RESOLUTION APPROVING JOINT POWERS AGREEMENT FOR THE
ADMINISTR.ATION, OPERATTON AND FINANCZNG OF THE
ENERGY PARK DEVELOPMENT AND TAX TNCREMENT F2NANCING
DISTRICT AND AUTHORIZSNG EXECUTION THEREOF
WHEREAS:
A. By Resolution C.F. No. 276898 , the City Council puxsuant
to Minnesota Statutes, Chapter 472A established Energy Park
Development District as Development District No. 3 (the "District")
to provide impetus for commercial development, to increase employ-
ment, to protect pedestrians from vehicle traffic and inclement
weather, to provide the necessary linkage between peripheral
parking facilities and places of employment and shopping, to
provide offstreet parking to service the shoppers and employees
of the District, to provide open space relief within the District,,
and to provide other facilities as are outlined in the developmen�
program for the District;
B. By Resolutions 1499 , 1535, 1609, 1697 and 1827, the
Port Authority of the City of Saint Paul (the "Port Authority")
pursuant to Minnesota Statutes, Chapter 458 establ.ished approx-
imately the same geographic area as Energy Park Economic Indus-
trial Development District (the "2ndustrial Development District")
for purposes of establishing and developing a system of economic/'
industrial developments;
C. By Resolution C.F. No. 276899, the City Council pursuant�
to Minnesota Statutes, Section 472A.10 designated the Port Author�ity
as administrator of the District.

D. By Resolution C.F. No. 276900, the City Council pursuant
to Minnesota Statutes, Section 273 .71 to 273 .78 and Chapter
472A designated the District as a tax increment financing distri�t
and adopted a Development Program and Tax Increment Financing Pl�n
(collectively the "Plan") for the District for the purpose of
financing the capital and administration costs of the District.
E. The Port Authority and the City desire to enter into a
Joint Powers Agreement to provide for the administration and
operation of the District by the Port Authority, to provide for
the financing of the District pursuant to the Plan and to set
forth the responsibilities of the City and the Port Authority
in connection therewith.
NOW THEREFORE, BE IT RESOLVED by the City Council that the
Joint Powers Agreement for the Administration, Operation and
Financing of the Energy Park Development and Tax Increment
Financing District is hereby
approved and that the proper officers of the City are hereby
authorized to execute said Agreement after it has been approved
as to form by the Assistant City Attorney.
