William Donovan Valuation and Assessment Engineer f Date: June 3, 1981 � � Subject: Petition of I,a.ura and Robert Ekstrand and the Webb Company for the vacation of part of Stewart Avenue Public Hearing - June 30, 1981 The petitioners request that a portion of Stewart Averlue be vacated. They propose to use the paved portion of Stewart Avenue as a main access road for the Webb Plant. The unpaved portion �of Stewart Avenue will be landscaped to enhance the appeaxance of the main access road. The petitioners now awn all the property abutting saa.d part of Stewaxt Avenue. This portion of Stewart Avenue is an improved, 66 foot wide by approximately �+65 foot long street consisting of 30,690 squaxe feet. The area is zoned I-1. The Department of Public Works has no objections to the proposed vacation, subject to the following conditions: a. A 30 foot wide permanent sewer easeanent must be retained centered along the existing 12 inch C.I.P. sewer for the , flil.l length oP the street right-of-wa.y. b. The petitioner must a�ree to pay for the costs involved in the removal of the existing City stop sign and the relocation of the street name sign estima.ted to cost $50.00. The Water Utility reports a 12 inch water main in tha.t portion of Stewart Avenue proposed to be vacated. In order to assure that the Water Utility will contirnze to have access to water f acilities, a.n easement �uust be retained over and across the north thirty-three (33) feet of the street. Northwestern Bell Telephone Compar�y has a buried cable on the sauth side of Stewart Avenue from Homer Street east to the Webb Company, providing service for that company and, therefore, wish to continue their utility easement in this street. Northerri States Power Company reports one pole with overhead conductors and a four inch gas ma.in in the proposed vacation area. They request that their interests be protected. The Department of Fire and Safety Services requests that the City's f�.re Y�ydrants remain in the proposed vacation axea. i i The Department of Planning and Economic Development has reviewed the proposed va.cation and has no objections. . � � � � ��7��� -z- There were no other objections or recommendations f�om ar�y other public or priva.te agencies involved. In view of the foregoing, I recommend tha.t the vacation be approved, sub�ect to the following terms and conditions: l. Tha.t the description of the streets to be va.cated read as follvws: All that part of Stewart Avenue including cul-de-sa.c lying between the southwesterly line of Lot 3, F. T. Watson's Sub Division of Lot 22 of Fort Outlots to St.Paul, as extended Northwesterly across Stewart Avenue and the easterly boundary of Homer Street which is a line between the southwest corner of Lot 18 Fort Street Out I,ots and the south- east corner of Stewart Avenue and Homer Street as apened, I �8.
