Willia.m Donova.n yaluation and Assessment Engineer Date: June 28, 1982 Subject: Petition of Midwest Special Servica� Inc. for the va.cation and release of certain sewer easement and an open ditch dre.in easement in Lots 7, 8 and 9, Collings addition of out I,ots to Saint Pe.ul. Public Hea.ring - Jti7�y 20, 1982 Midwest Special Services, Inc. requests this vacation in order to construct -- a new 52,�+22 square foot building to hause a special sheltered workshop for 120 disa bled workers, a developmental achievement center for 60 disabled participants, offices and a wa.rehouse. The building must sit on the south and ea.stern pa.rt of the property because the best soil conditions exist there. Because of that location, a s�ll portion of the northwest corner of the building will sit over the existing sewer that is running through the property. The existing easements need to be vacated and closed off in order to complete the building. The petitioner has proposed a new sewer ea.sement to be dedicated by him to the City of Saint Pa.ul. The total area to be va.cated consists of 17,400 square feet and is zoned I-1 (Industry). Northern States Pa�rer Compar�y reports an ov�erhead distribution electric line ' crossing over part of the proposed easement area. They request tha.t their interest be protected. The Depe.rtment of Public Works, Y�.ving reviewed the proposed vacation area, requests that the follawing terms and conditions be i.nclu,ded as requirements of the vacation: l. The rema.ining sanitary se�wer in Case Avenue �om Johnson Parkway wester]y to the alley must be reconstructed to flcsw in the opposite direction (to the east), and all private connections must be reconne.cted before the ea.se- ments are vacated and before the existing se�wers are abandoned, all to be acco�plished by the petitioner at its awn expense and to the sa.tisfaction of the Sewer Engineer. 2. A new 30-foot wide perm�nent storm sewer and drainage easement must be dedicated to the City for the fliture construction of a separate sewer system. There were no other recoffinendations, conditions or objections received from a�y other City department or utility compar�y in response to �qy letter of inquiry sent them on May 1�+, 1982. ` . � _ R�ir 0 J,��� -2- In view of the foregoing, I recommend that this va.cation be approved subject to the following terms and conditions ; 1. Tl�at all sewer, open ditch, drainage and temporary construction easements to be vacated and released are loca.ted in the following described area to wit; Parcel 1. Lot 7 except the West 136•55 feet thereof, and also except the East 167.62 feet of the South 100 feet thereof, Collings addition of Out Lots to Saint Paul. Parcel 2. Those portions of Lots 8 and 9 in said Collings addition of Out Lots to Saint Faul, which lie southeasterly of the right-of way of the St. P�ul, Stillwater and Taylor's Falls Rail.way, naw the Chicago, St. Pa.ul, Minneapolis and O�ha Railwa.y, excepting from said portions of I,ots $ and 9 that certa in strip of land 40 feet in width lying and being upon the Northwesterly bnundary of said portions of Lots 8 and 9 and the boundary line between said right- of way and �+0 foot strip of said Omaha Railway, and the said lands of William C. Then proceeding north to a point 435 feet north of the south property line and 70.46 feet east of the west property line. Then proceeding direct�y to the center of Case Street at the east property line.
