IFAPPROVED: Cost recovery programs to recover expenses for Summary abatement, Demolition and Boarding- up. This includes cutfing tall grass and weeds, hauling away all garbage, debris, refuse and tires. Also, all household items such as refrigerators, stoves, sofas, chairs and all other items. In winter this includes the removal of snow and ice from sidewalk and cross walks. IF APPROVED: If Council does not approve these charges, General Fund would be required to pay the assessment. Assessments are payable over 1 year and collected with the property taxes if not IF NOT AYPROVED: Neighborhoods would be left to deteriorate and property values would decline. Legislative Hearing Officer recommends denying the appeai. � MINUTES OF TI� LEGISLATIVE HEARING Tuesday, June 20, 2000 O O—`�� Gerry Strathman, I,egislative Hearing Officer Room 330 Courthouse The meeting was called to order at 10:10 a.m. STAFF PRESENT': Dick Lippert, Code Enforcement; Dennis Senty, Code Enforcement; Joe Yannarelly, Code Enforcement Summary abatement appeal on 1108 Sixth Street East (J0002A). (Laid over from 6-6-00) No one appeazed to represent the property. Gerry Strathman recommended approval of the assessment. Summary abatement appeal on 654 Magnolia Avenue East (J0002A). (Laid over from 6-14-00 City Council meeting) (A videotape was shown.) Hue Xiong, owner, appeazed and stated he received a letter on Mazch 8, which was after the property was cleaned up. Mr. Strathman responded the letter was mailed on February 15. (Mr. Xiong showed Mr. Strathman a envelope which was poshnarked March 8 twice.) Mr. Strathman stated the envelope has a return address of CTC Rea1 Estate in California. The letter from the City would not have come from California. He asked who was notified. Mr. Lippert responded Hue Xiong at 654 East Magnolia was norified and CTC in Califomia. The notice was sent to Mr. Xiong on the same day as CTC, and Code Enforcement has no indication the mail was retumed. The properry was posted on February 15. The City did the work on February 29, stated Mr. Stratlunan, which was two weeks after the notices were mailed. Mr. Xiong stated he did not receive a letter from the City. Mr. StratUman responded it was mailed to the owner, and that is what is legally required. Gerry Straihman recommends approval of the assessment. Summary abatement appeal on 1185 Burns Avenue (JOOOlAl). (Laid over from 6-6-00) (No one appeared to represent the property.) Dick Lippert stated the owner viewed the videotape. LEGISLATIVE HEARING MINiJTES OF JUNE 20, 2000 Gerry Sh recommends approval of the assessment. Appeal of summary abatement order on 1915 Margaret Street. �O —��� Marilyn and Daniel Amsdorff, owners, appeared. Mr. Arnsdorff stated Mrs. Amsdorff s son has sustained some injuries and has been helping with the cazs. He can work for a while, then he has to stop for a while. Mr. Strathman stated the summary abatement order is for vehicle parts and tires, and there is a velucle abatement order for 4 vehicles. Joe Yannarelly reported the parts have been taken caze of. Some of the velucles are still in violation. He has granted one e�rtension, and is willing to grant another one. How long will it take to finish the cleanup, asked Mr. Strathman. Mr. Arnsdorff responded they aze collecting parts for the Diplomat and the truck. The other vehicles have current tabs. He has an insurance waiver on the truck because it will not be driven until it is fixed. It is in the driveway. Mr. Strathman asked how long it will take to get the vehicles fixed. Mrs. Arnsdorff responded her son is sick. It will take a while. The engine blocks and parts aze covered and neatly put away. Mr. Sh�athman asked how the property looked the last time. Mr. Yannarelly responded yesterday it did not look bad except there aze two vehioles without tabs and one with a damaged front end that is properly tabbed. Mrs. Arnsdorff stated they were platming to take care of this last year, but they have a lot of problems to deal with. T'hey hope to have one vehicle removed by winter. It is a wreck, but it does not look that bad. She asked how many vehicles are allowed. Mr. Strathman responded no vehicles are allowed to be stored outdoors for more than 30 days when they aze cleazly in an inoperable condition. It appears the vehicles have been there faz longer than allowed, and there does not seem to be a specific plan about getting rid of them. There must be someone in the neighborhood that has complained. Mr. Amsdorff asked could he have 60 days to get them properly licensed and operating. Mr. Yannazelly responded the complaint came in on May 23. One vehicle is on blocks. He deferred w Mr. Lipper� Mr. Lippert stated if the vehicles aze on blocks, open for entry, look like junk, and a potential bazard, he would prefer granting a shorter period of time. If the vehicles aze not currently licensed and one part is needed for it to be a viable automobile, then he has no problem with a 60 day extension. Page 2 Mr. Yannazelly stated a 60 day e�ctension to August 20 would be fine. LEGISLATIVE FiEARING MINiJTES OF JIJNE 20, 2000 Page 3 Gerry Stratbman recommends denying the appeal because the original orders aze conect. ���°� � However, 7oe Yannarelly said he will grant the owners until August 20, 2000, to get the vehicles licensed and operable. Mr. Lippert added he will expect that there will not be additional vehicles, auto parts laying around, and other items to make this a bigger issue. If this is the only problem in the neact 60 days, Code Enforcement can live with it. Appeal of summary abatement order at 53 Dale Street North. Gerry Strathman stated the issue today is an order about grass on the boulevazd. (Code Enforcement showed photographs of the properry to Mr. Stratlimau. They were later retumed.) Jeanette Kamman, owner, appeazed and stated she has been pulling up the grass, but she does not want to cut it because her plants will be destroyed. She is keeping the properry well maintained. Mr. Strathman asked is the grass cut on the boulevazd. Ms. Kamman responded there is no grass to cut, but Holly Avenue is cut. Whatever is growing there is less than 8 inches high, asked Mr. Strathman. Ms. Kamman responded it all depends. She has picked up some other plants. She is pulling up dandelions. There has been poor weather tlus year so she is not sure some of her plants will survive. Trees and plants make a difference to her because she needs oxygen for her asthma condition. Mr. Strathman asked was an inspector out there yesterday. From the photographs, it looks like the plants are more than eight inches high. Dennis Senty responded he was out there yesterday. Most of the plants aze well in excess of eight inches. Ms. Kamman responded her plants aze not unhealthy looking, and she would like to keep them. The plants will have to be less than 8 inches high, stated Mr. Strathman. Ms. Kamman responded she could pull them all up and just leave the dirt there. Also, the City made her boulevazd very small by taking away six inches while the azea across the street got an extra six inches. It is hard to keep things green in the neighborhood when everyone cuts them down. Mr. Strathman asked when this will be abated. Mr. Senty responded he could wait another week for it to be done if Ms. Kamman wants to take caze of the properry herself. Gerry Strathman denied the appeal. The owner has until the City Council meeting on June 28, 2000, to take caze of her property. (Laid over from 6-6-00) No one appeazed to represent the property. Gerry Strathman recommended approval of the assessment. Summary abatement appeal on 654 Magnolia Avenue East (J0002A). (Laid over from 6-14-00 City Council meeting) (A videotape was shown.) Hue Xiong, owner, appeazed and stated he received a letter on Mazch 8, which was after the property was cleaned up. Mr. Strathman responded the letter was mailed on February 15. (Mr. Xiong showed Mr. Strathman a envelope which was poshnarked March 8 twice.) Mr. Strathman stated the envelope has a return address of CTC Rea1 Estate in California. The letter from the City would not have come from California. He asked who was notified. Mr. Lippert responded Hue Xiong at 654 East Magnolia was norified and CTC in Califomia. The notice was sent to Mr. Xiong on the same day as CTC, and Code Enforcement has no indication the mail was retumed. The properry was posted on February 15. The City did the work on February 29, stated Mr. Stratlunan, which was two weeks after the notices were mailed. Mr. Xiong stated he did not receive a letter from the City. Mr. StratUman responded it was mailed to the owner, and that is what is legally required. Gerry Straihman recommends approval of the assessment. Summary abatement appeal on 1185 Burns Avenue (JOOOlAl). (Laid over from 6-6-00) (No one appeared to represent the property.) Dick Lippert stated the owner viewed the videotape. LEGISLATIVE HEARING MINiJTES OF JUNE 20, 2000 Gerry Sh recommends approval of the assessment. Appeal of summary abatement order on 1915 Margaret Street. �O —��� Marilyn and Daniel Amsdorff, owners, appeared. Mr. Arnsdorff stated Mrs. Amsdorff s son has sustained some injuries and has been helping with the cazs. He can work for a while, then he has to stop for a while. Mr. Strathman stated the summary abatement order is for vehicle parts and tires, and there is a velucle abatement order for 4 vehicles. Joe Yannarelly reported the parts have been taken caze of. Some of the velucles are still in violation. He has granted one e�rtension, and is willing to grant another one. How long will it take to finish the cleanup, asked Mr. Strathman. Mr. Arnsdorff responded they aze collecting parts for the Diplomat and the truck. The other vehicles have current tabs. He has an insurance waiver on the truck because it will not be driven until it is fixed. It is in the driveway. Mr. Strathman asked how long it will take to get the vehicles fixed. Mrs. Arnsdorff responded her son is sick. It will take a while. The engine blocks and parts aze covered and neatly put away. Mr. Sh�athman asked how the property looked the last time. Mr. Yannarelly responded yesterday it did not look bad except there aze two vehioles without tabs and one with a damaged front end that is properly tabbed. Mrs. Arnsdorff stated they were platming to take care of this last year, but they have a lot of problems to deal with. T'hey hope to have one vehicle removed by winter. It is a wreck, but it does not look that bad. She asked how many vehicles are allowed. Mr. Strathman responded no vehicles are allowed to be stored outdoors for more than 30 days when they aze cleazly in an inoperable condition. It appears the vehicles have been there faz longer than allowed, and there does not seem to be a specific plan about getting rid of them. There must be someone in the neighborhood that has complained. Mr. Amsdorff asked could he have 60 days to get them properly licensed and operating. Mr. Yannazelly responded the complaint came in on May 23. One vehicle is on blocks. He deferred w Mr. Lipper� Mr. Lippert stated if the vehicles aze on blocks, open for entry, look like junk, and a potential bazard, he would prefer granting a shorter period of time. If the vehicles aze not currently licensed and one part is needed for it to be a viable automobile, then he has no problem with a 60 day extension. Page 2 Mr. Yannazelly stated a 60 day e�ctension to August 20 would be fine. Mr. Lippert added he will expect that there will not be additional vehicles, auto parts laying around, and other items to make this a bigger issue. If this is the only problem in the neact 60 days, Code Enforcement can live with it. Appeal of summary abatement order at 53 Dale Street North. Gerry Strathman stated the issue today is an order about grass on the boulevazd. (Code Enforcement showed photographs of the properry to Mr. Stratlimau. They were later retumed.) Jeanette Kamman, owner, appeazed and stated she has been pulling up the grass, but she does not want to cut it because her plants will be destroyed. She is keeping the properry well maintained. Mr. Strathman asked is the grass cut on the boulevazd. Ms. Kamman responded there is no grass to cut, but Holly Avenue is cut. Whatever is growing there is less than 8 inches high, asked Mr. Strathman. Ms. Kamman responded it all depends. She has picked up some other plants. She is pulling up dandelions. There has been poor weather tlus year so she is not sure some of her plants will survive. Trees and plants make a difference to her because she needs oxygen for her asthma condition. Mr. Strathman asked was an inspector out there yesterday. From the photographs, it looks like the plants are more than eight inches high. Dennis Senty responded he was out there yesterday. Most of the plants aze well in excess of eight inches. Ms. Kamman responded her plants aze not unhealthy looking, and she would like to keep them. The plants will have to be less than 8 inches high, stated Mr. Strathman. Ms. Kamman responded she could pull them all up and just leave the dirt there. Also, the City made her boulevazd very small by taking away six inches while the azea across the street got an extra six inches. It is hard to keep things green in the neighborhood when everyone cuts them down. Mr. Strathman asked when this will be abated. Mr. Senty responded he could wait another week for it to be done if Ms. Kamman wants to take caze of the properry herself. Gerry Strathman denied the appeal. The owner has until the City Council meeting on June 28, 2000, to take caze of her property. (Laid over from 6-6-00) No one appeazed to represent the property. Gerry Strathman recommended approval of the assessment. Summary abatement appeal on 654 Magnolia Avenue East (J0002A). (Laid over from 6-14-00 City Council meeting) (A videotape was shown.) Hue Xiong, owner, appeazed and stated he received a letter on Mazch 8, which was after the property was cleaned up. Mr. Strathman responded the letter was mailed on February 15. (Mr. Xiong showed Mr. Strathman a envelope which was poshnarked March 8 twice.) Mr. Strathman stated the envelope has a return address of CTC Rea1 Estate in California. The letter from the City would not have come from California. He asked who was notified. Mr. Lippert responded Hue Xiong at 654 East Magnolia was norified and CTC in Califomia. The notice was sent to Mr. Xiong on the same day as CTC, and Code Enforcement has no indication the mail was retumed. The properry was posted on February 15. The City did the work on February 29, stated Mr. Stratlunan, which was two weeks after the notices were mailed. Mr. Xiong stated he did not receive a letter from the City. Mr. StratUman responded it was mailed to the owner, and that is what is legally required. Gerry Straihman recommends approval of the assessment. LEGISLATIVE HEARING MINiJTES OF JUNE 20, 2000 Gerry Sh recommends approval of the assessment. Appeal of summary abatement order on 1915 Margaret Street. �O —��� Marilyn and Daniel Amsdorff, owners, appeared. Mr. Arnsdorff stated Mrs. Amsdorff s son has sustained some injuries and has been helping with the cazs. He can work for a while, then he has to stop for a while. Mr. Strathman stated the summary abatement order is for vehicle parts and tires, and there is a velucle abatement order for 4 vehicles. Joe Yannarelly reported the parts have been taken caze of. Some of the velucles are still in violation. He has granted one e�rtension, and is willing to grant another one. How long will it take to finish the cleanup, asked Mr. Strathman. Mr. Arnsdorff responded they aze collecting parts for the Diplomat and the truck. The other vehicles have current tabs. He has an insurance waiver on the truck because it will not be driven until it is fixed. It is in the driveway. Mr. Strathman asked how long it will take to get the vehicles fixed. Mrs. Arnsdorff responded her son is sick. It will take a while. The engine blocks and parts aze covered and neatly put away. Mr. Sh�athman asked how the property looked the last time. Mr. Yannarelly responded yesterday it did not look bad except there aze two vehioles without tabs and one with a damaged front end that is properly tabbed. Mrs. Arnsdorff stated they were platming to take care of this last year, but they have a lot of problems to deal with. T'hey hope to have one vehicle removed by winter. It is a wreck, but it does not look that bad. She asked how many vehicles are allowed. Mr. Strathman responded no vehicles are allowed to be stored outdoors for more than 30 days when they aze cleazly in an inoperable condition. It appears the vehicles have been there faz longer than allowed, and there does not seem to be a specific plan about getting rid of them. There must be someone in the neighborhood that has complained. Mr. Amsdorff asked could he have 60 days to get them properly licensed and operating. Mr. Yannazelly responded the complaint came in on May 23. One vehicle is on blocks. He deferred w Mr. Lipper� Mr. Lippert stated if the vehicles aze on blocks, open for entry, look like junk, and a potential bazard, he would prefer granting a shorter period of time. If the vehicles aze not currently licensed and one part is needed for it to be a viable automobile, then he has no problem with a 60 day extension. Page 2 Mr. Yannazelly stated a 60 day e�ctension to August 20 would be fine. LEGISLATIVE FiEARING MINiJTES OF JIJNE 20, 2000 Page 3 Gerry Stratbman recommends denying the appeal because the original orders aze conect. ���°� � However, 7oe Yannarelly said he will grant the owners until August 20, 2000, to get the vehicles licensed and operable. Mr. Lippert added he will expect that there will not be additional vehicles, auto parts laying around, and other items to make this a bigger issue. If this is the only problem in the neact 60 days, Code Enforcement can live with it. Appeal of summary abatement order at 53 Dale Street North. Gerry Strathman stated the issue today is an order about grass on the boulevazd. (Code Enforcement showed photographs of the properry to Mr. Stratlimau. They were later retumed.) Jeanette Kamman, owner, appeazed and stated she has been pulling up the grass, but she does not want to cut it because her plants will be destroyed. She is keeping the properry well maintained. Mr. Strathman asked is the grass cut on the boulevazd. Ms. Kamman responded there is no grass to cut, but Holly Avenue is cut. Whatever is growing there is less than 8 inches high, asked Mr. Strathman. Ms. Kamman responded it all depends. She has picked up some other plants. She is pulling up dandelions. There has been poor weather tlus year so she is not sure some of her plants will survive. Trees and plants make a difference to her because she needs oxygen for her asthma condition. Mr. Strathman asked was an inspector out there yesterday. From the photographs, it looks like the plants are more than eight inches high. Dennis Senty responded he was out there yesterday. Most of the plants aze well in excess of eight inches. Ms. Kamman responded her plants aze not unhealthy looking, and she would like to keep them. The plants will have to be less than 8 inches high, stated Mr. Strathman. Ms. Kamman responded she could pull them all up and just leave the dirt there. Also, the City made her boulevazd very small by taking away six inches while the azea across the street got an extra six inches. It is hard to keep things green in the neighborhood when everyone cuts them down. Mr. Strathman asked when this will be abated. Mr. Senty responded he could wait another week for it to be done if Ms. Kamman wants to take caze of the properry herself. Gerry Strathman denied the appeal. The owner has until the City Council meeting on June 28, 2000, to take caze of her property. The meeting was adjourned at 1035 p.m. �
