As you are all aware, this financing plan has been the subject of considerable controversy over the past several years. I believe al,l parties are now in agreement regarding a long-term solution to this diffic�ult issue. Staff is now prepared to recom- mend that the following financing plan be adopted by the City Council. 1. From July 1, 1982 and therea�ter, costs for Town Square Park will be allocated between the so-calTed Town Square "Loft" and the balance of the public space on the lowe�^ three levels. The Loft is understood to mean all of the costs associa�ted with the park on the fourth level, the scenic elevator, the two escalators between the skyway and the loft level, a�d fountain system on all l�vels, _ . 2. Oxford Development will be r sponsible for 100� of the costs on the lower three levels which are not i�cluded in the Loft definition as explained above. 3. The costs for the Loft will be spread on downtown property owners through a service charge formula as detailed by Bill Donovan, the Director of Assessments and Valuations fo�r the City. 4. In consideration for Oxford assuming 100% of the costs of the lower three levels, the City will agree t�b provide development assistance in the form of a contribution toward the operation and maintenance costs of the Town Square public space as follows: Operating Year I Contribution 1982-83 I $250,000 1983-84 150,000 1984-85 125,000 1985-86 I 100,000 1986-87 50,000 I -2- The source of this development assistance is tax increment revenue provided as a part of the Seventh Place Project Redevelopment and Financing Plan. The so-called Seventh Place Tax Increment Project operates on a calendar year basis as opposed to the July to June budget year for the Town Square oper$ting budget. Consequently, the allocation that is proposed from downtown tax increment proceeds is as follows: 1982. $150,000 1983. � 175,000 1 � 1984 150,000 • � 1985 100,000 1986 100,000 Total $675,000 It is estimated that over the next five years the total cost for the public space will equal $3,929,548. This figure assumes that the operating budget for the total public space (Town Square Loft and the lower three levels combined) will increase at a rate of approximately 10%. Using these assumptions, the $675,000 of City financial assistance from the Downtown Tax Increment District will equal approximately 17% of the total costs for the public space over the next five years. It should be emphasized that the City assistance declines over time and that as of July 1, 1987 Oxford Development will be responsible for 100% of the cost of the lower three levels without any City assistance. Attached to this memorandum are copies of the detailed assessment plan as prepared by Bill Donovan's office, a map of the downtown area illustrating the four zones of properties which will be affected, the detailed 1982-83 operating budget for Town Square, and a copy of the proposed amendment to the Downtown . The grounds for the �.ppeal from said assessments and service charges levied against said properties to finance and apportion the cost of sai�d improvements are as follows : 1. That the asses$ments , in each instance , are fraudu- lent, in that the City Cpuncil was aware of the absence of any economic benefit to the �roperties as a result of said "improvement" to be finajnced by said assessments. 2. That the asse�sments are made upon demonstrable mistakes of fact and lavV. 3. That the asse�sments , in each instance , are in an amount in excess of thejactual benefits to the above properties being assessed; the act�h�al benefit being none. 4.
