On June 18, 1981 , the Zoning Gommittee conducted a public.hearing on the case. No correspondence was received and only the applicant testified at the public hearing. The Committee voted 4-3 tv deny the re2oning, based on findings 5, 6, and 7 of the staff report. . On June 26, 1981 , the Planning Commission considered the Zoning Committee's recommendation and voted 14-2 to deny the rezoning (Brown and FitzGibbon voting no) . The rezoning request is scheduled to be heard by the City Council on July 23, 1981 . STAFF INUESTIGATION & REPORT: DATE 6/10/81 BY Donna M. Daykin • A. PURPOSE: Rezone from R-4 to RT-1 to allow a single-family home to be converted to a dup�ex. B. Sufficiency: The Finance Department declared the petition sufficient on May 8, 1981, Twelve parcels were eligible to sign the petition; 8 parcels were needed; and 11 parcels were obtained. C. FRQNTAGE & AREA: This corner lot has a frontage of 50 feet on Ohio and a frontage of 150 feet on Wyominc� for a total area of 7,500 square feet. D. SITE & AREA CONDITIONS: The site is occupied by a single-family home constructed in 1915. The lot slopes upward away from the street so that the house is set about 10 feet above street grade. The surrounding land use is predominantly single-family residential . E. FINDINGS: 1 . The site was zoned "A" Residence from 1922 until it was designated R-4 under the 1975 citywide zoning amendments. 2. The structure was built as a single-family home in 1915. The present owner purchased the house in 1940, at which time he converted it to a duplex. It was used as a duplex until approximately 1952, when it was converted back to a single-family home. �It has been used continuously as a single-family home since that time. 3. In an RT-1 zone, a lot size of 6,000 sq. ft. and a lot frontage of 50 feet is required for two family use. The parcel has adequate lot area and frontage to meet these requirements. 4. The Land Use Plan and the Housing Policy Plan address the issue of large house conversions , stating that further study is necessary to determine under what circumstances large house conversions should be allowed. (Housing St. Paul , 1980-1990, p.11 & 12 and Land Use Plan, p.42 & 43. ) 5. The house in question is not a large house. It is a 12 story house with a foundation size of 996 sq. ft. - 6. Rezoning the parcel would create one RT-1 parcel in a large R-4 zone. There is nothing about the lot or structure which distinguishes it from other lots or structures in the R-4 zone. Therefore, the rezoning could be considered spot zoning. 7. The rezoning request appears to be an effort to relieve one lot of restrictions applying generally to the area as a whole. F. CLARENCE & ARLE�E KAMMERER (#8901 � : Petition to rezone from R-4 to RT-1 to allow a single-family home to be converted to a duplex at 841 Ohio Street. The applicant was present. There was no opposition present at the hearing. Ms . Daykin showed slides of the site and reviewed her staff report with a • recommendation for denial . No comment was received from the District 3 Planning Council . Mr. Pangal questioned the use of the term spot zoning as a consideration for denial . Staff indicated that the rezoning would only involve 1 lot. Clarence Kammerer, 841 Ohio Street, testified that they bought the property in 1940, remodeled the structure, and began renting it out in September of that year. As their family grew, they had to take over the entire house. Now their family is gone and it is their intent to re-establish the structure as a 2-family unit. He stated that off-street parking would be provided; there is a single car garage and an attached carport in the rear of the property. It is a large 3-room apartment and he--is aware of the requirements he would have to meet in order to bring the property up to code. He also stated that he received no neighborhood opposition and has 14 signatures in support. Hearing no further testimony, Mr. Bryan closed the public hearing portion of the meeting. Mr. Pangal made a motion to recommend approval of the rezoning. P�ir. Armstead seconded the motion. The motion failed on a roll call vote of 3 to 4 with Mr. Levy, Ms. Karns , Mr. Lane�ran, and Bryan voting against the motion. Mr. Lanegran then made a motion to recommend denial of the rezoning based on findings 5, 6, and 7 of the staff. Mr. Levy seconded the motion. The motion passed on a roll call vote of 4 to 3 with Mr: Armstead, Mr. Pangal , and h1r. Bryan voting against the motion.
