Subject: Petition of the City of Saint Paul for the
vacation of a part of North Wheeler Avenue
Public Hearing - February 16, 1982
George Latimer, Mayor of the City of Saint Pa.ul, on behalf of the Department
of Communit;r Services and the District 11 Plannir� Coalition, requests that
the City Council grant this petition. The purpose for this vacation is to
combine the existing Newe L ?�rk with the lan3s recently acquired for park
purposes . The area to be vacated consists of 7,056 square feet and is
zoned R-li (single �'a.mily residential) .
The Department of Public Works reports that a private easement for an exist-
ing 8-inch sanitar�r sewer stub constructed in North Wheeler Avenue extends
north irom Taylor A venue to Pierce Butler Route mustbe retained for the
owners (Burlington Northern R�.ilroa.d) protection. The Department of Public
Works has no objection to the proposed va.cation subject to the private ease-
ment rights of the existing sewer stub,
There were no objections from any other public or private agency involved.
I, therefore, recommend the va.cation petition be approved, subject to the
i'ollowing terms and conditions :
i. That the 3escription of the s-treet to be vacated read as
follows:
All that part of the West one-ha.lf (1�2) of Wheeler
Street lying between the Easterly extension of the
Southerl,y line of Lot 5, Block l, and the Easterly
extension of Northerly line of Lot 1, Block l, all in
College Place Marshall's Division; also
A11 that part of the E�.st one-half (1�2) of Wheeler
S-�reet lying between the Westerly extension of the
South line oi Lot 12, and the Westerly extension of
the North line of Lot 16, all in Block 5 of MarsY�all's
Division of College Place.
�.2' That the vacation be subject to all the terms and conditions
of Chagter 130, codified March 1, 1981 of the St. Pa.ul Zegis-
lative Code, as amended.
