An Ordinance amending Chapter 60 of
the Saint Paul Legislative Code pertaining
to zoning for the City of Saint Paul and
the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes §462 .357 and §64.210
of the Legislative Code, the Port Authority of the City of St. Paul
dul_y petitioned to rezone portions of the South 1/2 of the NE 1/4
of Section 27, Township 29 N� Range 23 W, as shown on the attach�d
ma�, located on the east end of Energy Park near Lexington Parkway
and railroad tracks, from RM-2 and RM-3 to I-1 to provide parking
anc�, truck access, the petition having been certified by the Depart-
ment of Finance and Management Services on August l3, 1982 as having
been consented to by at least 67g of the owners of the area of the
pro�erty to be rezoned, and further having been consented to by at
least two-thirds of the owners of the property situated within 100
feet of the total contiguous descriptions of real estate held by
the same owner or any party purchasing any such contiguous property
within one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on August 19, 1982
conducted a public hearing for the purpose of considering the
rezoning petition, and pursuant to Section 107.03 of the Admini-
strative Code, submitted its recommendation to the Planning Com-
mission that the petition be granted; and
':�i3EREAS, The Planning Commission considered the rezoning
petition at its meeting held on August 27, 1982 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing %,��ore the Gity Council
on the said rezoning petition was duly pu�lished in the official

wholly or partly within 350 feet of the property sought to be
rezoned; and
WHEREAS, A public hearing before the City Council, having been
conducted on September 7, 1982 where all interested persons were
heard, and the Council having considered all the facts and recom-
mendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 10,
as incorporated by reference in Section 60 .301 of the Saint Paul
Legislative Code, as amendedA is hereby further amended as follows:
That property locat�d on the east end of Energy Park
near Lexington Parkway and railroad tracks, being
more particularly described as portions of the South
1/2 of the NE 1/4 of Section 27� Township 29N,
Range 23W, as shown on the attached map, be and
is hereby rezoned from RM-2 and RM-3 to I-1.
Section 2 .
This ordinance shall take effect and be in force thirty (30)
days from and after its passage� approval and publication.

Dear Sir:
On August 19, 1982, the Zoning Committee of the Planning Commission held
a public hearing on this proposed rezoning. A representative of the
Port Authority was present to answer questions. There was no testimony.
At the close of the hearing, the Zoning Committee voted 6 to 0 to recommend
approval of the rezoning.
On August 27, 1982 the Planning Commission considered the Zoning Committee's
recommendation and approved the rezoning by a vote of 12 to 0.
The rezoning is scheduled to be heard by the City Council on September 7,

F. ZONING HISTORY: On June 18, 1982, the City rezoned portions of Energy Park for
residential and business uses. At that time these two parce',s were zoned RM-3
(Parcel "A" ) and RM-2 (Parcel "6" ). Prior to 1981 , the property was I-1 .
G. FINDINGS:
1 . On September 1 , 1981 , the City Council adopted the "Energy Park Master Plan:
Folicies ," and directed that city agents examine proposals regarding Energy Park
fcr consistency with the Master Plan.
2. One purpose of the Energy Park project is "to provide a unique and attractive
• 5etting for both the development of new business and the expansion of existing
businesses. . . "
3. Energy Park Master Park policies call for shared facilties , such as parking lots ,
and direct vehicular access from Energy Park Grive for industrial uses.
4. G��B Batteries , Inc. is an existing industrial use at the eastern (Lexington
Park��ay) end of Energy Park.
5. Rezoning the two parcels will improve on-site parking and circulation for
G'�6 Batteries , Inc. 7he access rrom Energy Park Drive ���ill be improved. There
is � potential fcr shared parking with the adjacent restaurant.
6. T'r,e intent of the I-1 district is to accommodGte industriai operations and their

An Ordinance amending Chapter 60 of
the Saint Paul Legislative Code pertaining
to zoning for .the City of Saint Paul and
the zoning maps thereof.
WHEREAS., Pursuant to .Minnesota Statutes §462 .357 and �64 .210
of the Legislati�e Code, the Port Authority of the City of St. Paul
duly petitioned to rezone portions of the South 1/2 of the NE 1/4
of Section 27, Township 29 N, Range 23 W, as shown on the attached
map, located on the east end of Energy Park near Lexington Parkway
and railroad tracks, from RM-2 and RM-3 to I-1 to provide parking
and truck access, the petition having been certified by the Depart-
ment of Finance and Management Services on August 13, 1982 as having
been consented to by at least 67$ of the owners of the area of the
property to be rezoned, and further ha�ing been consented to by at
least two-thirds of the owners of the property situated within 100
feet of the total contiguous descriptions of real estate held by
the same owner or any party purchasing any such contiguous property
within one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on August 19, 1982
conducted a public hearing for the purgose of considering the
rezoning petition, and pursuant to Section 107.03 of the Admini-
strative Code, submitted its recommendation to the Planning Com-
mission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on August 27, 1982 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official
