Subject: Petition of Farm Cr dit Banks of St. Paul, et al, for the
vacation of the all y in Block bounded by E. Eighth Street,
Jackson, E. Ninth S reet and Temperance Street.

The Farm Credit Banks, et al, s the petitioners and sole oFraers of the
abutting property to the propo ed va.ca.ted alley requested this vacation
to permit a more effective uti ization of their land. The area to be
va.cated is an improved alley 2 1.13 feet long and 15 feet wide consisting
of 3016.95 sq.ft. The area is oned B-5 (Business) .
The Department of Public Works ha.s no objections to this vacation.
Northern States pvwer Compar�y reports that they have overhea.d conductors
in the proposed va.cation area. They request that their interest be protected.
The Northwestern Bell Telephon� Compar�y reports that they also Y1ave aerial
conductArs in the proposed va tion area. They request tha.t their interest
be protected.
There were no objections from rLy other public or priva.te agencies involved.
In view of the foregoing, I re ommend the �ra,cation be approved, sub�ect to
the follawing terms and condit'ons:
1. That the descriptio of the alley to be vacated read as
folluws:
All of the alley in V. D. Walsh's Rearra.ngement
of Lots 1 2, B1'k. 16, Robert & Randall's
Add, and B�.'k 7, Hoyt's Add, in the block bounded
by Tempera}�ce, E. Eighth, Jackson and E. Ninth Streets,
sub�ect to streets.
(-�': That the vacation be subject to all the terms and conditions
of Chapter �0, cod'ified March l, 1981, of the St. Pa.ul
I,egislative Code, a,s amended.
y-3: That a specific eas ment be retained to protect the interest
of Northern States oiwer Compar�y within the va.cated portion
of said alley.

�-Y. That the petitioners pay to the City as ma.rket va.lue the
sum of $19,000.00 as compensation for the vacation.

amount of �2,000.00, ,and in addition thereto, by acceptance
of the terms and con itions of this va.cation agrees to
indemnify, defend an save harmless the City of Saint
Pa.ul, its officers a d employees f�om all suits, actions,
or clai.ms of ar�y cha acter, including, but not limited to,
a claim brought beca se of ar�y injuries, or damages received
or sustained by ar�y rson, persons or property, on accaunt
of this va.cation; or because of arLy act or omission, neglect
or misconduct of sai petitioner; or because of ar�y claim
or liability arising from or based on ar�y violation or ar�y
law or regulation ma. e in accordance with the law, whether
by the petitioner or ar�y of its agents or em lp�ees.
