PROCEEDINGS : Jerry Kern explained that the building has four stories , ithe

and fourth floors are used for dead storage . The first and second fl ors
have three exitways , and the third and fourth have two exitways , one , n
enclosed stairway to the outside , and the other, a fire escape which d es
not extend all the way to the ground. The code requires two exitways o

storage, Mr. Kern said the city does not have any strong feelings about
this de�iciency.
Ms . Rose said that no one worked on the two upper floors , and it was neces-
sary to go up there no more than once or twice a month to get materials
stored there . �
BOARD ACTION : Mr. Gausman moved that a variance of the code be granted to
permit occupancy of the four-story building where the second means of
egress from the third and fourth floors _does not extend to ground level ,
so long as these two floors are used only for storage. Mr. Knutson �
seconded. • MOTION CARRIBD AND SO ORDERED. �

SUBJECT: Request extension of time or variance of Section 54. 11, to pe�mit
occupancy of three units on second floor sharing one b at}�room facility �nd
one -third floor unit where the bathroom facility is loca�ed outside of the
unit , because of financial hardship.
APPEARANCE: Thomas Crawford
PROCEEDINGS: Mr. Crawford said there were several items he was required
to complete b efore the city would "renew the Certificate of Occupancy, and
he was complying with all work orders except those listed in his appeal.
He said the apartments in question were small , never occupied by more than
one person.
Chairman Glassman called attention to a letter he had re�ceived from Mer�iam
Park Community Council , wherein the council recommended that a variance be
granted to allow no more than four persons in three second floor units !to
share one bathroom facility, and there was no objection to the third flpor
apartment where the bathroom was located outside its walls .
Alice Bijjani reported that the inspector had �ound the building to be well-
maintained.
BOARD ACTION: Mr. Tilton moved that a variance of Section 54. 11 be
: grante to permit occupancy of three second floor units where one bathroom
facility is shared by no more than four persons , and to permit occupancy
o� one third floor unit where the bathroom facility is located outside�

SUBJECT: Request waiver of Vacant Building Registration fees until property
is olc�, bec�ause of financial hardship.
APPEARANCE: W. Timothy Malchow
PROCEEDINGS : Mr. Malchow stated that Elsie Townsley was a 79-year-oid
wi ow w o ias lived in a subsidi2ed high-rise building since moving out of
her house in 1979. She has income of about $400 per month and is in quxte
poor health. Attempts had been made to se11 the house in the past, but
Mrs . Townsley was mot the sole owner and there were objections by some of
the heirs . The house has remained vacant. Mr. Malchow had recently ob�tained
a court order to allow sale of the property. It was appraised at $10 ,000 ,
although the city' s assessed value is carried at $34,000 and he has filied
an appeal for an abatement. He asked that payment of the registration fees
be waived and the filing fee of $10 for the appeal be returned.
Chairman Glassman said that in past cases of this type , the board has s�ome-
times granted a temporary waiver of fee payments until a property is soild,
at which time the fees are to be paid from the proceeds . Another way tlo
h andle it might be 'to waive payment of the $45 quarterly fee now due far
the first three months , but if the property is not sold by that time , tihe
amount of the fees due could be assessed against the property. '
BOARD ACTION: Mr. . Sawyer moved that nayment of the registration fees qf .
� 45 ue at t�iis time for the ensuing three months be waived. If the property
is not sold during that period, registration fees shall be assessed against
the property and become payable at the time it is sold. Mr. Tilton sectonded.
MOTION CARRIED AND SO ORDERED.
THE VOTE: Ayes - 6 Nays - 0 Abstentions - 0 �
BOARD ACTION: Mr. Sawyer moved that the $10 filing fee be refunded.
