent coverage af ter September 30, 1984 shall
be paid by the employee.

4. For employees employed in the aforementioned titles:
4.1 The empl.oyer shall provide a severance pay progra� as set forth
in this article.
4.2 To be eligible for the severance pay program, an e�ployee must
meet the following requirE:�:ents:
4.21 The employee must be 58 years of age or older.
4.22 The employee must be voluntarily separated from City
employment or have been subject to separation by lay-off
or compulsory retirement. Those employees who are dis-
charged for cause, misconduct, inefficiency, inco�petency,
or any other disciplinary reason are not eligible for
the City severance pay program.
4.23 The employee must have at least ten (10) years of service
under the classified or unclassif ied Civil Service at the
time of separation.
4.24 The employee must f ile a waiver of re-employment with the
Director of Personnel, which will clearly indicate that
by requesting severance pay, the employee waives all claims
to reinstatement or reemployment (of any type) , with the
City or with Independent School District No. 625.
4.25 The employee must have accumulated a minimum of sixty (60)
days of sick leave credits at the time of his sepaxation
from service.
4.3 If an employee requests severance pay and if the employee meets the
eligibility requirements set forth above, he or she will be granted
severance pay in an amount equal to one-half of the daily rate of
pay for the position held by the employee on the date of separation
for each day of accrued sick leave subject to a maximum of 200
accrued sick leave days.
�i.4 The �imun amount of money that any employee may obtain through
� �this severance pay program is $6,500.
4.5 For the purpose of this severance program, a death of an employee
shall be considered as separation of employment, and if the einployee
would have raet all of the requirements set forth above, at the time
of his or her death, payment of the severance pay nay be made to
the employee's estate or spouse.
4.6 For the purpose of this severar_ce program, a transfer from the City .
of Saint Paul employment to Ir.dependent School District No. 625
employment is not considered a seFaration of er.iployment, and such
transferee shall not be eligible for the City severance pragram.

4.7 The manner of payment of such severance pay shall be �ade in
accordance with the provisions of City Ordinance Na. 11490.
4.8 This severance pay program sha11 be subject to and governed by
the provisions of City Ordinance No. 11490 except in thase cases
where the specific provisions of this article canflict with said
ordinance and in such cases, the provisions of this articZe shall
control.
� 4.9 The provisions of this article shall not be eff ective until
December 31, 1981 , and until such date, the provisions of Ordina�ce
No. 11490, as amended, shall apply in their entirety.
4.10 Any employee hired prior to Decenber 31, 1981 , map, in any event,
and upon meeting the qualif ications of this article or City Ordina�nce
No. 11490, as amended by City Ordinance No. 163Q3, section l, section
6, draw severance pay. However, an election by the employee to c3raw
severance pay under either this article or the ordinance sha1l
constitute a bar to receiving severance pay fram the other. Any
employee hired after December 31, 1981, shall only be entitled te
the benef its of this article upon meeting the qualif ications her�in.
5. Except in cases of malfeasance in office or wi.11fu1 or ��ranton neglect of
duty, Employer shall def end, save harmless and inde�nify employee
against any tort claim or demand, whether groundless or otherwise, arising
out of an alleged act or omission occurring ir. the gerforulance anct scoge
of er�ployee's duties.
6. Employees covered by this Memorandum of Un_derstanding shall receive any
i.mprovements in fringe benef its granted to emploqees in non-conf ideati�l
classif ied supervisory positions which are in the same pay grade and
occu.pational group:

We recommend your approval and submission of this Resolution to the City Council.
PURPOSE AND RATIONALE FOR THIS ACTION
This Resolution approves a 1982-1983-1984 "Memorandum of Understanding"
applicable to the Classified Confidential Supervisory Employees of the City
of St. Paul. There are 10 employees in this group who are i.n classified titles
and who would be in the Management and Professional Supervisory Employees
Organization if they were not "Confidential" employees.
The "Memorandum of Understanding" provides the same salary increases
ne gotiated by M.A,P.S.E.O.
