The following list o� items as to why we ob�ect to p�.ying
for paving of the Bast W�st Alley in Block 2� Nelson Park from
vacated Rogers Street to ' the North-South Alley. A1so we will
be on vacation the week of July 11� and una;ble t4 atter�d t�ie
July 14 meeting. �
1 ) We feel there was 'much dishonesty and behiMd the b�,ck
tactics used by Mr. Leo Schouveller-1037 Scheffer and
former Councilman �George MeMahon to g�t this �,lley
approved.- We can not prove this but can go by otu.y
what we saw and he,ard. We feel Mr. G.. McMahoa got his
just award im the resent election.
2) Once before Mr. Schouveller along with a Mr. Richard
Schneider (wko formerlly recided at 10�1� Scheffer)
approximately i8 y�ears a��o: also petitioned for said
alley and because they did not get erlough sigr�atures
someone forged our na,ne and other neighbors on the
petitioM. �t that time we talked to Councilman t�t�.
Daglish who shpwed us the petition with our name on it
and told him that as n�t our signature� he check wi�h
others aMd eventua�ly petition was denied.
3) We have resided at ' 1025 SchePfer for 23 years in all
this time all conc�rned (9} neighbors were denied a
p�emit to build a gar�,ge facing said alley because of the
freeway and were tc�ld alley could not be graded until free-
� way was completed and emergency turns made so m�st of us
had to put in a frdnt approach for ga.rages«
4) Mr. Leo Schouvellen also had a front approach to a garage
and still does.- H� built a newer garage facing said alley
2 years ago and then proceded to start petition for alley.
How did he get the 'permit?
5) Three signed the pe�ttion gor alley 6 agair:ist. Thougrit �
majority rules in �uch cases. Rumor has it the other two
signers were told a{].ley would be free if put in.
6) we have the only completed a].ley in this ares tha� ends at
the freew�.y (7block' a�rea)because everyone else was also
told no alley could� be completed until freeway was co�-
pleted.

hearing was laid over from Dec. 5 until Dec.- 9.- d1s�
made phone calls to verify this �.nd when we shcwed up
on Dec. 9 we wexe told hearing was held on Dec� 5,. 198�.
8) Showed up for a�.l other council meetings... �ren though �
all those opposed showed up ( b fam3lies), and only
Mr. Schouveller (1 ) �,g.peared for tk�e petition the
petition was Q..�.. by the emuncil.�

The meeting was called to order by President Maddox at 10:05 A.M.
Present - Councilmen Hunt, Levine, McMahon, Showalter, Tedesco, President Maddox. . .6

President Maddox noted that Councilman Wi on was attending another meeting
outside of City Hall and would arrive shortly,

In the matter of grading and paving the east-west alley in Block 2, Nelson Park
from vacated Rogers Avenue to the north--south alley, under P.O. 275854.
Mr. Byers, 1038 Bayard, expressed concern about the pro�ect and Mr. Kuhfeld of
� the Public Works Staff explained that the project was initiated by three of the
nine property owners affected.
Councilman McMahon said the people in favor of the alley have an unfortunate
situation in the su�er because of water problems and the state did some grading
in connection with the I-35E project which left a bad situation.
He moved approval of the orders.
Councilman Maddox noted that the Public Works Committee reviewed this matter last
Friday and recommends approval.
Councilman Wilson arrived at this point in the meeting.
At the question of Councilman Maddox, Mr. Warn of the Finance Department explained
the deferred assessment policy available to senior citizens.
Mr. Byers expressed concern,that a decision on this matter has already been made
and Councilman Levine said there is concern that the people were not aware of the
Public Works Committee consideration.
Councilman Tedesco moved that the matter be laid over for two weeks for further
study because apparently not everyone was notified of the Public Works Committee
meeting and then he withdrew his motion with the understanding that the matter
would be heard today.
Mrs. Rudolph, 1025 Scheffer Avenue, said they and others will not use this alley
and at one time were told ,they could not build a garage in the alley until I-35E
was completed and most of the people put their garages in with front driveways.
Mr. Kuhfeld explained that when the state did grading they constructed part of the
alley and this proposal will connect to the alley that was improved by the state
and he said he thinks that any future changes, done as a result of state action,
would not be assessed.
Mr. Warn noted that the city is picking up a percentage of the cost of this alley
because of the unusual circumstances.
Frank Richard of the West Seventh Federation said they concur that the alley should
be completed but that the assessments should be cancelled.
Councilman McMahon moved approval of the orders and he referred to the situation'
created by the state.
Representative Tom Harens said he thinks the alley should be completed but expressec
concern about the assessmeiit and he said he would be willing to aid the city if
necessary through legislative action.
