RESOLUTION DIRECTING THE DNISION OF PARKS AND RECREATION TO ENTER INTO A
JOINT-USE AGREEMENT WITH THE SAINT PAUL PUBLIC SCHOOL DISTRICT FOR

5 WHEREAS, the City is the owner of Arlington/Arkwright Park located within the corporate
6 limits of the Ciry of Saint Paul, and
WHEREAS, the District desires to construct a baseball field for the Arlington High School, and
WHEREAS, the District has funds to construct said baseball field, and
9 WHEIZEAS, upon completion of the Arlington High School baseball season, said field will be
10 available for City use, and

WHER.EAS, the City is in need of good quality baseball fields and soccer fields, and
WHEREAS, the City desires to construct a soccer field at the Arlington/Arkwright site, and
WHEREAS, the City has funds to construct said soccer field, and
14 WHEREAS, the ArlingfonlArkwright Park site has adequate space to develop both a baseball
15 and a soccer field, and
16 WHEREAS, the District will construct the baseball and soccer fields under one construction
17 contract with costs for each field type identified through the bidding process, such that the City can
18 reimburse the District far soccer field construction costs plus related design and engineerina fees,
19 NOW, THEREFORE BE IT RESOLVED, that the proper City officials are hereby authorized
20 and directed to enter into a joint use agreement with Saint Paul Public Schools for the construction of a
21 baseball field and a soccer field at the ArlingtoniArkwright site, and the subsequent joint operation of
22 said basebali field, and
23 FINALLY RESOLVED, that the proper City officials are hereby further authorized and directed
24 to reimburse the District for the construction cost, including design and engineering fees, of the soccer
25 field from fund C00 �T102 in an amount estimated not to exceed $125,000.00.

3.1 District shall be responsible for all maintenance during the period the
District has exclusive use. Maintenance includes �ass cuttin�, field
prepazarion and general upkeep.
3.2 City shall be responsible for all maintenance during the period the City has
exclusive use. Maantenance includes grass cutting, field preparatiott and
general upkeep.
33 District shall be responsible for all maintenance and repairs of the
irrigation and plumbing systems, including "blowing out" the systems in
the fall.
3.4 District sha11 be responsible for a11 repairs of the fencing, benches,
bleachers, storage facilities or other facility amenities.
3.5 City shall be responsible for all maintenance and upkeep of parking lot.
3.6 District sY�all be responsible for at least two portable toilets and regulaz
servicing of said toilets during the period when the District has exclusive
use.
3.7 City shall be responsible for at least two portabie toilets and regulu

should be included in the City's annual fertilization and weed control plan.
3.11 City and District shall jointly agree on rules and regulations.
4. INDENINITY
The City and District agree to indemnify and hold harmless the other from and
against a11 claims of whatever kind that may arise from use of the baseball field.

13 District agrees to include City's soccer field in its construction packa�e
itemized in bids such that City can rennburse District.
1.4 Aistrict agrees to provide design and engineering services for the entire
project, and to administer the conshucfion contract, monitor the work,
make payments, etc. District agrees to require its contractor to name City
as additional insured on all insurance documents.
1.5 City aa ees to reimburse District upon completion of the work, including
both design and engineering expenses, and the cost of construction for the
City's soccer field.
2. USE
2.1 District shall have exclusive use of the baseball fieid property annually
during the period in the spring from when the field is ready for play
without damage to the turf ( on or about April 1) until the end of the
normal Minnesota State High School League Baseball Season (on or about
June 15). City and District will jointly determine when the turf is ready
for play.
2.2 City shall have priority far use during the period listed in 2.1 once the
needs of the District have been met. City use sha11 be by approval of the
District's representative.
2.3 City sha11 ha�e exclusive use of the baseball field pxoperty during the
period from the end of the AistricY s use (on or about June 15) until
October 31.
2.4 District shall have priority for use during the period listed in 2s.3 once the
needs of the City have been met. District use shall be by approval of the
City's Supervisor of Municipal Athletics.
2.5 The baseball field properiy shall not be used during the period from
Novembex until the District and City jointly determine when the turf is
ready for play.
2.7 City and District shall use said baseball field for such related lawful
activities which would be common to that type of facility.

AND
INDEPENDENT SCHOOL DISTRICT, NO. 625
THIS AGREEMENT, dated this day of 2000, by and
between the City of Saint Paul, Minnesota, a municipal corporation arganized and existing under
the laws of the State of Minnesota, hereinafter referred to as "City" and Independent School
District No. 625 existing pursuant to laws 1965, Chapter 705, as amended, hereinafter referred to
as "Districf".
WITNESSETH:
WHEREAS, the CITY is the owner of certain real property know as Arlington & Arkwright
Park, which is located within the corporate limits of the City of Saint Paui, and
WHEREAS, said properties are legally described as shown on Exhibit "A" attached hereto, and
WHEREAS, District desires to conshuct a baseball field on a portion of the Arlington/Arkwright
site, which is more particularly described on Exhibit "B" attached, and being a part of this
Agreement, and
WHEREAS, City desires to construct a soccer field on a portion of the Arlington/Arkwright site
adjoining the baseball field, also described on E�ibit "B".
WHEREAS, the Ciry covenants that it has good and sufficient title to the property, and
WHEREAS, the District herewith covenants and agrees that it will use said premises for the
purpose intended to-wit: the construction of a baseball field and such related uses which would
be common to that type of facility or any lawful athletic use as agreed upon by the parties hereto,
and
NOW THEREFORE, it is mutually agreed by and between City and District as follows:
CONSTRUCTION
11 City agrees that District shall have the right to constrnct during 2000-2�01
construction season.
1.2 City and District agree to cooperate in planning and design of the project.

3.1 District shall be responsible for all maintenance during the period the
District has exclusive use. Maintenance includes �ass cuttin�, field
prepazarion and general upkeep.
3.2 City shall be responsible for all maintenance during the period the City has
exclusive use. Maantenance includes grass cutting, field preparatiott and
general upkeep.
33 District shall be responsible for all maintenance and repairs of the
irrigation and plumbing systems, including "blowing out" the systems in
the fall.
3.4 District sha11 be responsible for a11 repairs of the fencing, benches,
bleachers, storage facilities or other facility amenities.
3.5 City shall be responsible for all maintenance and upkeep of parking lot.
3.6 District sY�all be responsible for at least two portable toilets and regulaz
servicing of said toilets during the period when the District has exclusive
use.

£ertilization, weed control and aerafion. Fertilization and weed control
should be included in the City's annual fertilization and weed control plan.
3.11 City and District shall jointly agree on rules and regulations.
4. INDENINITY
The City and District agree to indemnify and hold harmless the other from and
against a11 claims of whatever kind that may arise from use of the baseball field.

13 District agrees to include City's soccer field in its construction packa�e
itemized in bids such that City can rennburse District.
1.4 Aistrict agrees to provide design and engineering services for the entire
project, and to administer the conshucfion contract, monitor the work,
make payments, etc. District agrees to require its contractor to name City
as additional insured on all insurance documents.
1.5 City aa ees to reimburse District upon completion of the work, including
both design and engineering expenses, and the cost of construction for the
City's soccer field.
2. USE
2.1 District shall have exclusive use of the baseball fieid property annually
during the period in the spring from when the field is ready for play
without damage to the turf ( on or about April 1) until the end of the
normal Minnesota State High School League Baseball Season (on or about
June 15). City and District will jointly determine when the turf is ready
for play.
2.2 City shall have priority far use during the period listed in 2.1 once the
needs of the District have been met. City use sha11 be by approval of the
District's representative.
2.3 City sha11 ha�e exclusive use of the baseball field pxoperty during the
period from the end of the AistricY s use (on or about June 15) until
October 31.
2.4 District shall have priority for use during the period listed in 2s.3 once the
needs of the City have been met. District use shall be by approval of the
City's Supervisor of Municipal Athletics.
2.5 The baseball field properiy shall not be used during the period from
Novembex until the District and City jointly determine when the turf is
ready for play.
2.7 City and District shall use said baseball field for such related lawful
activities which would be common to that type of facility.

BETWEEN THE CITY OF SAINT PAUL, ARLINGTON AND ARK�VRIGHT FIELD
AND
INDEPENDENT SCHOOL DISTRICT, NO. 625
THIS AGREEMENT, dated this day of 2000, by and
between the City of Saint Paul, Minnesota, a municipal corporation arganized and existing under
the laws of the State of Minnesota, hereinafter referred to as "City" and Independent School
District No. 625 existing pursuant to laws 1965, Chapter 705, as amended, hereinafter referred to
as "Districf".
WITNESSETH:
WHEREAS, the CITY is the owner of certain real property know as Arlington & Arkwright
Park, which is located within the corporate limits of the City of Saint Paui, and
WHEREAS, said properties are legally described as shown on Exhibit "A" attached hereto, and
WHEREAS, District desires to conshuct a baseball field on a portion of the Arlington/Arkwright
site, which is more particularly described on Exhibit "B" attached, and being a part of this
Agreement, and
WHEREAS, City desires to construct a soccer field on a portion of the Arlington/Arkwright site
adjoining the baseball field, also described on E�ibit "B".
WHEREAS, the Ciry covenants that it has good and sufficient title to the property, and
WHEREAS, the District herewith covenants and agrees that it will use said premises for the
purpose intended to-wit: the construction of a baseball field and such related uses which would
be common to that type of facility or any lawful athletic use as agreed upon by the parties hereto,
and
NOW THEREFORE, it is mutually agreed by and between City and District as follows:
CONSTRUCTION
11 City agrees that District shall have the right to constrnct during 2000-2�01
construction season.
1.2 City and District agree to cooperate in planning and design of the project.
