NOTICE OF VIOLATION Owner/Manager Rainbow Foods 892 Arcade Street Saint Paul, Minnesota 55106 RE: Ali licenses held by Fleming Companies, Inc., d/b/a Rainbow Foods for the premises at 892 Arcade Street in Saint Paul License ID #: 10845 Dear Sir/Madam: The Office of License, Inspections and Environmentai Protection has recommended adverse action against the licenses held by Fleming Companies, Inc., d/b/a Rainbow Foods for the premises at 892 Arcade Street in Saint Paul. The basis for the recommendation is as follows: On May 15, 2000 an eighteen-year old female entered the premises of Rainbow Foods at 892 Arcade Sfreet as part of a liquor compliance check, and purchased a twelve-pack of Miiler beer. The clerk sold her the alcohol after requesting identi£cation and being told that the pnrchaser did not have any with her. Sale of alcohol to an individual under the age of 21 is a violation of Minn. Stat. §340A.503, subd. 2(1) and Saint Paul Legislative Code §409.08(2)a. Since this is considered a first violation, the licensing office will recommend a 5500.00 fine, pursuant to St. Paul Legislative Code §409.26. At this time you have three options on how to proceed: l. If you do not dispute the above facts and do not wish to have a public hearing, you will need to pay the recommended fine for this violation. The letter should be directed to Ms. Christine Rozek. Payment of the fine will be considered to be a waiver of the hearing to which you aze entitled. 2. Alternatively, if you do not dispute the above facts, but wish to have a public hearin� before the Saint Paul City Council, you will need to send me a letter with a statement admittin� the violation and requesting a hearing by Monday, 7une 5, 2000. The matter will then be scheduled before the City Council for a public hearin� to determine what penalty, if any, to impose. You wiil have an opportunity to appeaz before the Council and make a statement on your own behalf as to the penalty to be imposed. If you do dispute the above facts, a hearing will be scheduled before an Administrative Law Judge. At that hearing both you and the City will be able to appeaz and present witnesses, evidence, and cross-examine the other's witnesses. The St. Paul City Council will ultimately decide the case. The basis for the recommendation is as follows: On May 15, 2000 an eighteen-year old female entered the premises of Rainbow Foods at 892 Arcade Sfreet as part of a liquor compliance check, and purchased a twelve-pack of Miiler beer. The clerk sold her the alcohol after requesting identi£cation and being told that the pnrchaser did not have any with her. Sale of alcohol to an individual under the age of 21 is a violation of Minn. Stat. §340A.503, subd. 2(1) and Saint Paul Legislative Code §409.08(2)a. Since this is considered a first violation, the licensing office will recommend a 5500.00 fine, pursuant to St. Paul Legislative Code §409.26. At this time you have three options on how to proceed: l. If you do not dispute the above facts and do not wish to have a public hearing, you will need to pay the recommended fine for this violation. The matter will then be scheduled before the City Council for a public hearin� to determine what penalty, if any, to impose. You wiil have an opportunity to appeaz before the Council and make a statement on your own behalf as to the penalty to be imposed. If you do dispute the above facts, a hearing will be scheduled before an Administrative Law Judge.
