An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes �462 .357 and �64.210
of the Legislative Code, Marvin Anderson Constructian duly petitioned
to rezone except for street; Lot 1 and N 65 ' of Lot 2 and the vacated
street accruing, Oak Park Addition, located on the East side of
Hazelwood Street between the Chicago, 5t. Paul, Minneapolis & Omaha
Railroad tracks and Case Avenue from R-4 to RT-1 for the purpose of
constructing four duplexes, the petition having been certified by
the Department of Finance and Management Services on April 30, 1981
as having been consented to by at least 67� of the owners of the area
of the property to be rezoned, and further having been consented to
by at least two-thirds of the owners of the property situated within
100 feet of the total contiguous descriptions of real estate held by
the same owner or any party purchasing any such contiguous property
within one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on June 18, 1981 conducted
a public hearing for the purpose of considering the rezoning petition,.
and pursuant to Section 107 .03 of the Administrative Code, submitted
its recommendation to the Planning Commission that the petition be
granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on June 26, 1981 and recommended that
the City Council approve the petition; and '
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official '

to each owner of affected property and property situated wholly or
partly within 350 feet of the property sought to be rezoned; and
WHEREAS, A public hearing before the City Council, having been
conducted on July 30, 1981 where all interested persons were heard,
and the Council having considered all the facts and recommendations
concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet No. 15,
as incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located on the East side of Hazelwood Street
between the Chicago, St. Paul, Minneapolis & Omaha Railroad
tracks and Case Avenue, being more particularly described
as Except for street; Lot l and N 65 ' of Lot 2 and the
vacated street accruing, Oak Park Addition, be and is
hereby rezoned from R-4 to RT-1.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

This is written in response to the petition of Marvin Anderson Construction
to rezone the above described property from R-4 sing e fam�ly residentia )
to RT-1 (duplex residential ) in order to construct four duplexes. On June 18,
1981 , the Zoning Committee of the Planning Commission conducted a public
hearing on this case and recommended approval of the rezoning to. RT-1 on a
vote of 7 to 0.
The Planning Commission considered the Zoning Committee's recommendation
on June 26, 1981 , and recommended approval of the rezoning to RT-1 on a vote
of 16 to 0.
This matter is scheduled for hearing before the City Council on July 30, t98f .

must give written consent before the City shall consider the proposal. However, when the
owner of said property has owned for any time in the past year additional real estate contiguous
to the land proposed for rezoning, 2/3 of the property owners within 100 feet of this larger

it exceeds said sum shall be deducted from the balance owing to
the Party of the First Part under this Contract for Deed or any
outstanding Promissory Note .
In the event Party of the ��irst Part decides to sell this Con-
tract for Deed or to discount the Promissory Note in the event
of the rmrtgages , Party of the First Part �hall give Second Party
the right of first refusal in purchasing said Contract for Deed
or Pr�omissory Note at the san;e price and term� a� a sale to a
bona fide purchaser. If Second Party does not elect tr purchase
the contract for deed or promissory note fror� First Part,y , seller
is fr•ee to sell said contract for deed or promissory note to a
bona fide purchaser. However, should Party of the First Fart
r�duce the purchase pric� to an amount below that amount which
was offered to the Second Party , Party of the Fir�st Part must
again offer the Contract for Deed or Promissory Note to the
Second Party at the new price and on the riew terms . Party of
the First Part; agrees to notify Second Party of his intent to
sell in writing with said notice containin�; the price and terms
of payment . Second Party shall have ten ( 10 � days f:�om re��eipt
of said notice to elect to purchase said contract for° deed or
promissory note . Notice shall be deemed �iven by Second Party
,ahen deposited in the mail properly addressed to Party of the First
Part and f�rst class posta��;e prepaid. Tf Second ?'arty elects to
