BE IT RESOLVED, That the Council of the City of Saint Paul hereby ciertifies
and approves the action of the City of Saint Paul Board of Apgeals and! Re-
view pertaining to the following listed property and as shown by the E�xcerpted

APPEARANCE : Mr. tiVollin said he had been issued a Certificate of OcCupancy
on is property shortly after buying it about a year and ahalf ago. He
t�as about to se11 it, but a month ago had received a letter from the city
that the basement unit was more than 50o below . grade and use of it s�ould
be discontinued. He would suffer an economic loss ,if he could notes�ll

- on the same basis , i.e. , a three-unit building, as he had bought i�.
Alice Bij j ani agreed that the bui�.ding had been inappropriately certif�.ed
in the past. A prior owner had been told that the room used as a b�droom
should not be occupied as a sleeping roam, however, because of the inade-
� quate size of the window for use as an emergency escape route. Nev�rtihe-
less , a Certificate of Occupancy had been issued. She reported �Cha� there
had been substantial improvements made in recent years , deconvertin� from
five units to three , and a general upgrading of the units . She suggested
that the living room area be used for sleeping instead of the prese�t use,
there being a larger window suitable for escape purposes there.
rir. Wollin said the priox owner had not informed him at the time of sale
� that the city had stipulated the discontinuance of using the bedraom for
sleeping. He said it would be possible to put in a larger window, and he
would do so, if required. He preferred to continue the bedroom use .in its
present� location, rather than make �the�living room into::a� sleeping �oom:
HOARD ACTION: Mr. Tiltan moved to grant a variance of Sectian 54.I3 to
�ermit occupancy of dwelling unit more than 50a below grade , on condition
tfiat an escape window measuring a minimum of 10� of floor area squa�e
footage be installed in the sleeping room and placed in such mannex �as to
avoid interference between first floor rear entrance and escape windoir
of basement sleeping room in use of either means of egress. Ms. Burg
seconded. MOTION CARRIED AND SO ORDERED. �

SUBJECT: Request variance of Section 5�_Z1, to permit occupancy of a
�ng unit which has no bathing facilities within its walls , because
of lack of space. __
APPEARANCE: John Sipf - -
PROCEEDINGS: Mr. Sipf explained that three of the four apartments had �
t eir own complete bathroom facilities , but the other unit; an effi�iency
on second floor, had only a stool and handsink. There was no space� for
a tub or shower, but there was a shower in the basement for the tenant�s
exclusive use. He rented only to one person in the unit becau�e zt was
so small. He was complying with all remaining work orders listed i,n the
city's letter of 5/26/81. - _ . -
BOARD ACTION: Chairman Knutson moved that a variance of Section S4. II
e granted to permit. occupancy of apartment where the bathroom la�ked
bathing facilities , on condition that the unit never be rented to more
than one person and that all remaining items listed in the city`s letter
of 5/26/81 be completed by December 1, 1981. Mr. Tilton seconded.

I�ir. Tilton spoke of the great need for low-rent housing such as the �unit
under consideration and asked the board to give further thought to tZ2e
situation, perhaps limiting the variance to the period of Mr. Sipf's
ownership.
BOARD ACTION: Mr. Sawyer moved to grant a variance of Section 54. 11 on �
tFe same conditions of Mr. Knutson' s motion, adding to it th at the v�riance
be effective only for the period of the appellant's ownership. Ms . Burg
seconded. MOTION CARRIED AND SO ORDERED. . � _ .

PROCEEDINGS: Mr. Carlson told the board that he had owned and lived. in
alf o� the building for 50 years. The other half consisted of one �.part-.
ment on first floor and another on the second.
� --�- Alice Bijjani said she had inspected the property herself, and it appe.ared -
to have beer_ built as a fourplex without bathrooms . These were add�d later,
using small amounts of space from existing rooms in each apartment, but
handsinks were r�ot inc2uded:� , .Afte.r:a recent Certificate of Occupancp in-
Spection, Mr. Carlson had been in�ormed th at he must put handsinks in each
fiathroom to comply with code. ,
Mr. Car�lson said he was complying with all work orders listed in the city's
' . letter of June 24, 1981, except for the installation of a handsink i� the
. second floor apartment, where his plumber said there was no space for one.
He said his tenant there had lived in the unit for the last 15 years and
did not find the lack of a handsink to be an inconvenience. The kitchen
.�ntas adj acent and the tenant used the kitchen sink to wash up. _ _

Ms . Bijjani stated that the arrangement of the unit was poor. To use the
xear entrance , it was necessary to step through une doon,ray that led into
the bathroom and through another doorway �.nto the kitchen. So much wall
space was taken by the two doors that it was" practically impossible to
find a spot where a handsink could be conveniently placed. �
BOARD ACTION: Mr. Tilton moved that a variance of Sect�.on 54.11 be �ranted,
permitting continued occupancy of the second floor dwelling unit where
there is �no handsink in the bathroom. Mr. .Sawyer seconded. �:MOTION CARRIED
AND SO ORDERED. .
