An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes §462.357 and �64 .210
of the Legislative Code, James Miles duly petitioned to rezone
Lots 23, 24 and 25, Block 1, Bryant's Addition, located on the
north side of Ashland between Victoria and Avon from RT-1 to RT-2
for the purpose of constructing a 4-unit townhouse, the �etition
having been certified by the Department of Finance and Management
Services on May 8, 1981 as having been consented to by at least
67g of the owners of the area of the property to be rezoned, and
further Yiaving been consented to by at least two-thirds of the
owners of the property situated within 100 feet of the total
contiguous descriptions of real estate held by the same owner or
any party purchasing any such contiguous property within one year
preceding the date of the petition; and
WHEREAS, The current Planning Committee on June 18, 1981
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107 .03 of the Admini-
strative Code, submitted its recommendation to the Planning Com-
mission that the petition be granted; and
WHEREAS, The Planning Coitunission considered the rezoning
petition at its meeting held on June 26, 1981 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official
newspaper of the City on July 11, 1981 and notices were duly

WHEREAS, A public hearing before the City Council, having
been conducted on July 23, 1981 where all interested persons were
heard, and the Council having considered all the facts and
recommendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 19
and Sheet No. 20, as incorporated by reference in Section 60.301
of the Saint Paul Legislative Code, as amended, is hereby further
amended as follows:
That property located on the north side of Ashland
between Victoria and Avon, being more particularly
described as Lots 23, 24 and 25, Block l, Bryant 's
Addition, be and is hereby rezoned from RT-1 to RT-2.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
This letter is written in response to the petition of James Miles to rezone
3 vacant lots at 823, 827 and 831 Ashland Avenue (north side between Victoria
and Avon) from RT-1 (one and two fam�ly residential ) to RT-2 (three and four
family and townhouse residential ) to allow the construction of a four-unit
townhouse.
The Zoning Committee conducted a public hearing on the case on June 18, 1981 .
No one testified at the public hearing. Four letters were received in support
of the rezoning, one with four signatures, in addition to a letter from
District 8 in support of the rezoning. The Zoning Committee voted 7-O.to
recommend approval of the rezoning.
The Planning Commission considered the Zoning Corrmittee's recommendation on
June 26, 1981 , and voted 15-0 to approve the rezoning.
The rezoning request is scheduled to be heard by the City Council on July 23,
1�981 . Please notify me by July 22 if any member of the City Counci1 wishes
to have slides of the site presented at the City Council public hearing.

G. STAFF INVESTIGATION & REPORT: DATE 6/9/81 BY Donna M. Daykin
A. PURPOSE: Rezone from RT-1 to RT-2 to allow construction of a four-unit townhouse.
B. SUFFICIENCY: The petition was de.clared sufficient by the Finance Department on May 8,
19�—Twenty-seven parcels were eligible to sign the petition; 18 parcels were needed;
and 21 parcels were obtained.
C. FROPJTAGE & AREA: The parcel has a frontage of 120 feet on Ashland and a depth of .
118 feet for an area of 14,160 square feet.
D. SITE & AREA CONDITIONS: Three duplexes were cleared from the site in 1975. The
site is presently vacant and is flat. Surrounding land uses include large single family,
duplex, and triplex homes built around �the turn of the century. blebster Magnet School
is located 12 blocks east of the site.
E. FINDINGS:
1 . The development proposed for the site is a 4-unit townhouse structure with a
projected selling price of $70,000 - $85,000 per unit. The developer has applied
for funding under the McKnight Housing Fund.
2. The site plan indicates that each unit will have two off-street parking spaces ,
which meets the Zoning Ordinance parking requirements for new construction of
townhouses.
3. According to the 1974 Land Use Survey, the site was formerly occupied by 3 duplexes ,
or 6 housing units. The proposed density of four housing units is lower than the
previous density.
4. The Housing Policy Plan encourages a more efficient use of land resources for
housing development b,y encouraging development of duplexes and triplexes on
scattered vacant infill sites in lower density residential area (Policy S5, p.9) .
5. The Land Use Plan states that "On scattered vacant sites in existing neighborhoods ,
the City will establish criteria which will allow new housing development at
densities somewhat higher than the existing zoning but compatible with the aeneral
existing pattern of development." (P.41 , Policy 4.1-4)
6. The District 8 Plan designates this area as low density residential (_6-10 housing
units/acre) (p.8) . The proposed development has a density of approximately 12
units/acre, which is only slightly higher than the density recommended in the plan.
7. Based on the above 3 findings , the rezoning is found to be in conformance with the
Comprehensive Plan.
8. The rezoning would be compatible ��rith the prevailing land use in the area and
►vould not create disharmony between land uses.
F. STAFF RECOMMENDATION: Based on findings 3 through 8, staff recommends approval of
the rezoning to RT-2.

The applicant was present. There was no opposition present at the hearing.
P�s. Daykin showed slides of the site and reviewed her staff report with a
recommendation for approval . District 8 submitted a letter in support and
3 letters were received in support, one with 4 signatures.
The applicant was present to answer any questions.
Hearing no further testimony, Mr. Bryan closed the public hearing portion of
the meeting.
P�Ir. Levy made a motion to recommend approval of the rezoning based on findings
3 through 8 of the staff report. Mr. Armstead seconded the motion. The
motion passed on a roll call vote of 7 to 0.

Our �upport is ba�ed upon several factors:
1) The lots in question are at present vacant� and tY�us both an
eyesore and a hang-eut . apot. Both issues are of concern to a
rapidly developing and stabilizing neighborhood. Undeveloped lota
hold back progresa as well aa the property values� an issue of
importance to both property owners as well as thd city.
2) kecognizing that thc�e lots must not and will not sit vac�.nt
indefinitly� Jim Niles ' project offers an ideal solution to
use of these lots. Four living units on three lots i5 well within
the prevalent density patterns in the area� and allows a developer
to be able to rrovide quality con�truction� de:ign and a price
ran�e suitcd to the nei�hborhood.
3) Jim r�7iles is a neighborhood reGident � and ha� been for rrany
years . His cQncern for the area is genuine. His integrity and
quality work have been ciemon�trated by previous projects.
4) `1'he project in question ia well-designed to blend into the
existing neighbarhood. Y�e fEel that it will definitely enhance
the block. The units are de�igned to be energy efficient - a plu:jc.
'1'he size of the units provide a K�elcome and positive alt�rnative
to persons wantin� to buy in this area� yet not wanting a l�rge
homc.
As homeowners in this block, we wholeheartedly �upport the proposcd
devel�pm�nt as bein� of value to thc immediate neighborhood as well
as the city.

Dear Ms . Daykin ;
The District 8 Planning Council has reviewed Mr . Miles '
proposal and request for rezoning for his development pro-
ject at 827-31 Ashland , and has given approval to it .
The information presented to the council that supported
our recommendation was that Mpls . /St . Paul Family Housing
Fund financing would be sought , that the energy credit would
be used , that the unit prices would be such that equity par-
ticipation loans would be applied for and that they had an
affirmative action plan . These factors combined would pro-
vide homeownership opportunities to low and moderate income
families and economically benefit the neighborhood in its
construction .
. However , the information distributed by PED regarding
projects requesting Family Housing Fund financing indicates
that equity participation loans have not been requested and
that there is no affirmative action plan . Given this infor-
mation , we could not follow through with our recommendations .
I talked to Mr . Miles about these discrepancie� and he
assured me that the information was wrong. I said I needed
that to be verified by the city.
Jerry Jenkins called and stated that she had taZked to
Ken Gauthier and Vicki Murray and they said Mr . Miles has
requested 50% equity participation and an-:affirmative action
plan exists . We will accept this verbal verification and
proceed on that basis and contiriue to recommend Mr . Miles '
project and request , but we will need written verification .
