Subject: Petition of Harry 0. nderson and Electro Plating Engineering
Company for the vacat on of a certain portion of West Ivy Avenue
Public Hearing: June 8, 1982
The petitioners, Harry 0. nderson and Electro Plating Engineering Com-
pany, being the only abutting p operty awners to the proposed vacation area
request this vacation. They cu rently awn a building with underground foot-
ings encroaching approximately o (2) feet on to Ivy Avenue. The petitioners
plan to expand their building t e full length of their lot (along Ivy) and
wish to maintain the same build ng lines they have now. Ivy Avenue will be
reduced fran 63 feet to 61 feet at this point if the vacation is granted. The
vacation area will be 157 feet y 2 feet consisting of 314 square feet and is
zoned I-1 (Industry).
Northern States Power Comp ny reports having a pole and aerial wires in
the proposed vacation area and they request that their interest be protected.
There were no objections, reco�►endations or restrictions received from
any other City department or u ility company in response to my letter of in-
quiry sent them on March 29, 1982.
In view of the foregoing, I recommend that the vacation be approved sub-
ject to the following terms and conditions:
1. That the descrip ion of the portion of said street
to be vacated be described as follows:
That part of he northerly 2 feet of Ivy
Avenue lying etween the southerly exten-
sion across s id avenue of the east and
west lines of Lot 12, Block 9, Hagers Sub-
division of L ts 1, 2, 3, 4, 5, 6, 7, 14,
15, 16, 17, 1 of Walcott's Addition to
Cottage Homes.
�.2: That the vacatio be subject to all the te�ms and conditions
of Chapter 130, odified March 1, 1981, of the St. Paul Legis-
lative Code, as mended.

act or omission, neg ect or misconduct of said petition-
er; or because of an claim or liability arising from or
based on any violation or any law or regulation made in
accordance with the law, whether by the petitioner or any
of its agents or emp� oyees.
