That Section 34. 08 of the Saint Paul Legislative Code, pertaining to requirement fo,r exterior property area, as amended by Ordinance 16844 , ICouncil File 277558, be and the same is hereby amended as follows: (8) Storage of firewood, etc. It shall be unlawful to accumulate and store building material, lumber, firewood, boxes, cartons, or other containers, machinery, scrap metal, junk, raw material, fabricated goods and other items in such manner as to become infested with rodents. 5tored items must be elevated at least 12 inches off the ground. Firewood, in piles exceeding 20 cubic feet, must be located at least ten feet from buildings used for human habitation, and may be piled no more than six feet high, from the point of elevation above grade. Section 2 . This ordinance shall take effect and be in force 30 days from after its passage, approval and publication. This ruling poses an unreasonable inconvenience to those many �citizens af ' St Paul who choose to heat with wood. I would aerrture that it is so restrictive that many of us �r�ll no longer practice wood-burning; hence ' we will . loose on our equipment investments, and will be frustrated in keepi.ng our cor,�mitment to anialternate energy saurce. � , Yards around most St Paul homes are relatively smali . If wood must � b� 10 fieet f�om houses and. g�rages, gard�ning and leisure activities ' will be. s�vere]y restricted and reduced in many cases. Wood burners � i.lvj�ng in multiple units will doubtlessly be affected even more seyerely because often there 'simply would he no space to accomodate wood in accordance with the new ordinance. If, for QXdEi1��If:� I pile g7�ecri vaK � 6 feet h�gh (�he maximum according to one interpretation of the ambig- � uously Worded ordinance) , then each 4-X-8-foot sections would bear 2.6 tons, Should the p]atform be weak, then it will pose a serious hazard, particularly to small children, because it might collapse r�ear somcone. The wood-piling ordinance is intended to discourage rc�dents, a commen- dabie goa1 in view of thas po�entially serious problem. Nowever, does i th�s ordinance reflect a good balance between the �eas�nable ?�nterpsts i of w.00d burners and the assurance that rats will be curbed? I can't speak for other neighborhoods, but certainly rats are not a problem in ours. As lang as residents do not leave garbage accessible to rats, ar to dogs who can make i� accessible to rats, then the rodents should not be able to survive regardless;�of how �uch �.shelter 'i:����available. May � suggest that the issue of how we pile our firewood and how we discourage rats in residential neighborhoods be reviewed again. Based upon our anaZysis of their responses, I am submitting the attached amenclment to the ordinance for your consideration. The major change in the revised ordinance would be to exempt common-wall residences and accessory buildings fram the distance requirement as it relates to fire wood. The reason for exempt- ing common-wall residences (by which is meant townhouses, con- dominiums, caoperative residences) is that there is usually little yard space with these types of dwelling unit~ and storage of fire wood is difficult. THE COUNCIL OF THE CTTY OF SAINT PAUL DOES ORDAIN: Section 1. That Section 34 . 08 of the Saint Paul Legislative Code , pertaining to rec{uirement for exterior property area, as amended by Ordinance 16844, Council File 277558 , be and the same is hereby amended as follows : (8) Stoxage of firewood, etc. It shall be unlawful to` accumulate and store building material , lumber, firewood, boxes , cartons or other containers , machinery, scrap metal , junk, raw material , fabric�ted goods and other items in such manner as to become infested with rodents . Stored items must be eleVated at least ��12 inches off the ground. Firewood, in piles exceeding 20 cubic feet must be located at least ten eet rom buil Yngs used or uman habitation, and may be . piled no more t an six eet ig , rom the point of elevation above grade. Section 2 .
