Saint Paul Legislative Code pertaining to
zoning for the City af Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Niinnesota Statutes �462.357 and �64.210
of the Legislative Code, Harry Hadd duly petitioned to rezone
except parts taken for highway, and except the north 300 feet,
and except the west 398 feet, Lot 1, Block 9, Eastview Addition �
Number 5, located an the northwest corner of Etna and Wilson,
from B-2 to B-3 f or the purpose of constructing a motel, the
petition having been certified by the Department of Finance and
Management Services on Pdovember 14, 1980 as having been consented
to by at least 67% of the owners of the area of the property to be
rezoned, and further having been consented to by at least two-
thirds of the owners of the property situatec� within 100 feet of
the total contiguous descriptions of real estate held by the same
owner or any party purchasing any such contiguous property within
ane year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on August 20, 1981 �
conducted a public hearing for the purpose of considering the
: rezoning petition, and pursuant to Section 107 . 03 of the Admini-
strative Code, submitted its recommendation to the Planning Com-
mission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on August 28, 1981 and recoznmended ,
that the City Council approve the petition; and ;

WHEREAS, A public hearing before the City Council, having
been conducted on October 22, 1981 where all interested persons
were heard, and the Council having considered all the facts and
recommendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 23,
as incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the northwest corner of

Dear Sir:
This letter is written in response to the petition of Harry Hadd to rezone property
at the northwest corner of Wilson and Etna from B-2 (community business) to B-3
(general business) to permit construction of a 2-story motel .
The case was first heard by the Zoning Committee on December 18, 1980. After
several layovers at the request of the applicant, the case was considered again
on August 20, 1981 . District 4 submitted a letter in support of the rezoning, re-
versing their earlier position in opposition to the rezoning. One letter was
received from a property owner at 1366 E. Third Street in opposition to the rezoning.
The Zoning Committee voted 5-2 to recommend approval of the rezoning on the basis
of the District Council 's support of the rezoning.
The Planning Commission considered the Zoning Committee`s recommendation on
August 28, 1981 and voted 12-5 to approve the rezoning.
The requested rezoning is scheduled to be heard by the City Council on October 22,
1981 . Please notify me by October 21 if any member of the City Council wishes to
have slides of the site presented at the City Council public hearing.

A. PURPOSE: Rezone from B-2 to B-3 to allow constructior� of a 2�story hotel ,
B. SUFFICIENCY: The petition was declared sufficient by the Finance Department on
Novem Er 14, 1980. Fifteen parcels were eligible to sign the petition; 10 parcels were
needed; and 10 parcels were obtained.
C. SITE & AREA CONDITIONS: The site is approximately 118,119 sq. ft. and is vacant. North
of t e site is a small shopping area and parking lot, with a Countp�y Club Market, barber
shop, and vacant storefront; to the west is vacant land proposed for development as a
sports club. Beyond the shopping center, the surroundinq area is residential except
for vacant land in the Etna Birmingham corridor. The Etna/Birmingham study has designated
the vacant land across Etna from the site as an appropriate site for townhouse development.
D. ZONING HISTORY: The site was zoned "A" Residence in 1922; in the 1931 amendments , it
remain�Residence; by 1971 , it was designated "Commercial ." In 1975, it was
designated B-2.
E. FINDINGS:
1 . The St. Paul Land Use Plan designates this site as part of a neighborhood comimercial
center. The District 4 Plan designates the site as "commercial ."
2. The draft District 4 Housing Plan identifies this site as appropriate for mixed use
development, combining housing and community-level retail and service uses. The
existing B-2 zoning would accommodate this use.
3. The community level retail and service uses allowed in B-2 are more appropri�te to
the site than the general business uses allowed in B-3, which include auto repair
stations and fast food restaurants.
4. The uses allowed in 6-2 are more likely to complement and reinforce existing
commercial uses at the small shopping center than the uses allowed in B-3. A hotel ,
in particular, would serve a transient population which would not bolster the existing
commercial uses to the extent that community business uses would.
F. STAFF RECOMMENDATION: Based on findings 1 through 4, staff recommends denial of the �
rezoning to B-3.

On August 17th, the Dayton's Bluff District 4 Community Council Board of Directors
reviewed Mr. Hadd's rezoning request from B-2 to B� for the property at the north-
west corner of Wilson and Etna Streets to allow construction of a 2-story motel.
After a presentation by �r. Hadd on the proposed scaled-down development and
appropriate resident input, the Cor►'►munity Council Board voted to recommend the
approval of the requested rezoning.
Earlier reservations about the rezoning of this properiy were not resolved; however,
they were outweighed by concerns that the adjacent communiiy business area was
losing businesses and that no new development would take place to stabilize this
commercial area without this rezoning.
We hope that this Committee will consider our recommendation in its deliberations
on this rezoning request.

Levy, and Papgal of the Zoning Comm�ittee; P�r. Garvey, Assistant
City Attorney; Ms. Lane of the Division of Housinq and Building
Code Enforcement; Ms. Beseman and Ms. Daykin of the Planning
Division Staff.

The meeting was chaired by Joseph Pangal , Vice-Chairman.
HARRY HADD (#8780) : Petition to rezone from B-2 to B-3 to allow construction
of a 2-story hotel located on the northwest corner of Etna and Wilson.
The applicant was present. There was no opposition present at the hearing.
D1s. Daykin showed slides of the site and reviewed staff findings with a
recortenendation for denial . District 4 submitted a letter stating their
support of the rezoning; one letter was received in opposition.
Harry Hadd, Marine on St. Croix, explained that in their original proposal
they were attempting to construct a 17-story, 256 unit hotel but because of
financing difficulties and opposition from the local people, they downgraded
their proposal to a 2-story motel . Phase 1 would consist of 57 units, employ
18 people, and have a $127,000 a year payroll. Phase 2 would consist of
160 units , employ approximately 40 additional people, and have a �200,0�^ a year
payroll . They have letters from t�lidway �Vational gank & Northv�estern National Bank to
support their project financially. He stated that they are at a point now
where they need to have the zoning resolved because the next expenditure of
funds for the architect will be quite considerable.
There was discussion regarding the location of a restaurant in the hotel and
parking.
Hearing no further testimony, Mr. Pangal closed the public hearing portion of
the meeting.
Ms. Daykin stated that the objection to the project is based on the belief
that the B-3 zoning would not be appropriate for that site. If the hotel
should not be developed, it would permit other intense business uses. It would
not reinforce or compler�ent the shopping center as much as B-2 uses would.
She also mentioned there is sor�e problem with access; there is not direct
access to 94 west from the site. The applicant has had a number of different
versions of the hotel which makes it difficult to know exactly what is going
to be built.
Mr. Lanegran made a motion to recommend approval of the rezoning based on
the recomnendation submitted by District 4. Mr, Hanggi seconded the motion.
The motion passed on a roll call vote of 5 to 2 with Mr. Armstead and
Ms. Sumners voting against the motion.

Current plans ca11 fo� the motel facility to be built .in two or more phases
dependent upon financial considerations and business results when Pha,se I is
opened and operating.
Phase I will consist of 5'j units and 67 paxking spaces. The cost will

amount to about $1,300.00 with an owners equity of about $4U0,000.00.
It is expected tnat about 18 people will be employed initially with a
payroll in the neighborhood of $12?�000.00 annually. Taxes for the first
phase are expected to be about $36,000.00
Phase II would increase the number of rooms by $3 and paxking spaces by
87• The employee number would increase to over 40� and the pa,yroll would
be expected to exceed $200,000.00. Taxes and licenses probably would
exceed $100,000.00 for the entire facility when completed.
_ � Construction of the motel could start by October, 1981� provided interest
rates reach an acceptable investment level. Plans axe being readiect
with the expectation that rates will soon reach a satisfactory level.
As soon as rezoning is approved, complete architectural pla.ns will be
developed and submitted to Best Western for a franchise.
1'resently, the property being rezoned is zoned B-2, but is unoccupied.
Offers have been received from two investment groups to use the
property for an indoor roller skating rink facility. However, because of
its location at the 194 interstate exit, the site� it is felt, would
better be used if it was rezoned to B-3 and a reasonably priced, luxury,
moderate sized motel is erected on it.

On December 15th, the Dayton' s Bluff/District 4 Community Council.
Board of Directors reviewed the rezoning request from B-2 to B-3 for
the property at the northwest corner of Etna and Wilson for the pur-
pose of the construction of a hotel of approximately 200 rooms.
The Board voted, without dissent, to recommend the denial of the
requested rezoning based on the following:
1. The Dayton' s Bluff District 4 Plan designates this site as
"Commercial" and the recently adopted St. Paul Land Use Plan
designates this site as part of an isolated neicthborhood cen-
ter. The intent of both is clearly that this commercial area
should be a Comanunity Business area (B-2) and not a General
Business area (B-3) or a mixed used commercial cluster. A
B-3 zoning for the purpose of a hotel would therefore be in-
appropriate.
2 . 'I'he proposed site is not adjacent to nor would it be an expansion
of a B-3 area. A B-3 would be a more intensive commercial i�se
and inappropriate to the surrounding residential character pf
that area.

3 . A rezoning of this site to a B-3 and construction of a hotel
would be premature at this time for the following reasons:
a. Although it is Mr. Hadd' s stated intent�on to have a hotel
built, a rezoning at this time would not ensure that and
would open that site up to other uses permitted under a B-3.
b. A 200 room hotel development with it' s required parking
would necessitate competition for already limited parking
facilities; there is no assurance that adequate parking
exists for all of the commercial activity, especially in
light of the impending development of the Sun Ray West Spo�'ts
Spa.
C. Traffic problems already existing in that area have not been
adequately addressed, nor has the question of highway access-
ibility and the impact of traffic on the surrounding residen-
tial neighborhood related to that limited access.
In conslusion, we sympathize with Mx . Hadd' s desire to develop com-
mercial property he owns and support commercial development in that
area (as indicated by our support of the Sun Ray West Sports Spa) ,
but recommend denial of a B-3 zoning as inappropriate and premature
for that site.
