Subject: Petition of the City of Saint Paul for
the vacation of the Garf�eld School site
Public Hearing - June 30, 1981 ,
George Latimer, Mayor of the City of Saint Paul, has si�ed a petition
to vacate the Garfield School site located on Gorman Street between
Geor�e Avenue and Stevens Street, at the request of the Departmeut of
Planning and Economic Development. The Independent School District
No. 625 declared the said site surplus and transferred ownership to
the City of Saint Paul for development purposes. The City Cauncil
accepted the deed on May 12, 1981 by Cauncil File No. 276837. Planning
and Economic Development requests conveyance of the site to the Housing
and Redevelopment Authority for the cons�ruction of from six (6) single
fami.ly hames up to twelve (12) townhouses.
The School Boaxd will receive f�om Housing and Redevelopment Authority
$2�+,000.00 for the site at the time of sale from Hausing and Redevelop-
ment Authority to a private develaper.
The West Side Citizen's Organization (Planning I7istrict #3) expressed
same reservations over vacation of the public interest in th�:s site at
this time. They wauld like more consideration given to the possible
use of this site for the relocation of or in con�unction with the rehab-
ilitation of the agi.ng Riverview Branch Libraxy (across George Street
from the site).
No other public or private agencies involved have voiced any objection
to the vacation at this time.
Therefore, in view of the fore�oing, I recommend the vacation be approved,
subject to the following terms and conditions:
1. That the legal description of the property to be vacated I
read as follows:
All of Lots Six (6), Seven (7), Eight (8), �
Nine (9) and Ten (10), Block 97 West St. �
Paul Proper. ;
� '8,. That the vacation be subject to all the terms and conditions
of Chapter 130, as codified March 1, 1981, of the St. Pau1
Legislative Code, as amended.

� '�. That at the time of sale of Garf"ield School site
by the Housing and Redevelopment Authority to a
private developer, the Independent School I7istrict ..
#625 will receive from Hausin� and Redevelopment
Authority the sum of $2�+,000.00 for said site.
3 �. That the Hausing and Redevelopment Authority of
the City of Saint Paul, their assi�s or successors,
and in addition thereto, by acceptance of the terms
a.nd conditions of this vacation agrees to indemnify,
defend and save harmless the City of S aint Paul, its
off�cers and employees f�aan all suits, actions, or
claims of any character, including, but not limited
to, a claim brou�ht because of ar�y injuries, or
damages received or sustai.ned by ar�y person, persons
or property, on account of this va:cation; or because
of any act or amission, neglect or misconduct of said
petitioner; or because of aqy clai.m or liability
arising from or based on any violation of any law or
regulation made in accordance with the law, whether
by the petitioner or any of its agents or employees.
r�'�. That the petitioner, being the City of Saint Paul,
shall not be required to pay compensation or post
a bond.

I flzrther recommend that the proper City officials be authorized to
convey, by Quit Claim Deed, title of the sub�ect property to Housing
and Redevelopment Authority.
