(License ID No. 0010845), located at 892 Arcade Street in Saint Paul is hereby ordered to pay a
fine of $500.00 for the violation of Sale of Alcoholic Beverages to an Underage Person.
Said fine shall be paid to the Office of License, Inspections and Environmental Protection
within thiriy (30) days of the adoption of this resolution by the Council and signature by the
Mayor.
This resolution and the action of the Council in this matter are based upon the facts
contained in the May 24, 2000, Notice of Violation letter to the licensee, the Law E�nforcement
Buy Report Form, the Liquor Compliance Check Sheet, and such arguments as may haue been
made at the public hearing. The licensee did not contest the facts of the violation.

Dear Sir/Madam:
The Office of License, Inspections and Environmentai Protection has recommended
adverse action against the licenses held by Fleming Companies, Inc., d/b/a Rainbow Foods for
the premises at 892 Arcade Street in Saint Paul. The basis for the recommendation is as follows:
On May 15, 2000 an eighteen-year old female entered the
premises of Rainbow Foods at 892 Arcade Sfreet as part of a
liquor compliance check, and purchased a twelve-pack of
Miiler beer. The clerk sold her the alcohol after requesting
identi£cation and being told that the pnrchaser did not have
any with her. Sale of alcohol to an individual under the age of
21 is a violation of Minn. Stat. §340A.503, subd. 2(1) and Saint
Paul Legislative Code §409.08(2)a.
Since this is considered a first violation, the licensing office will recommend a 5500.00
fine, pursuant to St. Paul Legislative Code §409.26.
At this time you have three options on how to proceed:
l. If you do not dispute the above facts and do not wish to have a public hearing, you will
need to pay the recommended fine for this violation. If this is your choice, you should
make payment directly to the Office of License, Inspections and Environmental

Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be considered to be a waiver of the hearing to which you aze entitled.
2. Alternatively, if you do not dispute the above facts, but wish to have a public hearin�
before the Saint Paul City Council, you will need to send me a letter with a statement
admittin� the violation and requesting a hearing by Monday, 7une 5, 2000. The matter
will then be scheduled before the City Council for a public hearin� to determine what
penalty, if any, to impose. You wiil have an opportunity to appeaz before the Council and
make a statement on your own behalf as to the penalty to be imposed.
If you do dispute the above facts, a hearing will be scheduled before an Administrative
Law Judge. At that hearing both you and the City will be able to appeaz and present
witnesses, evidence, and cross-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Monday, June
5, 2000, how you wish to proceed.
If you have not contacted me by Monday, June 5, 2000, I will assume that you are
not contesting #he facts and will schednie this matter for the St. Paul City Council and have
it placed on the Consent Agenda during which no public discussion is ailowed and Yhe
recommended penalty wili be imposed.

(License ID No. 0010845), located at 892 Arcade Street in Saint Paul is hereby ordered to pay a
fine of $500.00 for the violation of Sale of Alcoholic Beverages to an Underage Person.
Said fine shall be paid to the Office of License, Inspections and Environmental Protection
within thiriy (30) days of the adoption of this resolution by the Council and signature by the
Mayor.
This resolution and the action of the Council in this matter are based upon the facts
contained in the May 24, 2000, Notice of Violation letter to the licensee, the Law E�nforcement
Buy Report Form, the Liquor Compliance Check Sheet, and such arguments as may haue been

Dear Sir/Madam:
The Office of License, Inspections and Environmentai Protection has recommended
adverse action against the licenses held by Fleming Companies, Inc., d/b/a Rainbow Foods for
the premises at 892 Arcade Street in Saint Paul. The basis for the recommendation is as follows:
On May 15, 2000 an eighteen-year old female entered the
premises of Rainbow Foods at 892 Arcade Sfreet as part of a
liquor compliance check, and purchased a twelve-pack of
Miiler beer. The clerk sold her the alcohol after requesting
identi£cation and being told that the pnrchaser did not have
any with her. Sale of alcohol to an individual under the age of
21 is a violation of Minn. Stat. §340A.503, subd. 2(1) and Saint
Paul Legislative Code §409.08(2)a.
Since this is considered a first violation, the licensing office will recommend a 5500.00
fine, pursuant to St. Paul Legislative Code §409.26.
At this time you have three options on how to proceed:
l. If you do not dispute the above facts and do not wish to have a public hearing, you will
need to pay the recommended fine for this violation. If this is your choice, you should
make payment directly to the Office of License, Inspections and Environmental

Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be considered to be a waiver of the hearing to which you aze entitled.
2. Alternatively, if you do not dispute the above facts, but wish to have a public hearin�
before the Saint Paul City Council, you will need to send me a letter with a statement
admittin� the violation and requesting a hearing by Monday, 7une 5, 2000. The matter
will then be scheduled before the City Council for a public hearin� to determine what
penalty, if any, to impose. You wiil have an opportunity to appeaz before the Council and
make a statement on your own behalf as to the penalty to be imposed.
If you do dispute the above facts, a hearing will be scheduled before an Administrative
Law Judge. At that hearing both you and the City will be able to appeaz and present
witnesses, evidence, and cross-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Monday, June
5, 2000, how you wish to proceed.
If you have not contacted me by Monday, June 5, 2000, I will assume that you are
not contesting #he facts and will schednie this matter for the St. Paul City Council and have
it placed on the Consent Agenda during which no public discussion is ailowed and Yhe
recommended penalty wili be imposed.

Dear Sir/Madam:
The Office of License, Inspections and Environmentai Protection has recommended
adverse action against the licenses held by Fleming Companies, Inc., d/b/a Rainbow Foods for
the premises at 892 Arcade Street in Saint Paul. The basis for the recommendation is as follows:
On May 15, 2000 an eighteen-year old female entered the
premises of Rainbow Foods at 892 Arcade Sfreet as part of a
liquor compliance check, and purchased a twelve-pack of
Miiler beer. The clerk sold her the alcohol after requesting
identi£cation and being told that the pnrchaser did not have
any with her. Sale of alcohol to an individual under the age of
21 is a violation of Minn. Stat. §340A.503, subd. 2(1) and Saint
Paul Legislative Code §409.08(2)a.
Since this is considered a first violation, the licensing office will recommend a 5500.00
fine, pursuant to St. Paul Legislative Code §409.26.
At this time you have three options on how to proceed:
l. If you do not dispute the above facts and do not wish to have a public hearing, you will
need to pay the recommended fine for this violation. If this is your choice, you should
make payment directly to the Office of License, Inspections and Environmental

Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be considered to be a waiver of the hearing to which you aze entitled.
2. Alternatively, if you do not dispute the above facts, but wish to have a public hearin�
before the Saint Paul City Council, you will need to send me a letter with a statement
admittin� the violation and requesting a hearing by Monday, 7une 5, 2000. The matter
will then be scheduled before the City Council for a public hearin� to determine what
penalty, if any, to impose. You wiil have an opportunity to appeaz before the Council and
make a statement on your own behalf as to the penalty to be imposed.
If you do dispute the above facts, a hearing will be scheduled before an Administrative
Law Judge. At that hearing both you and the City will be able to appeaz and present
witnesses, evidence, and cross-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Monday, June
5, 2000, how you wish to proceed.
If you have not contacted me by Monday, June 5, 2000, I will assume that you are
not contesting #he facts and will schednie this matter for the St. Paul City Council and have
it placed on the Consent Agenda during which no public discussion is ailowed and Yhe
recommended penalty wili be imposed.
